HomeMy WebLinkAboutMinutes 04-07-1964MINUTES OF THE RELULAR MATING OF THE CITY OF CAPE CANAVERAL, FLORIDA April 7, 1964 The Regular Meeting of the City Council of the City of Cape Canaveral, Iles held at 7:30 P.M. on April 7, 1964, at the Temporary City Hall, 109 Buchanon Ave., Cape Canaveral, 4`lorida. City Officials present warn: Mayor,Itichard R. Thum, Councilmen; Jack Hurck, F. L. Murphy, Eugene Jandreau and Nm. Eberwein, T. David Burns - City Attorney, Donna J. Anderson - City Clerk. The Meeting was called to Order by Mayor Thrum. The Minutes of the Regular Meeting of March 17th and the Minutes of The Special Meeting of March 31, 1964, were read by Mayor Thum and approved unanimously. on a Motion by Mr. Jandreau, seconded by Mr. Hunk, the Treasury Report was approved by unanimous vote. Mayor Thum recognised Mr. Jim Morgan, Building Inspector for the City of Cape Canaveral, who asked that certain accusations . made by Mr. Hurck and printed in the paper be clarified or retracted. Mr. Hurck suggested that the Ttem was not on the Agenda and suggested further that the matter be taken up at a Special Meeting. Mr. Jandreau then male a Motion that the Ttem be placed on the Agenda that Mr. Hurck be invited to reply to accusations that were made in the paper. Mr. M:rphy seconded the lotion.. Mr. Jandreau, Hr. Murphy and Mr. Eberwein voted in favor of the lotion, Mr. Hurck opposing and the Motion failed for lack of unanimous vote required in Placing Items on the Agenda. There being no objections, Item 5 was moved to Item 1 on the Agenda. It— 1. Amendment of Zoning Ordinance (Arnold) Mayor Thum . read the letter of application from Mr. Joseph Arnold and from the Minutes of the toning Board of April 2nd approving the request. The Amendment to the Zoning Ordinance was given first reading by Mayor Thum, said Amendment being entitled "AN ORDINANCE OF THE CITY OF CAPE CANAVERAL., FLORIDA, AMENDLNG ORDINANCE NO. U-62 AS AMENDED BY ORDINANCE NO. 64 -1; TO REZONE A PARTICULAR PARCRL OF.. LAND FROM R -1 CLASSIFICATION TO C-2 CLASSIFICATION; PROVIM:D AN EFF=ECTIVE DATE." On a Motion by Mr. Hurck, seconded by Mr. Eberwein the let Reading was approved unanimously. PAGE I 0F3 OF THE REGULAR MEETING April 7, 1964 Page 2 Item 2 Utility Ordinance Upon explanation by the City Attorney of the changes made in the Utility Ordinance, Hr. Jandreau made a Motion that the first reading be approved. Mfr. Merck seconded the lotion and the first reading was approved unanimously. Item 3 Reappointment of Auditors_ On a Motion by Hr. Jandreau, seconded by Mr. Eberwein and approved unanimously, Montenegro & Company, Certified Public Accountants were reappointed as Auditors for the ,City of Cape Canaveral. Item 4 Revision of Budget Hr. Jandreau made a lotion that the proposed revisions of the Budget be approved. Mr. Murphy seconded the Motion and the Revised Budget was approved unanimously. Items Amendment of Occupational Ordinance At the suggestion of the City Attorney, Hr. Murphy made a Notion that Item 5. be tabled for further study. The lotion was seconded by Mr. Jandreau and passed unanimously. Item 6 Amendment of the Zoning Ordinance (Dobson) Mayor Thum read the letter of application submitted by the Attorneys for Mr. Roger Dobson, and after the let reading of the Ordinance entitled "AN ORDINANCE OF THE CITY OF CAPE CANAY-:'AL, FLORIDA, AMENDING ORDINANCE NO. 11 -62 A5 A.v2NDED, BY PROVIDING A NEW SUB SECTION, TO BE ENTITLED SECTION L (a), ARTICLE VII WHICH PERMITS PRIVATELY OPERATED NURSERY SCHOOLS AND KINDERGARTENS AS CONDITION USES WITHIN R -3 ZCNING CLASSIFICATION PROVIDING At! EFFECTIVE DATE." Mfr. Jandreau made a lotion that the word'a eas amended" in the title, line 7, be stricken. Hr. Murphy seconded the Motion and it passed unanimously. Mr. Murphy then made a Motion to strike the word "Provide" appearing in Subsection (a) in Section I (a). Mr. Eberwein seconded the Motion and it was carried unanimously. On a Motion by Mr. Jandreau, seconded by Mr. Murphy, the let reading of the Ordinance as corrected was approved unanimously. Item 7 Amendment of Zoning Mao (tialonowski) A letter from the Attorneys representing Mr; & Mrs. Balonowski was read by the City, Attorney. Mr. Murphy made a Motion that the Balonowskl Matter be removed from table (Meeting of March 17, 1964). Mr. Eberwein seconded the Motion and it was carried unanimously. Mr. Murphy then made a Motion that the City Attorney draw an amendment to rezone from H-1 to C-2 that property as specifically requested by the Balonowskis. Mk. Rank Depositor) Mr. Hurck made a lotion to transfer the City's account from the Cocoa State Bank to the First National Bank of Cape Canaveral. The lotion failed for lack of a second. letters from various banks were read by the City Attorney giving rates of interest. Mr. Jandreau made a Motion to table and after discussion, withdrew his lotion. Hr. Murphy made 'a Motion that the First National Bank of Cape Canaveral be designated as a Depository. Mr. Jandreau seconded the Motion and it was carried by unanimous vote of the council. Mr. Jandreau made a Motion that the City Attorney be directed to write a letter to the Volunteer Fire Department obaolving them or liabliity as a result of occupancy by the City of the Fire House. The Motion was seconded by Mr. Murphy and approved unanimously. Mr. Hurck made a Notion that the bill submitted by Hr. James Fulcher, Architect, in the Amount of $470.40 be approved for payment. Mr. Jandreau seconded the Motion and the !%tion passed with Mr. Hurck, Hr. Jandreau and Mr. Fberwein voting in favor and Mr. Murphy opposing. Mr. Hurck made lotion for Special. Meeting of the City Council on April 14th, to take up matters pertaining to Arnold, Dobson, and Balonowski. Mr. Jandreau made a lotion that the Matter of the City Attorneys statement be added. Mr. Murphy seconded the Motion for Special Heating on April 14, 1964 and on a Motion by Hr. Hurck, seconded by Mr. Jandreau the Meeting was adjourned by unanimous vote at 9:15 on the 7th day of April, 1964. Approved this the 21st day of April, 1964 q PAGE-5 OF3 '
