HomeMy WebLinkAboutMinutes 01-14-1964 SpecialPUBLIC REARING MINUTES OF SPECIAL MEETING CITY COUNCIL January 14, 1964 A Special Mieoting of the City Council ofthe City of Cape Canaveral, convened at 7:30 P.M., on January 14, 1964, at the Temporary City Hall, 109 Buchanan Ave., Cape Canaveral, Florida. City Officials present were: Mayor Richard Thum, councilmen] Jack Hurck, F. L. Murphy, Eugene Jandreau, and W. J. Eberwein, Donna J. Anderson - City Clerk, T. David Burns - City Attorney. The Meeting was called to order by Mayor Thum. Mr. Hurck made a Motion that, due to weather and heating conditions, the Meeting be moved to the Fire Station at 120 Jackson Ave., the Motion was seconded by Mr. Jandreau and passed unanimously and there -upon the Meeting was recessed at 7:35 P.M., leaving a Police Officer at the City Hall to direct the Public to the Fire Station. The Meeting reconvened at the Fire Station and was called to order by the Mayor . who asked if there were any objections to holding the Meeting at this location and there being none, the Meeting proceeded with the first item on the Agenda. Request for Closing a Portion of Magnolia Ave. (By R. F. Tidwell) Mr. Cecil Rosier, representing the Tidwells presented the application to the Council and after discussion, Mr. Murphy moved that the request be denied. Hr. Jandreau seconded the Motion and the vote resulted in a tie with Mr. Murphy and Mr. Jandreau voting bo deny the request and Mr. Hurck and Mr. Eberwein voting against denial. Mayor Thum voted against the denial thereby breaking the tie. At the City Attorney's suggestion, an affirmative Notion to close that portion of Magnolia Ave. was made by Mr. Hurck. Mr. Eberwein seconded the Motion and the vote resulted in a tie with Mr. Hurck and Mr. Eberwein voting in favor of the Motion and Mr. Murphy and Mr. Jandreau voting against. Mayor Thum broke the tie voting in favor of the applicants request. 2. Resolution - Abandoning and Disclaimin a Portion of Road and Alley Polk Ave. Max Brewer Apetition with twenty -two (22) signatures of persons objecting to the applicant's request was presented to the Council by Mr. Cecil Annette and after discussion a Motion by Hr. Hurck to defer action until February 4th died for lack of a second. PAGE I OFR, M.INUTEq SPECIAL MZETING Janu,r� 14, 1964 PAGE 2 On a Motion by Mr. Murphy, seconded by Mr. Jandreau, the Council denied the Request by majority vote of 3 to 1 with Mr. Eberwein, Mr. Murphy and Mr. Jandreau voting for denial and Mr. Hurck apposing. 3. Bulkhead Line (By John Starling & Hal Simms representing Shuford Hills) After discussion of the presentation, Mr. Jandreau made a Motion to recess the Public Hearing on the application to establish or extend the Bulkhead Line in portions of Section 15 and 16, Township 24 South, Range 37 East, located in the City of Cape Canaveral until Tuesday, February 11, 1964 at 7:30 P.H. at City Hall, City of Cape Canaveral, Flouid4, for further Public Hearing to be held at said time. The Motion was seconded, by Hr. Murphy and passed unanimously, whereupon the Meeting was in short recess on a Motion by Mr. Jandreau, seconded by Mr. Murphy and by unanimous vote. Upon resuming, the Council proceeded to Item 4, on the Agenda. 4. Vacating Plat in Chandler Pnrk There being no discussion, Mayor Thum announced that this matter had been disposed of at a previous meeting. 5. Variance Bequest (By Jack Tegreeny - Store - Keeper -by- the -Sea) On a Motion by Mr. Jandreau to grant the request allowing for the sale of beer and wine by reducing the required footage from 300 ft. to 203 ft. door to d,.or and with the express understanding and provision that the entrance be moved to the west side of the building, seconded by Hr. Murphy, the Council unanimously approved the request. 6. Master Plan Ms. Jandreau made a Motion to table discussion of the Mister Plan explaining that several hours work remained on the plan before it is ready for public consideration. The Motion was seconded by Mr. Hurck and passed unanimously. Cn a Motion by Mr. Murphy seconded by Hr. Jandreau, and passed unanimously the Special Meeting for Public Hearing Adjourned.
