See page 4 of the Young’s attached Variance Application which carried
the R-3 zoning designation. This request for variance was reportedly
rejected by the City Attorney. The 2010 request for subdivision never
reached the P&Z Board for review. That subdivision application was made
under the former Subdivision Chp. 98 which did not yet include the Lot
Split Ord.
For clarification, I haven’t seen a current Lot Split Application for
the Young’s recent Lot Split request. The file did refer to it as a Lot
Split? The Subdivision Plat Map Survey is quite similar to the initial
Plat Map Survey that was submitted in 2010.
The issue raised below relates to the continued error in the Zoning
Map. The Zoning Map needs to be corrected. Those who don’t know the
history stated below could be misinformed, e. g., the above Variance
Application and 1995 efforts to build townhouses.

Thanks Angela.
I saw the message Charlie Hartley sent. He is correct. We fought this
battle over the zoning map 20 years ago. Nancy and I had to appear at
Council meeting with our lawyer and a court reporter before the City
would sit up and take notice.
Charlie and I worked long hours to trace the history and show the City
the errors that had been made. We have an entire booklet that we
presented to the City showing step by step how past City personnel had
goofed.
Rocky may recall this matter. He was not Mayor, but he was on Council.

I was present during this discussion. I believe Bill Jones, tenant to
Praetorius, said part of the Praetorius property was listed as R-3 on
the zoning map and Betty Praetorius wanted to change it from R-1.
The 40 foot strip adjacent to Costa Del Sol is shown as R-3 on the 2008
Official Zoning Map. We cleared this up in a City Council meeting of
04/04/95, see attached. The City agreed that the conflict between the
Zoning Map and the Comprehensive Map would be corrected.
The discrepancy related back to the rezoning for Costa Del Sol in 1982
from R-2 to R-3 that included a 75 foot buffer zone. They extended that
buffer zone on the zoning map for R-3 along the entire north property
line from AIA to the Banana River to incorrectly include the Praetorius
40 foot section that’s on the south border of the Young Property. It
connects the Praetorius R-1 property to the Banana River.
We had meetings with the City, and letters and presentations, and the
zoning map was resolved as being incorrect. The City Council directed
that it be corrected on 04/04/95. It was corrected for the section east
of North Banana River Blvd, but has not been corrected for the section
west of North Banana River Blvd (the Praetorius strip).
This has continued to create problems and it’s apparently being seized
on once again. For example, based on this discrepancy, the Young’s
attempted to claim in 1995 that their property was zoned R-3, see
attached 1995 meeting minutes. They proposed to put in four townhouses
on their property. The Young’s have since still included in their
Subdivision applications that their property is R-3. Their prior
application for a Variance Application for the 2010 Subdivision
submittals stated their property was R-3.
We keep rehashing and revisiting the same old dead issues. This is déjà
vu all over again.
We again respectfully request that the City clear up this error and put
an end to this. It has created and continues to create a fictitious
issue that being used as justification for a change in zoning.

listed their property with Caldwell Banker and that the property is "in
the process of being re-zoned from R-1 to R-2."
