April 28, 1964
A Special Meeting of the City Council of the City of Cape Canaveral
convened at 7:30 P.H., on the 28th day of April, 1964 at the temporary City Hall
7410 Astronaut Hlvd., Cape Canaveral, Florida. On a Motion by Mr. Jandreau,
seconded by Mr. Murphy and passed uanimously, the Meeting was recessed to the
Fire Hall, 120 Jackson Ave., where -upon the Special Footing reconvened.
The Meeting was called to Order by Mayor Thum.
City Officials present were: Mayor Richard Thum, Councilmen; Jack
Hurck, F. L. Murphy, Eugene Jandreau and Wm. Eberwein, Donna J. Anderson - City
Clerk, John HcCarey - City Attorney, and the Sargent -At -Arms, Chief Wimberley.

Item 1. Utility Ordinance (2nd and Final Reading)
Mayor Thum gave by title 2nd and final Reading to Ordinance No. 6410
"AN ORDINANCE AMENDING AND RE- ENACTING AN ORDINANCE LEVYING AND IMP03 G A TAR ON
EACH PURCHASE OF ELECTRICITY, MF.TF.RED OR ROTTLED GAS (NATURAL, LIQUIFIED PETROLEUM
GA.G OR MANUFACTURED), WATER SERVICE, TELEPHONE SERVICE AND TELEGRAPH. SERVICE IN
THE CITY OF CAPE CANAVERAL: PROVIDING CERTAIN EXEMPTIONS AND A TAX: PROVIDING
FORTE PAYMENT AND THE COLLECTION OF SUCH TAXES: PROVIDING FOR THE APPROPRIATION
OF THE R:VENUE.i TO BE DERIVED FROM SAID TAL,.St PROVIDING A PENALTi FOR THE
FAIIIIT,' TO PAY OR TO COLLECT SUCH TAXES, OR FOR THE VIOLATION OF SAID ORDINANCEt
AND FOR OTHER PURPOSES." Mr. Jandreau made a Motion that 2nd and Final Reading
of the Ordinance be approved. Mr. Murphy seconded the Motion end the Ordinance
was adopted by the unanimous vote of the Council.
Item 2. Amendment to Zoning Map (2nd and Final - Rolanowaki)
Mayor Thum gave 2nd and Final Reading by title to Ordinance No. 64 -13
"AN CRDINANCE OF THE CITY OF CAPE CANAVERAL, FLORIDA, AMENDING ORDINANCE NO. 11 -62
AS AMENDED BY ORDINANCE No. 64 -1; TO ]=OKE A PARTICULAR PARCEL OF LAND FROM R-1
CLA"SIFICATION TO C-2 CLASSIFICATIONt PROVIDED AN EFFECTIVE DATE." On a Motion
by Mr. Jandreau, seconded by Mr. Hurck and carried uanlmously, the Ordinance
was adopted.

Item 1. Ordinance No.. 64 -11 (Meeting Place - let. Reading)
Mayor Thurm gave let Reading to Ordinance No. 64 -1I. "AN ORDINANCE.'
AMEEDING, ORDINANCE. NUM -R 64- TO PROVIDE THAT THE CITY COUNCIL OF THE CITY

OF CAE CANAVERAL, FLORIDA, MAY MEET IN REGULAR OR SPECIAL SESSIONS AT PLACES
OTHER THAN THE CITY HALL: PROVIDED AN EFFECTIVE DATE.." On a Motion by Mr.
Hurck, seconded by Mr. Jandreau, Ordinance No. 64 -11 was approved by the
unanimous vote of the Council.
Item 2. Designation of Fire Hall as City Hall Annex (Resolution)
Mayor Thurm read Resolution No. 55 "A RESOLUTION IN REGARD TO THE
DESIGNATION OF A CITY OF C.U?E CANAVEHAL, FLORIDA, CITY HALL ANNEX.e Mr. Murphy
made a Motion that the Resolution be adopted, Mr. Jandreau seconded the Motion and
the Resolution was adopted unanimously.
Item 3. Resolution (Building Inspector)
Mayor Thurm read Resolution No. 56 "R ?SOLUTION CLARIFYING DUTIES AND
TV'IPONSIBILITISS OF TIC BUILDING INSPECTOR OF THE CITY OF CAPE CANAVEnSL, FLORIDA."
On a Motion by Pr: Jandreau, seconded by Hr. Murphy, the Resolution was adopted
with Pa. Jandreau, Mr. Murphy and Mr. Eberrein voting in favor of adoption and
Mr. Hurck abstaining.
Item 4. Request for Conditional Use (Dobson)
Mayor 1hUrm read the Minutes of the Zoning Board of April 16, 1964
approving the request and the letter of application submitted by the Dobson's
through their Attorney, Mr. Meadows of Griggs a Meadows. Mr. Murphy made
Potion that the Building Inspector be directed to issue the Building Permit of
the Dobsons. Mr. Jandreau seconded the Motion and it was passed unanimously.
Item 5. Variance Request and Re- Zoning (Farris)
On a Motion by Hr. Murphy, Item 5 was referred to the City Attorney
for the preparation of an Amendment, such amendment to be placed on the Agenda
for the Regular Meeting of May 5, 1964. Mr. Eberuein seconded. the Motion and
it was passed unanimously.
Item 6. Request for Annexation (Broosier)
On a Motion by Mr. Murphy, seconded by Mr. Jandreau, Item No. 6 was
tabled with Mr. Jandreau, Mr. Murphy and Mr. Eberwein voting in favor of the
Motion and Mr. Hurck opposing.
Item 7. Discussion of Appointment of Clerk of Court Deputy
On a Motion by Hr. Murphy, seconded by Mr. Jandreau and Pas,ed unanimously
Mrs. June Kientz was appointed Deputy Clerk of Court.
Item 8. Election Code (Amendment)
Mr. Hurck ma?e a Motion that Item 8 be tabled until the 3rd Tuesday in
June. Mr. Eberwein seconded the Motion and it was passed unanimously. Mayor

7hurm announced that the City Hall would be open for registration on the following
dates: May let and 6th from 5 to 9 and on Saturday Hay 9th from 9 A.M. to 1 P.M.
Item 9. Sewerage Request Scabaroal
On a Motion by Mr. Jandroau, seconded by 'Mr.. Murphy and passed unanimously
Item 9 was tabled.
Item 10. Discussion of Ordinance 13 -62
After discussion, and an opinion of the City Attorney that there was
no violation of the Ordinance, there was no further action on Item 10.
Item 11. Amendment Ordinance 3 -62
No action was taken on Item 11.
Item 12 Re- Zoning Request (L H Aonlevate)
On a lotion by Mr. Murphy, seconded by Mr. Jandreau, Item 12 was
tabled by the unanimous vote of the City Council.
There being no other business before the Council, Mr. Hurck made a
Motion that the Meeting be adjourned. The Motion was seconded by Mr. Eberwein
and passed unanimously and thereupon the Meeting was adjourned at 9t4O P.M.
