I’ve attached an example of a form Declaration of Access Easement,
which could be utilized in a substantially similar form to establish the
easement on proposed lot 1 as discussed in my prior email (below).
Additionally, this form could be modified to include a covenant related
to fire sprinklers on any new construction on your lot per the Fire
Marshall, as indicated in my prior/below email. I believe it would be
more appropriate to note such a covenant related to fire sprinklers on a
recorded agreement rather than as a plat note.

Good afternoon Mr. Young,
As we discussed when we met last Friday, we are looking into your
request to split the lot without provision of utilities on the new lot.
We will provide a response on that issue as soon as possible, but please
understand that we were not aware of your desire to possibly split the
existing lot without ensuring utilities were provided to the new lot
until very late Friday afternoon. We will get back with you as soon as
we can.
1. Additionally, I previously provided additional comments to
City staff and discussed with your surveyor that portion of our comments
related to removing the access easement from the plat legal description
such that only property you own in fee simple is included on the plat
and dedication (and title opinion). Certainly, the surrounding
properties and necessary easements should remain depicted, but it should
be clear that they are not a part of the plat/subdivided property, and
should not be included in the legal description or dedication. This
revision to the legal should also be made to the title opinion.
2. This is a somewhat technical/legal concern but I question why
the title opinion and plat don’t reflect the language set forth in the
Jahn/Butler deed (page 2), which in effect provides that your existing
easement upon the Marino property is a non-exclusive, perpetual easement
and covenant running with the land, however, should the Grantee or his
assigns ever secure access to the subject property by other means, the
easement shall terminate. This language is included on the instrument
that conveyed the easement (Jahn deed). Unless you or the attorney
preparing the title opinion can provide the City with information to the
contrary, I believe this should also be included in the plat notes and I
believe at this point that the title opinion should be revised to
reflect this. If the attorney providing the title opinion disagrees
with me or has additional information, please do not hesitate to have
the attorney contact me with the additional information.
3. Please provide to the City a separate, recorded legal
instrument establishing the Access/Utility Easement located on the
proposed .45 acre Lot 1. If needed, the City may be able to provide you
with an acceptable example/form document for such an easement.
4. It is my understanding that the Fire Marshall has determined
that the 20 foot access easements are sufficient for provision of
emergency services provided that there are fire sprinklers in any new
construction on Lot 2. We would require that this be included as a plat
note and/or recorded agreement.
5. As you know, we are looking into the utilities issues and will
be in touch soon.

It is my understanding from our meeting last Friday that access to
utilities is not a requirement for a lot split but it will become an
issue when or if I should want to build a home on the new lot. I am
sending this to make sure we are all in agreement and ask that you let
me know immediately if there are any other issues that need addressing.
I am trying to avoid being informed late of a problem making it
necessary for another delay in getting this matter on the agenda for the
May P/Z meeting.
