CITY COUNCIL
January 7, 1964
A Regular Meeting;of the City Council of Cape' Canaveral, Florida '=
was held at 7:30 P.M., on January 7, 1964,at the Temporary City Nally
109 Buchanan Ave., Cape Canaveral, Florida.
City Officials present were: Mayor Richard Thurm Councilmen;
F. L. Hvrphy, Jack Hurck, Eugene Jandreau, City Clerk - Donna J. Anderson,.
City Attorney T. David Burne.
The Meeting was called to order by'Mayor Thurm.
On a Notion by Mr. Jandreau, seconded by Mr. Hurck and passed unanimously,
the Minutes of the Regular Meeting of4Dacember 17, 1964, were approved as read.

Mr. Hurck announced that t4 flag pole was now installed at the City
Fall and expressed appreciation to Bauer TV for donation "of the flag pole and
to the Cocoa Tribune for "donation of the Flag.
OLD BUSINESS '
1. ABC Beverage Ordinance - Amendment (2nd and Final -Reading)
Mayor Thum gave 2nd and Mal Reading and %= %=r k made a Motion t o
approve the Amendment. Mr. Jandreau secondedthe Notion. After discussion and
opinions by citizens and the Council, Mr. Hurck made a Motion that the matter
be talked for an indefinite period to allow"the Council tims-for further consider-
anon. W. Jandreau seconded t he Hotton. After consideration of further
discussion, -this Notion and the Second were with drawn and Mr. Hurck made a
Motion that the matter be placed on the Agenda of the Regular Meeting of
January 21, 1964. Mr. Jandreau seconded the Notion and it passed by unanimous
vote of the Council.
2, Ordinance No. 1511-63 Amendment I Police Dept. 12nd and Final Reading)
Mayor Thurm gave 2nd and Final Reading and on a Notion by lir. Hurck,
seconded by Mr. Jandreau, Amendment No. 15A-63 was Adopted by unanimous vote of
the Council. ?

After receiving competitive bids on an additional Patrol Car, Mr.
Murphy made a Motion that the car be -purchased from Indian River Cheverlet
Co. who submitted the low bid of $2,129.03. Mr. Hurck sedonded the ,Notion
and it was passed by unanimous vote.
3. Ordinance No. 24-63 Anpointment,of Temporary Judge (2nd and Final Reading)
Mayor Thurm gave 2nd and Final Reading of the Ordinance providing for
the Appointmenb of a Temporary Judge. Mr. Hurck made a lotion that the

Ordinance be Adoptedtand Hr. Jandreau seconded the Notion, After a suggested
Amendment to the Ordinance by the City Attorney, Hr. Jandreau moved that the
Ameddment be approved. Mr. Hurck seconded the lotion and the Councilts vote
was unanimous to Amend the Ordinance with the insertion of the following
language in Section I, and following the words, said Municipal Court,
"provided however, such designation b9 the City Council shall be made only
after a reconceddation by the Regular Municipal Judge." Hr. Jandreau then made
the Notion that the Ordinance as Amended be Adopted, with a Second by Hr. Murphy
and by unanimous vote of the Council, Ordinance No. 24 -63 as Amended was Adopted.
On a Notion try Mr. Jandreau, seconded by Mr. Nurphy and unanimously
carried, the Variance Request by Hr. Purcell pertaining to Cities Service
Station was placed on the Agenda Becoming Item 4 of OLD BUSINESS,
4. Variance Request - Cities Service Station (Purcell )
Mayor Thum read the Request for Variance. Mr. Jandreau made a Notion
that the matter be called from the Table, Hr. Murphy seconded the Motion and
the vote was unanimous.
M Request for Variance was allowed after a letter was read from
Hr. H. W. Kerwin, the adjoining property owner, stating that he had no
objection providing that a six ft, wall was created between the properties.
The Motion to grant the Request was by Mr. Jandreau, seconded by Mr. Murphy
and unanimously carried.
NEW BUSINESS
1. Variance Request (Integrity Construction Corporation)
Hr. Hurck made a Motion to deny the Request, the Motion was seconded
by Mr. Murphy and carried by majority vote with Mr. Hurck and Hr. Murphy
voting to deny the Request and Hr. Jandreau abstaining.
2. Appointment of Fire Chief
Mr. Murphy made a Notion that Chief of Police W. H. (Slim) Wimberley
be appointed Fire Chief. Mr. Hurck seconded the Motion and Chief Wimberley
was appointed by unanimous vote of the Council.
3. Appointment of Public Health Officer
On a Motion by Mr. Jandreau, seconded by Mr. Murphy and carried
unanimously, Dr. Paul H. Jahn was appointed Public Health Officer for the
City of Cape Canaverals
There being no other business before the Council, Mr. Murphy made a
Notion that the Meeting be adjourned. Mr. Hurck seconded the Motion and it
wee carried unanimously.
