HomeMy WebLinkAboutMinutes 08-27-1963 Special® 6 M;Snutes of Special Meeting City Council August 27, 1963 A Special Meeting of the City Council of the City of Cape Canaveral, Florida was held on August 27, 1963 at the Temporary City Hall, 109 Buchanan Ave., Cape Canaveral, Florida. Members present were : Mayor Richarl7hu:m, William Fbexwein, Jack Hurck, Eugene Jandreau, F. L. , Murphy, George Ritchie — City Attorney, Maxine Pearson — Deputy City Clerk. Meeting was called to order by Mayor Thum at 7 :40 PM: The Mayor opened discussion re: "filling vacancy of Mr. F. L. Murphy ", and asked penmiasion to move this issue first on the Agenda. Mr. Hurck objected to this and made a Motion not to deviate from the Agenda. tr. Mur W seconded the Motion.. The Notion was voted not to deviate from by Mr. tfiupby, Mr. Fbervein, and Mr. Hurck. Mr. Jandreau abstained. The'MOtion was passed by 3/4 vote not to deviate from the Agenda. Civil Defense Mayor Thunm opened discussion re; Civil Defense, and stated the City Attorney would like more time, as he had not been able to look into the proposal legally. A Motion was made by Pr. MLnphy to adopt a Resolution accepting the Civil Defense Plan as time was of the essence. Mr. Hurck seconded the Motion. Mr. Jandreau expressed his opinion that this may be too hasty, if the City Attorney needs more time to look into the proposal. ;r. Minphy stated that he felt we should go ahead with the Motion. Mr. Ritchie stated he had not been able to look into the proposal.in conjunction with bindinr, the City, legally. Mr. Mituphy stated in reading, over the proposal -.we would not be obligated, legally, and Mr. Hurck suggested we adopt the resolution. Itr. Jandreau suggested an amendment to the Motion. 'Mr. Hurck stated that if a Resolution was passed, it could be rescinded later, that we had everything to Fain and nothing to lose — saving $10,000 requested by the Fir: Department. Mr. Ritchie stated he had not time to Go over the Resolution to the extent of its legality of "free gift ". A vote was passed unanimously to adopt the Resolution. Vacancy: Discussion was open regarding the "verbal resignation" by Mr. mr-phy on August 1963. The Mayor read a letter presented by Mfr. Murphy rescinding his "verbal resignation" to remain on the Council. Mr. Hurck made a t•fotion to accept the letter of rescission from Mr. Mhuphy. City Attorney - Court: The next discussion on the Agenda visa re: necessity of City Attorney attending or representing the.City in 6Lnicipal Court. Mr. Jandreau made a Motion that if his presence was needed, the City Attorney should be present. Mr. Hurck suggested a meeting be setup with the Judge, City Attorney and Councilmen, deciding when and where the City Attorney's services would be required. Mr. Hurok explained the necessity might arise, when the defendant has an Attorney, the City should be represented in case of a rebuttal. Mr. Ritchie pointed out the expense of full time - if his presence is not always required. Mr. Hurck asked for arrangements for this 6leetin3 with the Judge, City'Attomey and the Councilmen at earliest convenience. Budget: Further discussion was opened to the proposed 1963 -1964 Budget. The Police Department was reduced from 3 patrolmen to and from 3 dispatchers to 2 and the 7 ,auxiliary part time patrolmen would remain as is. Uniforms were reduced to $280.00 for the Chief and auxiliary patrolmen, but remained at $500.00 for the 2 patrolmen. Mr. Hurck questioned if the figure for the Fire Department, $14,000 would be in excess to the proposed $5,500.00. Mr. dbeller, • Volunteer Fireman, pointed out that they 'could not operate on $14,000 without • suitable truck and citizens weren't interested enough to back the Fire Depart- ment which could lead to retuming and disolving all cquipoent to its mners. The City Attorney pointed out if a donation was given for a fire truck, the City should be retained as rightful owner. No father discussion was subrtdtted and Mr. Hurck made a Motion for the Meeting to adjourn. I•tr. Jandreau seconded the Motion. The Motion carried unanimously and the Meeting was adjoumed at 9:00 R.I. 1,1axine R. Inasmuch as I.wan ruled out of order by the Chairman and no action was taken by the Council aocepting vV tesignntion, I hereby rescind my verbal resignation and u111 remain on the Council.
