February 4, 1964
The Regular Meeting of the City Council of the City of Cape
Canaverall, Florida, convened at 7130 P.H., on February 4, 1964 at the
Temporary City Hall, 109Buchanon Ave., Cape Canaveral, Florida.
City Officials present were Mayor'. Richard Thum, councilmen)
Jack Hurdk, F. L. Murphy, Eugene Jandreau, Wm. Eberwein, T: ]avid Burns,
City Attorney, Donna J. Anderson, City Clerk.
The Meeting was called to Order by Mayor Thum.
Mr. Murphy made a Motion that the Heating be moved to the Fire
Station, at 120 Jackson Ave. The lotion was seconded by ,Mr. Eberwein and
passed unanimously and thereupon the Meeting recessed, leaving a Police
Of''icer at the City Hall to direct the Public to the Fire Station.
The Meeting reconvened at the Fire Station and was called to
Order by MV,or Thum.
Mayor Thum read the Minutes of the Regular Meeting of January
21, 1964, and on a Motion by Mr. Hurck, seconded by Mr. Murphy and by
unanimous . vote, the Minutes were approved.

1, Zoning Yap - 2nd and Final Rnadlrut of ordinance No 44 -1
Mayor "shim read ordinance No. 64 -1. Mr. Jandreau made a Motion
that the Ordinance be ,adopted and Mr. Murphy seconded the Motion.
The Zoning Map was divided into Sections for discussion and
suggestions afterwhich Mr. Hurck made a lotion that the matter be tabled
for study until the next Regular Meeting of February 18, 1964. Hr. Jandreau
seconded the Motion and it was passed unanimously.
2. Explanation of City Hall Plans
Mr. Murphy explained to the Public, who may have misunderstood
the City's intention to build only a segment at this time of the City Hall.
Mr.' Murphy made a Motion that the architect be changed naming
Mr. Hank DfAmeco as architect. Mr. Eberwein seconded the Motion. The
Motion failed to carry with Mr. Mamhy and Mr. Eberweln voting in favor,
Mr. Hurck and Mr. Jandreau opposing and Mayor Thum casting an opposing
vote, thereby breaking the tie.
Mr. Hurck made a Motion that the entire Council negotiate with
the architect. Mr. Jand -au seconded the Motion and it was carried by

3. Variance Request — 4.bitecliff Apartments, Richard J. Callahan
Mayor Thum read a letter of application for request for variance
previously submitted to the Council. Mr. Jandreau made a Motion to grant
the r,_•quent. Mr. Hunk seconded the Motion and the request for Vsniance was
granted by majority vote with Mr. Hunk, Mr. Eberwein and Mr. Jandreau
voting in favor and Mr. Murphy opposing.

1. Variance Request — WXBR Radio Station (Rucmi Construction Co.)
Mayor Thum read a letter of application from Bacon Construction
Company and from the minutes of the Special Meeting of the Zoning Board of
January 30, 1964, showing the unanimous recommedation of the Zoning Bard
to approve the request.
On a Motion by Mr. Jandreau to grant the Variance, seconded by
kr. Murphy, the Council voted unanimously to approve the Variance.
2. Appointment of Interin Judge
0n a suggestion by the City Attorney, Mr. Hurck omde 'a Motion
that this item be postponed. Mr. Jandreau seconded the Motion. FL•. Hunk and
11r. Jandreau voted in favor of postponement. Mr. Murphy and Mr. Eoen ein
against, Mayor. Thum voted for postponement thereby breaking the tie and
the Item was postponed.'
3, Street Liphts
After discussion, Hr. Jandreau made a Motion to Table, seconded
by Mr. Murphy and the Motion passed unanimously.
Item Ho. 4 was placed on the Agenda-on a Motion by Mr. Jandreau
seconded by Mr. Murphy and passed unanimously and titled "The proposed
sewerage treatment plant site. Mayor Thurm read a letter from Briley,
Wild and Associates and a letter from the ,City Fiscal Agent with regard .
tf: the plant.. site and the sewer• -.ge project.
Hr. Jandreau made a Motion that the proposed plant site as shown
by the enrinners nap be accepted as submitted. Mr. Murphy seconded the Vstlon
area It w:.s passed by unanimous vote of the Council.
On a Motion by Mr. Hunk to adjourn, seconded by Mr. Murphy and
pa-ed unanimously, the meeting of February 4th, was adjourned.
