Request: For a Special Exception to allow for the on premise consumption of alcoholic
beverages at 6910 No. Atlantic Av. per Section 110-171.

Summary
A Special Exception for alcohol was granted for this property in early 1990 and
remained in effect until it expired on March 30, 2010. According to the Code "a Special
Exception shall expire and become null and void if the use granted thereunder is
abandoned or otherwise ceases to exist for a period of 18 consecutive months". Boston
Beef and Seafood ceased operations September 30, 2009 and more than 18 months
lapsed before another business serving alcohol applied for a Business Tax Receipt at
that location.
The applicant is operating a casual restaurant serving hot dogs, hamburgers, etc. and
desires to sell beer and wine as was allowed at this location in the past. The restaurant
use is compatible with surrounding uses and the request for SE is consistent with past
use and appropriate at this location.
Special Exception Worksheet and Staff Analysis
All special exception recommendations and final decisions shall be based on the following
criteria to the extent applicable:
Land Use and Zoning
Is the requested SE consistent with the intent of the Comprehensive Plan?
Yes, C-9 Commercial land use classification allows for restaurant uses and beer and wine
service is an integral part of many restaurant operations.
Is the requested SE consistent with the intent of the zoning district in which it is sought?
Yes, restaurants are principal uses in C-9 Commercial zoning.
Will the SE meet all the requirements of the zoning district in which the request is to be
located, such as: lot requirements, building setbacks, lot coverage, height, buffers, off-
street parking, signs, storage, landscaping, etc.? The lot and existing building are
grandfathered for size, setbacks, coverage, landscaping, etc. The floor plan provided by the
applicant depicts 50 seats inside and outside of the restaurant. The Code calls for one parking
space for every three seats or 97 parking spaces. While the site plan provided does not depict
parking as currently configured, there is adequate provision for parking per code.
Special Conditions for establishments serving alcoholic beverages
Is the establishment within 300 feet of any existing church, school ground, or
playground? No.
Is the establishment within 300 ft. of the mean high water line of the Atlantic Ocean or of
the Banana River? No.
Impact to surrounding properties
Is the proposed special exception compatible and harmonious with properties and uses
in the surrounding area? Explain why. Yes. A restaurant serving alcohol is an established
use at this location and is compatible with the surrounding area.
Will the scale and intensity of the proposed special exception be compatible and
harmonious with adjacent land uses? Yes, as it is currently.
Will the traffic generated, volume and type, adversely impact land use activities in the
immediate vicinity? No.
Will the proposed special exception create any adverse impacts to other properties in the
surrounding area? Address the creation of noise, light, vibration, odor, stormwater
runoff, or other offsite impacts that would not have been created had the property been
developed as a principle use? No, this request does not change the nature of previous uses
on the site which did not create any adverse impacts to other properties in the surrounding area.
Will there be adequate screening, buffers, landscaping, open space, off-street parking,
other similar site improvements to mitigate any adverse impacts of the SE? There is
adequate screening and buffering.
Will the size and shape of the site, the proposed access, internal circulation, and design
enhancements be adequate to accommodate the proposed scale and intensity of the SE
requested? Yes.
Are signs and exterior lighting designed and located so as to promote traffic safety and
to minimize any undue glare or incompatibility with adjoining properties? Yes.
What are the hours of operation and how will they impact surrounding properties? No
additional impact.
Traffic and Parking
Is there adequate off-street parking? Yes.
Is there adequate ingress and egress, with particular reference to auto and pedestrian
safety and convenience, traffic flow, and emergency access?
Yes.
What type and how much traffic will the SE generate? Restaurant patrons.
Are there adequate loading and unloading areas? Yes.

Are adequate utilities available? Location and capacity. Yes.
Will the proposed special exception create any unusual demand for police, fire, or

Is there adequate refuse facility for the use and is the dumpster properly located and

STAFF REPORT
Request: For a Special Exception to allow for the sale of new and used automobiles
(low speed electric vehicles) in C-1 Commercial Zoning District per Section 110-
334(c)(9).
Applicant: James N. Clippert for Son Motors, LLC
Owner of property: The James W. Means, Sr. Trust, William H. Means II, Trustee
Subject property: 8075 & 8085 North Atlantic Ave. This building is attached to and
south of the VFW Post.
Future Land Use and Zoning designation: C-1, Commercial District
Surrounding zoning:
North — C-1, Commercial
East — C-1, Commercial
South — C-1, Commercial
West — C-1, Commercial
Surrounding uses:

Summary:
Son Motors, LLC assembles, sells and services low speed electric vehicles. Son
Motors moved into property addressed as 8075 and 8085 North Atlantic Ave. the first
weekend of October. They moved into the building without obtaining zoning approval or
a Business Tax Receipt.
As I understand the operation, vehicles are delivered to the site by flatbed truck where
batteries are installed, wheels are attached and tops are assembled. While the code
does not specifically address low speed electric vehicles, Staff has determined this to
be a special exception use in C-1 Commercial zoning district under Section 110-
334(c)(9) - New and used automobiles.
A Fire Code inspection will be completed by the Fire Department prior to issuance of a
Business Tax Receipt. The inspection will identify activities conducted in the building,

assess fire separation values of existing walls, and determine if there is proper storage
and disposal of hazardous materials, if any.
If the site cannot provide parking per code and/or outdoor display, additional parking will
have to be obtained via parking agreement from a property owner within 500 ft. of the
subject property.

and uses in the surrounding area? Explain why. The proposed operation should be
compatible with surrounding properties as it is surrounded by commercial uses with the
exception of residential east of and across No. Atlantic Avenue. The hours of operation
are Monday through Saturday gam — 5pm.

and harmonious with adjacent land uses? Yes.
3. Will the traffic generated, volume and type, adversely impact land use
activities in the immediate vicinity? No. Traffic generated will be customers and
loading and unloading of vehicles.

properties in the surrounding area? Address the creation of noise, light,

I am a distributor of Low Speed Vehicles known as Rugged Electric Vehicles. I am
employing a staff of local residents to sell and service these vehicles. My staff and I plan to sell
these vehicles from our location at 8075 N. Atlantic Avenue. We hope to be received by the
residents of our city and will operate within the restraints of the local and state laws. I anticipate
this will have explained what our intentions for our distribution are.

Public Works Services has concerns about the repairing/maintenance of these vehicles on the property. There is no
information included in the package concerning the planned disposal of fluids (e.g., oil, grease) and batteries, which are
known to be an environmental hazard if not disposed of properly (metals such as cadmium, chromium, etc.). We suggest
that the City request additional information from the applicant regarding these issues.
