CITY OF CAPE
CANAVERAL, FLORIDA
April 14, 1964
The Special Meeting of the City Council of the Uity of Cape Canaveral
convened at 7130 P.M., at 109 Euchanon Ave., Cape Canaveral, Florida, on April
14, 1964 and on a Motion by Hr. Jandreau, seconded by Hr. Eberwein and passed
unanimously, the Meeting was recessed to the Fire Hall at 120 Jackson Ave.
whereupon the Special Meeting reconvened.
The Meeting was called to Order by Mayor Thum.
The roll was called by the City Clerk and City Officials present were:
Mayor Thum, Councilmen= Jack Hurck, F. L. Murphy, Eugene Jandreau and Wm.
Eberwein, T. David Burns - City Attorney, Donna J. Anderson - City Clerk.
Item 1. Amendment of Zoning Ordinance (Arnold) 2nd and Final Reading
Mayor Thum gave 2nd and Final Reading to the Ordinance entitled "AN
ORDINANCE OF THE CITY OF CAPE CANAVERAL, FLORIDA, AMENDING ORDINANCE NO. 11 -62 AS
AMENDED BY ORDINANCE NO. 64 -1,. TO RLZONE A PARTICULAR PARCEL OF LAND FROM R -1
CLASSIFICATION TO G-2 CLASSIFICATIONt PROVIDED AN EFFECTIVE DATE." Mr. Hurck
made a Motion that the Ordinance be adopted. Mr. Jandreau seconded the Motion
and the Ordinance was adopted by the unanimous vote of the Council.
Item 2. Amendment of the Zoning Ordinance (Dobson) 2nd and Final Reading
.Mayor Thum read by title the Ordinance "AN ORDINANCE OF THE CITY OF
CAPE CANAVERAL, FLORIDA, AMENDING ORDINANCE NO. LL-62 AS AMENDED, BY PROVIDING
A NE.i SUB SECTION TO HE ENTITLED SECTION 1 (a), ARTICLE VII WHICH PERMITS
PRIVATELY OPERATD NURSERY SCHOOLS AND KINDERGARTENS AS CONDITION USES WITHIN
R -3 ZONING CLASSIFICATION PROVIDING AN EFFECTIVE DATE." On a Motion by Mr. Hurck
seconded, by Mr. Jandreau, the Ordinance was adopted by unanimous vote.
Item 3. Amendment of Zoning Mao (Balonowski)
On a Motion by Mr. Jandreau, seconded by Mr. Eberwein and passed
unanimously Mayor Thum read an Ordinance "AN ORDINANCE OF THE CITY OF CAPE
CANAVERAL, FLORIDA, AMENDING ORDINANCE NO. 11-62 AS AMENDED BY ORDINANCE NO.
64 -1i To RiZONT A PARTICULAR PARCEL OF LAND FROM R -1 CLASSIFICATION TO C-2
CLASSIFICATICN: PROVIDED AN EFFECTIVE DATE." Mr. Jandreau made a Motion that
let Reading be approved, seconded by Mr. Hurck and the Motion passed unanimously.
Mr. Jandreau made a Motion that a statement submitted by the City
Attorney for legal retainer fees in the amount of $1,500.00 be approved for
payment. Mr. Muck seconded the Motion with Mr. Hurck, Mr. Eberwein and Mr.
Jandreau voting in favor of the Notion and Mr. Murphy opposing.

Upon an appeal by the Attorney for Roger Dobson, Mr. Murphy made a
Motion to Place on the Agenda the matter of granting the Dobson request. Mr.
Eberwein seconded the Motion. The lotion failed for lack of unanimous vote
required in placing Items on the Agenda with Mr. Murphy and Mr. Eberwein
voting in favor, Mr. Hurckopposing and Mr. Jandreau obstaining.
Item 4. lotion in Reference to Building Inspection Department'
Mayor Thum recognised. Hr. Hurck who opened discussion and spoke
at some length. Mr. !organ was then recognized, followed by Mr. Leon Stromair,
Attorney representing Mr. Morgan. Closing discussion, Mr. Stromeir suggested
that a Resolution be presented t o the Council in behalf of the Building Inspector.
On a Motion by Mr. Jandreau, seconded by Mr. Murphy and Passed
unanimously, the Heating was adjourned.
