March 17, 1964
The Regular Meeting of the City Council of the City of Cape
Canaveral was held at 7:30 P.M., on March 17, 19641 at the Temporary City
11311, 109 Buchanan Ave., Cape Canaveral, Florida.
City Officials present were: Mayor Richard Therm, Councilmen,
Jack Hurck, F. L. 1larphy, 'Mn. Eberwein' and Eugene Jandreau', T. David Surne-
City Attorney, Donna J. Anderson - City Clark.
The Meeting was called to Order by Mayor Thurm.
Mr. liarphy made a Motion . that there be no smoking during the Council
Mreting. Mr. Eben�ein seconded the Motion, Mr. Jardreeu, Mr. Murphy and Mr.
Ebers:ein voted in favor of the lotion and Ma. Hurck against.
Mayor Thun3 read the Minutes of the Regular Meeting of March 3, 1964.
A correction is made in Item 1 - Zoning Map Line 3, that "Exhibit
B" he chanF.ed to "Exhibit All (indicating attached map).
Mr. Hirphy made a lotion that the Minutes he approved :.s Amended.
Mr. Jandreau seconded the lotion with lb•. Jandreau, Mr. Murphy and Mr.
Eberwein voting in favor of approval anti Mr. Hurck obsteining.
Mayor Thurm read the Minutes of the Special Mooting for Public
Hearing of March 10, 1964. On a lotion by Mr. Murphy, acconded by Mr.
Eber,ein and by unanimous vote, the Hinutcs were ap-roved as read.
The Treasury Report was read by Mayor 'Ihurm at Mr. Hurck's . reouest
and after discussion the Report was approved.,

Mr. Murphy made a Motion that the Ordinance be adopted. Mr. Jandreau
seconded the Motion.
Mr. Hurck made a lotion to Amend Rule 1.02 of Section 1 by striking
the last sentence on page 2, lines 2 through 4 and insert in lieu therof, the
following. "All Regular Meetings shall be held in the City Hall of the City of
Cape Canaveral, Florida or such other place within the City as designated by
the Council in Regular Meeting, and shall be open to the Public and the Press.
The lotion failed for lack of a Second.
Mr. Hurck made a Motion to amend Rule 1.03 of Section 1 by striking
lines 25 through 28, on page 2, beginning with the words, "of, .after reasonable
diligence."
The lotion died for lack of a second.
Mr. Hurck made a Motion that Rule 1.04 be amended by adding after the
words" of the City Council," or any person . through a sponsoring councilcan.
Mr. Jandreau seconded the Motion and it was passed by unanimous vote.
Mr. Jandreau made a Motion to amend We 1.03 by adding a new
sentence dust before Rule 1.G4 to read "All Meetings of the Council not being
in the nature of Regular or Special Meetings shall be open to the press. Mr.
Murphy seconded the Motion and it was passed by unanimous vote.
Mr. Hurck made a Motion to amend Rule 1.04 by striking the words
"ten o'clock on Friday morning, appearing on line 15, page 3, and insert in
lieu thereof "five P.H. o'clock on the Friday."
The Motion failed for lack of a second.
Mr. Hurck made a Motion to amend Rule 1.18 as followst Strike the
words "Chief of Police" appearing on line 17, page, B. and insert in lieu thereof,
the word "Council" there was no second to the Motion.
Mr. Murphy made a Notion to amend Rule 1.04 by, striking the words
10 o'clock on Friday morning and inserting in lieu thereof the words "1 o'clock
on Monday" Mr. Eberrein seconded the Notion to Amend. Mr. Murphy made a Motion
to amend the amendment by striking 1 o'clock on Monday and inserting in lieu
thereof the words "11 o'clock on Monday" Mr. Eberwein seconded the Amendment.
Mr. Jandreau, Mr. Murphy and Mr. Eber•ein voted in favor of the Amendment. Mr.
Hurck opposed.
I Mr. Jandreau, Mr. Murphy and Mr. Eberwein voted inDLvor of the Motion
as amended. Mr. Hurck opposed.

On a Notion by Hr. Jandreau, seconded by Mr. Harphy and passed by
unanimous vote of the Council Ordinance No. 19 -63 was Adopted as Amended.

Hr. Wrphy made a Notion to approve the expenditure of $2,878.10
as presented by lowest bidders. Mr. Jandreau seconded the lotion and it passed
by unanimous vote.
Mr. Jandreau made a Motion that the Building Inspector, Hr. James
Morgan be appointed to oversee the construction of the Field Novae. Hr.
Murphy seconded the Notion and it passed unanimously.
Item 2. Variance Bequest - Balonoweki
Mayor Thum read the letter of application for variance and the Minutes
of the Zoning Board of March 5, 1964, approving the Request.
Mr. Hurck made a Notion to Grant the Request and after discussion
withdrew the Motion. Mr. Jandreau then made a Potion to Table the Matter. Hr.
Harphy seconded the Motion and the Notion passed with Mr. Jandreau, Mr. Yarphy
and Hr. Eberwein voting to Table and Mr. Harck opposing.
Item 3. Variance Request - Dobson Kindergarten
Mayor Thum called a short recess and upon resuming the Meeting,
an application for a Variance Request by Roger Dobson was read. Mayor Thum
read from the Minutes of the Zoning Board of March 5th approving the Request.
Mr. Jandreau made a lotion that the Request be granted. Hr. Murphy
seconded the Motion. After discussion, Mr. Murphy withdrew his second, Mr.
Jandreau withdrew his lotion and Mr. Hurck made a Motion to table the Request.
Mr. Jandreau seconded the lotion and it was passed unanimously.
Mr. Hurck made a lotion that the new zoning Ordinance now being
prepared by the City Attorney include the category of Kindergartens and
Nurseries in R-3 under conditional uses. Hr. Jandreau seconded the Motion and
it was passed unanimously.
Item A. Consideration of Re- Zoning area zoned R -1 located on Astronaut Blvd.
This Item was removed from the Agenda by Mr. Jack Molene who originally
placed the Item.
Item 5. Discussion of the 'Gadget
After discussion the Council went on to the next ltem an the Agenda.
Item 6. Approval of Jail Construction
Mr. Dhrck made a Notion to disapprove the Construction of the Jail on
the basis that Sunda were not appropriated in the Budget. The lotion died for
lack of a Second.

Mr. Jandreau made a Motion to adjourn, seconded by Mr. Harphy
and passed unanimously.
