Dear Mr. Boucher.
The St. Johns River Water Management District received your letter and plans regarding
the referenced project on January 12, 1998. The proposed modification involves the
addition of 3 patio areas, with a total of 480 square feet of impervious surface.
The proposed modifications as described in the submittal received on January 12, 1998,
will not substantially alter the system design or permit conditions. Therefore a new
smrmwater permit will not be required.

Dear Mr. Moran:
Stotler Stagg & Associates, Architects, Engineers, Planners, Inc. (SSA) has received and reviewed the
calculations for the above referenced site. However, these calculations do not comply with Chapter 90
(Floods) of the City's Code of Ordinances. For example, the detention basin routings of stormwater for the
25 year event (or 100 year if no flows are leaving the property) should be shown. The previously approved
calculations package submitted on October 24, 1995, or calculations of similar content, should be used
when making the required modifications to the detention basin.

is completely void of trees or vegetation. It is composed of
beach sand identical to the sand on the adjoining ocean frontage
property. The attached Peninsula Testing Company Soil Report
notes the Wet Season Ground Water Table at 10' or more below
elevation 11.0' or at about 0.00' elevation. The Hydraulic
Conductivity is excellent at 3.1 x 10-3cfs/ft; /ft.head=
[0.0031 x 3600= 11.16 cf/hour/ft° /ft/head)

The CN for the property is approximating 30 or less. All storm
runoff percolates into the ground immediately.

for the above referenced project based on the consultant supplied site plan and survey.
Although the site plan was previously approved, the supplied site plan has been
modified to include concrete patios behind the proposed buildings. Therefore, we can
not recommend the site for approval until the following comments are addressed
1. Six-- 10' long x S' wide x 4 thick concrete patios have been added to the site plan
but do not include material specifications: Please add a note -to plan providing
reinforcing type, if any, and p.s i of concrete to be used.
2. The new patios are located partially inside the retention area. Please show how the
retention area will be regraded around these slabs and,provide revised drainage,.-
calculations
3. Please provide a copy of the modification approval letter from the St. Johns River
Water Management District. -

The Planning and Zoning Board approved this site plan, with no stipulations, on 10-25-
95. Since the approval from the Board, the site plan was modified to add 3 patio areas,

Staff reviewed the site plan for compliance. Staff determines the plan complies with all

submitted along with the Articles of Incorporation and Declaration
Of Restrictive Covenants previously reviewed by this office.
Following my review of the Bylaws as submitted to me today, I have
the following comments:
1. There appears to be a conflict between the Restrictive
Covenants and the Bylaws in that Article III, Section 3 of the
Restrictive Covenants provides that the Developer shall have the
sole and exclusive right to elect the board of directors of the
Association until such time as 50$ of the lots have been sold or
until the Developer voluntarily relinquishes control. However, in
the Bylaws, Article III provides that the homeowners may replace
one director so selected by the developer when 5% of the units "in
the homeowners are sold" (sic). Notwithstanding the apparent
typographical error, the mechanism to determine the directors of
the Association appears ambiguous at best.
2. There is a reference in Article III, Section C(3) to
Chapter 718 of the Florida Statutes. Chapter 718, Florida Statutes
deals strictly with condominium associations and therefore any
reference thereto should be deleted unless this Association is, in
fact, a condominium organized pursuant to that Statute. Otherwise,
Chapter 617, Florida Statutes (Florida Not For Profit Corporation
Act) will apply. In addition, there are other references to "the
Act" (e.g. Article IV, paragraph H which I assume means the
Condominium Act). Again, this Act does not apply to this
development unless the development is a condominium created under
the authority of Chapter 718, Florida Statutes.

Also note that a reference to the common areas as provided in
all the documents and defined in the Declaration of Restrictions
and Protective Covenants must be attached thereto by exhibit. This
exhibit was not included in the documents submitted to this office
for review and, therefore, I suggest the City familiarize itself
and be comfortable with:
1. The common areas for which the Association will be
responsible; and
2. The assessments and maintenance costs associated with the
common areas.
