The Special Meeting for Public Rearing continued at 7:30 P.M. at
120 Jackson Ave., Cape Canaveral, Florida.
City Officials prosent worst Mayor Richard R. Thum, Councilman;
Jack Rurck, F. L. Murphy, Wm. Eberwein, and Eugene Jandreau, Donna J. Anderson -
City Clerk, T. David Darns, City Attorney.
The Meeting ties called to Order by Mayor Thum.
Mayor Thum read from the Minutes of January 14th; 1964, and from
the Minutes of February 11th, 1964, at which the Public Hearing recessed
until this date,
Thu City Attorney read 'a letter from Mr. Kenneth D. Woodburn,
Biologist, Florida Board of Conservation, which letter in hereby made a part
of the Minutes.

extension of bulkhead line In Banana River
Gentlemen:
The bulkhead line extension proposed by the applicant lies from 3870 feet
to 5100 feat offshore the applicant's recent fill. A platprop•.rad by the
Brevard Engineering Company and dated January 14, 1964, indicates that ap-
proximately 211 acres of submerged land would be filled inside the proposed
line and an additional 102 acres, more or less, of submerged land would be
dredged for 500 -foot wide channels along the northern and southern edges of
the new fill. Dredging depths are not indicated but the channel along the
western edge of the existing fill is at least 14 feet deep and encompasses
about 40 acres from which fill material was obtained. No channel of com-
parable dimensions is shown for the western 'side of the proposed new fill
although water depths are shallow enough, to indicate one would be needed.
Altogether, more than 312 acres of submerged land would be dredged or
filled if the 'bulkhead line requested by the applicant is approved and de-
velopment ensues as planned. Meat of this acreage is vegetated by attached
seagrass except where siltation from dredging and filling for the toll cause-
way to the north and for the applicant's existent fill to the east has
occurred or whore bare spots from exposure of the bottom during low winter
tides heva developed. Because of prevailing winds and rainfall, water depths
are lower in winter than in summer in the Banana and Indian Rivers. Consequently,
sparsely vegetated bottoms in winter may be lushly vegetated in summer when sun-
light intensity and duration are greater also.
Besides the 312 acres that would be affected directly by dredging or
filling under the new bulkhead line proposal, adjacent submorged acreagc of
seagrass would be silted. Also, an additional 1.0 acres of bottom would be
dredged below the depth of effective sunlight penetration (the'euphotic zone)
and subsequent plant photos;:nthosis if a 500 -foot channel were dredged along
the western edge of the new fill proposed..
Submerged acreage damaged or destroyed for seagrass growth represents
lost nursery grounds for young fish and shrimps and feeding grounds for their
predators such as spotted neatrout or outer sport and commiercial fishes.
Such losses approaching 403 acres -(from dredging, filling and siltation) in
the subject area would not be compatible with State conservation programs
and goals. 'However, car -fully controlled dredging to depths no greater than
six feet Mean Low Water (within the most effective sunhotic zone) for a
navigational chwwal needed through this shallow area Into the existent
fill of the applicant would be compatible with sustaining mirlce Productivity
in the Banana River.

The City Attorney called Mr. Tom Groover of Briley, Wild & Associates,
the City Engineers, who rave 'a report of his study of the Bulkhead Use and
the opinion of the City Engineers.
After discussion Hr. Jandreau made a Motion that the application
by Shuford Hills be denied by resolution and that such resolution be prepared
by the City Attorney, Hr. 14arphy seconded the Motion. Mr. dandreauy Mr.
Murphy and Mr. Eberweinvoted to deny the application and Mr. Hurck voted
against the denial.
Mayor Thum read Resolution No. 50 entitled "A RESOLUTION
MEQUESTING THE STATE ROAD DEPARTMENT TO HAKE A Ct,RTAIN ENGINn'nRV;G STUDY
WITHIN THE CITY LIMITS OF THE CITY OF CAPE CANAVERAL, FLORIDA.-- Hr. Murphy
made a Motion that the Resolution be adopted. Hr. Hurck seconded the Motion
and the Resolution was adopted by the unanimous vote of the Council.
Mayor Thum read,. Resolution No. 51 entitled "A R'' :SOLUTIOU DIIECTLNG

INC." Mr. Murphy made a Motion that the Rosolution b. adopted, Mr. Hurck
seconded the Motion and the Resolution was adopted by unanimous vote,
whereupon the Mbnting for Public Hearing was adjourned.'
