2005 Growth Management Legislation
The most significant change in Florida's growth management laws since 1985. Among the growth
management reforms included in the law, it requires all local governments to implement school
concurrency by adopting a Public School Facilities Element into its comprehensive plan no later than
12/1/08.
KEY POINTS
Three main elements — Roads / Water / Schools
What is it for?
Insure that services are "concurrent' 'with growth.
Will this stop growth?
No. It will require that the impact of Implann growth pay its fair share of the cost of the impact.
Are vested developments affected by this?
No. Vested developments are included in the planned growth based on agreed absorption rates.
Does everyone have to do this?
Melbourne Village has bem exempted. Grant / Valkaria will be exempted.
What happens if I don't agree to participate?
No Comprehensive Plan changes will be approved by the DCA.
Pilot Districts
DCA selected 6 pilot districts (Hillsborough, Indian River, Lake, Sarasota St. Johns and Walton) and awarded
a $200,000 grant to each district to assist with an accelerated schedule.

TERMS
Interlocal Agreement for Public School Facility Planning (]LA)
The existing ILA must be revised to include school concurrency and must be signed by all parties.
Public School Facility Element (PSFE)
A PSFE must be adopted into all Comprehensive Plans.
Concurrency Service Area (CSA)
School boundaries / Adjacent CSA's as the second test.
Level of Service (LOS)
Financially feasible / Tiered from existing to 100%.
Proportionate Share Mitigation (PSM)
First 3 years of plan is considered current.
ISSUES
Growth Projections
The number of new students in the CSA's, based upon agreed population projections and student
generation rates. Four sets of projections. Student generation rates are based on the Census 2000
data / verified by demographer.
Charter Schools
Not currently included in projections. Can be used as PSM if compliant with SREF standards.

SCHEDULE OF ACTIVITIES
June 24, 2005: Growth Management legislation (SB 360) was signed into law by Governor Bush.
March 17,2006: Brevard Public Schools hires Kimley Horn as the Growth Management Consultant.
June 16, 2006: Brevard Public Schools hosts a meeting of the Planners from the County and the
municipalities to discuss the Growth Management legislation.
August 15, 2006: Brevard Public Schools hosts a meeting with the Brevard County Public
Management Association to discuss the Growth Management legislation. A draft of the ILA is issued.
September 27, 2006: Brevard Public Schools hosts a meeting with the managers and planners from
the County and the municipalities to discuss the Growth Management legislation. A draft of the
Student Growth Projections is issued.
October 13, 2006: Final ILA comments are due from the County and the municipalities.
October 19, 2006: Brevard Public Schools will host a meeting with the managers and planners from
the County and the municipalities to discuss the ILA comments. A draft of the PSFE will be issued.
November 1, 2006: Brevard Public Schools will issue a draft of the Financial Feasibility Analysis.
November 2006 — March 2007: Brevard Public Schools will work with local governments to resolve
all issues.
TBD: Workshop for School Board / staff and elected officials / staff of local governments to address
any remaining issues. Suggested forum — the Summit meeting scheduled for 1/19/06.
March 2007: Agreement on the Interlocal Agreement and a School Concurrency Element with
related modifications to existing Comprehensive Plan elements.
Aprfl 2007 — March 2008: Approval of the revised Interlocal Agreement by the DCA and adoption
by the School Board and all local governments. Incorporation of a School Concurrency Element and
modification of existing Comprehensive Plan elements as necessary to address school concurrency in
the Comprehensive Plans of all local governments and approval by the DCA.

There are three main cmponerts to the school concurrency Pan that are required to be included in the, updated
Intedocal Agreement for Coordinated Planning and S&nol Carx;urrency (ILA): 1) Financial feasibility of the School
Dstrict Five -Year Capital Facilities Work Program; 2) %gulatory review of all new residential projects; and 3) Joint
planning Wth Cities, the Carty and the School [District. N/Iore guidarooe is provided through the statutes. The
following summarizes the components of interlocal agreement for school concurrency:
Update the existing Public School Interlocal Agreement (ILA) for Facility Planning to include school
ouxurrency. The ILA Wil detail the specific responsibilities of the School Board, the Carty and the Cities
to address the tin-dy delivery of adequate public school facilities at ft adopted level of ser\Ace inducing:

facility planning, based on a finai-icially feasible School [District Capital Facilities Work Program (Sections
163.3177(6)(h)(1), 163.31777, F.S. and 163.3180(13), F.S.)

identify and include this program in the ILA and an amended Capital Improvements Element of the County
and the Cities comprehensive plans. (Section 163.3180(13)(d)l., F.S.)
• The ILA \AhII establish public school Caurercy Ser\Aoe Areas ( to define the geogaphic bouriclaries
in mhch school ooncurrerr-y is measured, and include the CSAs in the updated ILA and in the supporting
data and analysis for the new Public Sd-iod Facilities Element of the comprehensive plans. (Sections
163.3180(13)(c) and 163.3180(13)(g)(5), F.S.)
• The ILA \AAII call for the adoption of Level -of -Service (LOS) standards to establish mia;NdrTurn pernissible
school utilization rates relative to capacity, and will include those LOS stanclads in the updated ILA and in
the new Public Sdxxi Facilities Element and the amended Capital Improvements Element of the
comprehensive plans. (Section 163.3180(13)(b), F.S.)
• The ILAWII call for the adoption of a new Public School Facilities Element (PSFE) into the County's and the
Oties� omprehensive plans consistent vvith the ILA and those adopted by the other local governryents
within the County. (Sections 163.3180(13)(a) and 163.3177(12), F.S., and Rule 9J-5.025, F.A.C.)
• The ILAWII call for the School [District's Pegulatory Reviewof %sidential Development, in accordance Wth
163.3180(13)(g)6, for school capacity and issuance of cletermination letter. A student generation multiplier
wII be used to determine the nevv student in -pad generated from a residential development on public
schools.
The updated ILA WII call for the establishment of Proportionate -Share Mtiqation methodology and opitions
to be included in the PSFE and the ILA. (Section 163.3180(13)(e), F.S.)
The ILA WII require an amendment to the Capital InTrovements Ben -at of the Carty and the Cities
compi4wisive plans to include the School Dstrict's Five -Year C.-Otal Facilities Program (Section
163.3180(13)(d)l., F.S.)
The ILA \AAII require the amending of the Intempyernmental Coordination Element of the corrprehensive
plan, if necessary, as set forth in Section 163.3184, F.S.
*The Town of Melbourne Village qualifies for exemption from the ILA for School Concurrency at this time.
