MINUTES OF HWULAR METING
City Council
December 3, 1963
A Regular Meeting of the City Council of the City of Cape
Canaveral was held at 7130 P.M. at the Temporary City Hall, 109
Buchanan Ave., Cape Canaveral, Florida.
City Officials Present weret Mayer RiohmN Thum, Councilmen:
William Iberwein, Jack Horck, flagons Jandreau, F. L. Murphy, Donna J.
Andersen - City Clerk, T. David Dorms - City Attorney.
The Meeting was called to Order May Mayor Them
On a Motion by Mr. Murphy, seconded by Mr. Merck and
carried enanlmcusly, a Resolution No. 44, entitled "A RESOLUTION IN
REGARD TO TRE JOHN F. MGDNREDT SPACE CANTER AND THAT MASS OF LAND
HISTORICALLI KH" AS CAPE CANAVERAL" was placed an the Agenda.
Mr. Murphy made a Motion that Ordinance No. 22 -63 entitled
"AN ORDINANCE PROVIDING CERTAIN PROCEDURAL RSCOIAEMENTS AS CONDITIONS
PRECECNNT TO CITY COUNCIL'S RESOLUTION VACATING SUBDIVISION PLATS" be
placed on the Agenda. This Motion was ascended by Mr. Jandreau and
passed unanimously.
The Ordinance No. 23 -63 entitled "AN ORDINANCE PROVIDING FOR
THE NSTABLISHMENT, LOCATION, CHANGE, OR DISCONTINUANCE OF PUBLIC STREETS
BY Tim CM COUNCIL, AND PRESCRIBING TM PROCEDURE THME:FORE" was placed
an the Agenda on a Notion by Mr. Merck, ascended by Mr. Murplp and
passed unanimously by the Council.
MINUTES ON TRE REGULAR MEWING ON NOVEMBER 19, 1963-
The Minutes of the Regular Nesting of November 19th were read
by Mayer Therm and approved by the Council as read. It was suggested
from the audience that the Minutes reflect a ropbrt given by Mr. Tea
Groner of Briley, Wild and Associates showing Sewerage Treatment
Plant Sites to be considered and therefore the following sites are
shown and hereupon made a part of the Minutest
1. A tract of land within the boundaries of Port Canaveral
on the south side of the Causeway, approximately 3000
feet West of SR 401.
2. A tract in the western eatention oft he Shuford Mills
property, approximately 3000 feet west of the present
western boundary of that property.

3. A tract of bottom -land in the Banana River, in the vicinity
of the western extension of Columbia Drive, approximately
2000 feet west of the anticipated BalMead Line in that
arm.
4. A tract of bettem -land in the Banana River, in the vicinity
of the western extersion of Center Street, approximately
2000 feet west of the anticipated Bulkhead Line in that
area.
MINUTES OF THE SPECIAL MEETING OF NOVEMBER 25 1963.
Minutes of the Special Heating of November 25, 1963, were
read by Mayor Thum and approved by the Council as read.
RESOLUTION N0. 44.
Mayor Thum read Resolution No. 44 entitled "A RESOLUTION IN
REGARD TO THE JOHN F. KENNEDY SPACE CENTER AND THAT NAM OF LAND
HISTORICALLY KNOWN AS CAPE CANAVERAL" in its entirety and on a Motion
by Mr. Harck, seconded by Mr. Murphy, the Council voted unanimously
to Adopt the Resolution.
On a Motion by Mr. Jandrean, seconded by Mr. Murphy and
unanimously passed, Ordinance No. 18-63 entitled "AN ORDINANCE
PROVIDING CERTAIN PROCEDURAL REQUIREMENTS AS CONDITIONS PFiE =T TO
CITY COUNCIL'S HWOWTION VACATING SUBDIVISION PLATS" was given lot
reading in its entirety by Mayor Thurm.
On Motion by Mr. Hark, seconded by Mr. Jandreau and
Passed unanimously, let Heading in its entirety was given Ordinance
No. 19 -63 entitled "AN ORDINANCE PROVIDING FOR THE ESTABLISHMENT,
LOCATION, CHANCE, OR DISCONTINUANCE OF PUBLIC STREETS BY THE CITY
COUNCIL, AND PRESCRIBING THE PROCEDURE THEREFORE ", by Mayor Thurm.
Motion was made by Mr. Jandreau to approve the let reading
of both Ordinances, seconded by Mr. Murphy and approved unanimously
with Notice being given the City Clerk to post copies of same..
FINE DEPARTMENT (Discussion) Reading of Ordinanoo No 20-63
Introducing discussion of the Fire Apartment, Mayor Thum
read a letter from the Volunteer Fire Department requesting that
the Council postpone action on the Ordinance establishing a Fire
Apartment until the next regular Meeting. This request was granted

No. 20-63, seconded by Mr. Jandreau and passed unanimously.
READING OF ORDINANCE N0. 19-63 (Council Procedure, 2nd & Final)
Acting on a suggestion by the City AtWrney, Mr. Marck made
a Notion that 2nd and Final Reading of Ordinance No. 19-63 be pest -
paned until the next Regular Nesting oft he City Council allowing for
Amendments to be made. This Notion was seconded by Mr. "by and
passed unanimously.
READING OF ORDINANCE NO. 21 -63 (Zenins Reamed. 2nd & Final)
Mayor Thum gave 2nd and Final Reading of Ordinance 21 -63,
Mr. Hurck's Notion to Amend the Ordinance allowing for additional
members oft he Zoning Board died for lack of a second.
Mr. Jandreau made a Notion to approve the 2nd and Final
Reading of Ordinance No. 21 -63 entitled " AN ORDINANCE CREATING A
BOARD TO BE KNOWN AS THE ZONING AND PLANNING BOARD OF THE CITY OF
CAPE CANAVERAL; PRESCRIBING NUMBER OF MEMBERS{ PROVIDING TERMS OF OFFICE;
PROVIDING POWERS AND DUTIES; PROVIDING RULES OF PROCEDURE OF THE BOARD;
VALIDATING OFFICIAL ACTS OF PAST ZONL.0 AND PLANNING BOARDS; PROVIDING
AN EFFECTIVE DATE ". Nis NNotida was'asaseMd by Rk. Marpky mad passed
unanimously.
On a Motion by Mr. Jandreau to approve the Reading of
Resolution No. 45 entitled " RESOLUTION APPOINTING MEMBERS OF THE
PLANNING AND ZONING BOARD ", seconded by Mr. MulAW and passed by a
majority vote, Mr. Jandreau, Mr. Murphy and Mr. Wwrewin in favor of
the Notion and Mr. Merck abstaining, the Resolution was read by Mayor
Thorn. Mr. Jandreau made a lotion to adopt the Resolution. Mr.
Murphy seconded the lotion which passed by a majority vote with
Mr. Jandreau, Mr. Murphy and Mr. Yberwein voting in favor of adop-
tion and Mr. Hurck abstaining.
On a Notion by Mr. Murphy to adJoarn, seconded by Mr.
Jamdreaa, the Notion carried by majority vets, Mr. lberwein, Mr.
Jandreau and Mr. Murphy voting in favor of the Notion, Mr. Hurck
abstaining and thereupon the looting was adjourned. This the 3rd.
day of December, 1963.
