CITY COUNCIL
April 21, 1964
The Regular Meeting of the City Council convened at 7:30 P.H. at the
Temporary City Hall, 7410 Astronaut Blvd., Cape Canaveral, Florida, and on
a motion by Hr. Jandreau, seconded by Mr. Eberwein and passed unanimously the
Meeting was recessed to the Fire Hall at 120 Jackson Ave., Cape Canaveral,
Florida, whereupon the Meeting reconvened and was called to order by Mayor Thum.
The roll was called by the City Clerk and City Officials present were:
Mayor Richard R. Thum, CouncilmeneJack Hurck, F. L. huphy, Eugene Jandreau,
lh. Eberwein, Donna J. Anderson City Clerk, T. David Burns - City Attorney.
Mayor Thum read the Minutes of the Regular Meeting of April 7th, the
Special !testing of April 13, 1964 and the Special Neeting of April 14, 1964, and
they were approved as read.
Item 1 Termination of Services of City Attorney
The following letter was read by Mayor Thum.
April 20, 1964

Cape Canaveral, Florida
Will you please place the following resolution on the Agenda for
Tuesday, April 21, 1964.
"Be it resolved that the services of T. David Burns
as City Attorney of the City of Cape Canaveral,
Florida be hereby terminated. That said services
be terminated as of April 21, 1964.11
Will you please place on the calendar the appointment of a City Attorney
for the City of Cape Canaveral, Florida.

Mr. Murphy then made a lotion that the services of the City Attorney
be terminated, Mr. Jandreau seconded the Motion. After discussion and request
for reason, Mr. Jandreau suggested that a letter be written to the City Attorney
if desired and such letter was requested by the City Attorney. Mr. Jandreau, Mr.
Murphy and Mr. Lberwein voted in favor of the lotion. Mr. Hurck abstained.
Item 2. Appointment of City Attorney
Mr.Jandrrau made aMotion to appoint John Mc Carey as temporary City
Attorney for the City of Cape Canaveral.

Mr. Hurck made a Motion to postpone the appointment for one week.
After discussion on whether the M niciple Court Judge could also serve as the
City Attorney, Mr. Jandreau made a Motion that John McCarey be appointed temporary
City Attorney. Mr. McCarey offered to serve as temporary City Attorney without
compensation. The Motion was seconded by Mr. Murphy with Mr. Jandreau, Mr.
Murphy and Mr. Eberwein voting in favor of the Motion and Mr. Hurck abstaining.
Mr. Hurck made Motion that this meeting be adjourned and the remainder
of the Agenda be postponed and be taken up at a Special Meeting on April 28, 1964.
Mr. Jandreau seconded the Motion with Mr. Hurck, Mr. Eberwein and Mr.
Jandreau voting for adjournment and Mr. Murphy opposing.
Approved as amended this the 5th day.. of May, 1964.
Correction under Item 2, Paragraph 1, line It Mr. Jandreauls first motion was
to ap,olnt John McCarey as temporary City Attorney for the City of Cape Canaveral.
