CITY COUNCIL
November 3. 1964
The Regular Meeting of the City Council of the City of Cape Canaveral,
Florida was held at 7:30 P.M. at the City Hall annex, 190 Jackson Ave., Cape
Canaveral, Florida.
The Meeting was called to Order by Mayor Thum and the roll was
called by the Clerk. Officials present were Mayor Richard R. Thum,
Councilwoman - Fransis Jamieson, Councilmen - Eugene Jandreau, Wm. Eberwein,
J. D. Badgett - City Manager, T. David Burns, - City Attorney, Donna J.
Anderson - City Clerk, and the Sergeant -at -arms.
The Minutes of the Regular Meeting of October 20, 1964 were read
by the Clerk and there being no additions or corrections were approved as
read.
OLD BUSINESS
Item 1. Zoning Ordinance (2nd and Final Reading)
Item 1, was passed temporarily.'
Item 2. Rids for City Hall
on a Notion by Mr. Jandraau, seconded by Mrs. Jamieson and passed
unanimously, Item 2., was tabled for two weeks until the next Regular Meet-
ing of November 17, 1964.
Item 3. Resolution - City Prosecutor
Mayor Thum read "A RESOLUTION APPOINTING A CITY PROSECUTERI
PRESCRIBEING COMPENSATION, PRESCRIHEING COMPENSATION FOR CITY JUDGE, PRO-
VIDING AN EFFECTIVE DATE." The Resolution was adopted on a Motion by Mrs.
Jamieson, seconded by Mr. Jandreau and passed by the unanimode vote of the
Council.
NEW BUSINESS
Item 1. Zoning Ordinance (let Reading),
Mayor Thum read an Ordinance No. 81 -64 "AN ORDINANCE TO BE NNOwH
AS THE ZONING ORDINANCE OF THE CITY OF CAPE CANAVERAL, FLORIDA, AMENDING
ORDINANCE NO. 11 -62 AND RELATING. TO REGULATIIKG THE NUMBER OF STORIES AND
SIZE OF STORIES AND SIZE OF BUILDING AND OTHER STRUCTURES: THE PERCENTAGE
OF LOT THAT MAY BE OCCUPIED, THE SIZE OF YARDS, COURTS AND OTHER OPEN
SPACES: THE DENSITY OF POPULATION AND THE USE OF BUILDINGS, STRUCTURES,
LAND AND WATER AREAS FOR TRADE, INDUSTRY, RESIDENCE OR OTHER PURPOSES:
FOR SUCH PURPOSES CHEATING DISTRICTS AND ESTABLISHING THE BOUNDARIES
THEREOF: DEFINING CERTAIN TERM USED HEREIN: PROVIDING FOR THE METHOD OF
ADMINISTRATION AND AMENDMENT: ESTARLISPlNG A HOARD OF ADJUSTMENT AND
PROVIDING PENALTIES FOR VIOLATION: PROVIUING AN EFFECTIVE DATE.- PAGE OFZ

Mr. Jandreau made a Motion to approve let Reading, *a. Jamieson seconded
the Notion, which passed with Mrs. Jamieson and Mr. Jandreau voting in favor
and Mr. Eberwein opposing.
Item 2. Re- Naming of North Atlantic Ave.
On a lotion by Mrs. Jamieson, seconded by Mr. Zberwein and passed
unanimously, Item 2. was tabled.
OLD BUSINESS
Item 1. Zoning Ordinance (2nd and Final)
Mrs. Jamieson made a lotion to Amend Ordinance No. 80-64 by
"Strike every thing following the Ordaining, clause and substitute in lieu
thereof the following:
Section 1.
Gasoline and Automotive service stations shall not be permitted within
2000 feet of each other within the City of Cape Canaveral, Florida.
Section 2.
Distances for the purpose of this Ordinance shall be by the shortest,
normal, regular and lawful driving route.
Section 3.
The building lnspector shall not issue a building permit for the construction
of a gasoline and automotive service station within 2000 feet of an existidg
gasoline and automotive service station or within 2000 feet of a location
upon which a valid building permit is outstanding.
Section 4.
This Ordinance shall be effective immediately upon its adoption..
Mr. Jandreau seconded the Motion and it carried with Mrs. Jamieson and Mr.
Jandreau voting in favor of the amendment and Mr. Eberwein opposing,
Mrs. Jamieson then made the Motion to Amend by striking the title
and insetting in lieu therof " AN ORDINANCE RELATING TO GASOLINE AND
AUTOMOTIVE SERVICE STATIONS LOCATED WITHIN THE CITY OF CAPE CANAVERAL,
FLORIDA; PROVIDING AN EFFECTIVE DATE." Mr. Jandreau seconded the Notion
and the Ordinance was adopted an amended with Mrs. Jamieson and Mr. Jandreau
voting in favor and Mr. Eberwein apposing.
There being no other business before the Council, the meeting was
edJourned on a lotion by Mr. Jandreau, seconded by Mr. Eberwein and carried
unanimously at 7:50 P.H.
