emergency items. Citizens will limit their comments to three (3) minutes. The Community
Appearance Board will not take any action under the "Public Participation" section of the agenda.
The Community Appearance Board may schedule items not on the agenda as regular items and act

November 12, 2015
A Meeting of the Community Appearance Board was held on November 12, 2015, at the Cape
Canaveral Public Library, 201 Polk Avenue, Cape Canaveral, Florida. The meeting was called to
order at 6:00 p.m. by Chairperson Randy Wasserman. The $ecretary called the roll.

1. Interview & Recommendation to City Council Re: Potential Board Member, Sandra
Lanham
Mrs. Lanham stated that she has lived in Cape Canaveral for eight (8) years. She and her
husband started visiting the area in the 90's. Her husband was presented ajob opportunity with
NASA in 2007. He accepted and they have been living here since then. She was President of
the HOA in her community and now serves on the Beautification Committee. She saw the
vacancy on the Community Appearance Board and felt she would be a good fit. She cares about
Cape Canaveral and would like to volunteer her time.
Discussion ensued with Board Members to include: her thoughts on improvements to any
particular area; anything that stands out in the City regarding architecture; the City has evolved
since the 90's; becoming familiar with the Statutes for this Board; keeping property values on
the rise; the bike path, landscaping on Ridgewood Avenue and the solar lighting is beautiful.

Motion by Mr. Wasserman, seconded by Mrs. Raymond, to recommend to City Council to appoint
Sandra Lanham to fill the vacancy on the Community Appearance Board. Vote on the motion
carried unanimously.
2. Oceanside Distillery —Review and action regarding a Level 1 application consistent with
Chapter 22, Article III of the Cape Canaveral Code of Ordinances
Assistant City Attorney Kimberly Kopp swore in all participants who were planning to speak on
behalf of this item.
Mr. Dickey presented Staff s report/photos to show the layout of the property. Staff explained the
surrounding properties and their uses.
The item consists of a Level 1 application which required Community Appearance Board review
and action for a proposed commercial building located east of Commerce Street on the north side
of W. Central Boulevard related to a 6,200 square foot commercial building that will contain a
micro -distillery, associated tasting room, and retail store. The proposed building is located on a
.83 acre parcel which has a driveway cut onto W. Central Boulevard. The property is zoned C-2
Sec. 2242 (c) of the Code established certain criteria that the CAB must consider when evaluating
an application. In general, the criteria are to gauge whether a project is in harmony and consistent
with the surrounding natural and built environment.
See. 2244 of the Code includes the specific standards that must be considered. They include:
• The plans for the proposed buildings are not excessively similar or dissimilar to any other
building or structure in the general area.
• Front or side elevations must be shown.
• Size and arrangement of elevation facing the street must be shown.
• The plans for the proposed building are in harmony with the established character of other
buildings or structures in the surrounding area.
The property is within the AIA Economic Opportunity Overlay District and must meet certain
architectuml/site design guidelines applicable to development within this area regarding:
Sec. 110423. - Building Orientation - Buildings shall be oriented towards AIA, N. Atlantic
Avenue and Central Boulevard, as well as adjacent cross -streets in order to encourage pedestrian
activity along the sidewalks of Al A, N. Atlantic Avenue and Central Boulevard. and to facilitate
pedestrian access to and from the sidewalk to adjacent properties.

Sec. 110-643. —Articulation - Reduce the monotony of large buildings by breaking architectural
elements into smaller pedestrian scale components or through use of varied materials, textures or
colors, trim, roof lines, canopies and awnings in order to provide variation and visual interest.
Fapades shall be organized into three major components, the base (ground level), body (upper
architecture) and cap (parapet, entablature or roofline).
See. 110.648. - Entry treatment - Construct a dominant entryway to reinforce the character of
the building, add visual interest, break up the monotony of flat surfaces, add a vertical element to
break up the facade of the building and create an inviting entrance.
Sec. 110-650. - Exterior surface materials - Select high quality, human -scale building materials
to reduce building mass, create visual interest, and complement the community vision for
architectural style of the Al A EOOD.
Sec. 110-654. - Awnings and canopies - Add awnings or canopies to provide variation to simple
storefront designs in order to establish a horizontal rhythm between structures where none exists
and add color to a storefront. Canopies and awnings that span an entire building are discouraged.
Sec. 110-669. - Surface parking - Locate surface parking in the tear or side of buildings and
provide pedestrian access from the parking to the building and street.
Sec. 110-689. - Surface parking lots - Buffer off-street parking adjacent to a public right-of-wity
or residential buildings with a landscaped berm.
After review of submitted materials, Staff is recommending the following modifications to the site
plan/renderings:
1. A knee wall and/or landscaped berm, a minimum of 30 inches in height, be erected
between the parking area and W. Central Boulevard.
2. The sidewalk along W. Central Boulevard be extended to the east property line.
3. The three windows on the eastern side of the building should be bordered by a vertical
architectural treatment and/or facade articulation to help breakup the horizontal surface of
the eastern side of the building.
Mr. Foleno presented a revision to the original plan to present to Board Members to include: pitch
of roof; additional landscaping; structural canopies will be added per Staffs recommendation;
colors (buffhan); stack stone for elevations; impact windows and landscaping buffers.
Mr. Foleno explained that he and his brother will own and operate this business.
Discussion ensued regarding changes to driveway; flow of traffic during this process; the recycle
of construction products; plans are consistent with the Redevelopment Plan; further clarification
of a knee wall; extension of sidewalk; elevation of building; removal of the guard shack currently
on the property; location of dumpster pad and type of enclosure; stormwater/retention area; and
where the HVAC unit will be placed.

per Staffs recommendations. Vote on the motion carried unanimously.
Board Member's thanked Mr. McMillin and Mr. Hoog for attending the meeting.
Mr. Dickey reminded Board Members that a Chairperson and Vice Chairperson needed to be
chosen in February, 2016.

Subject: Level 2 review for the use of a wall mural at the VFW Post located at 105
Road.
Summary: This item consists of a Level 2 review for the use of a wall mural at the VFW Post
located at 105 Long Point Road (Attachment 1).
Recently, Code Enforcement Staff notified the VFW Post that the newly -painted wall mural was
not allowed by the City Code of Ordinances. However, Sec. 94-6 (g) of the Code did allow for
a process by which a wall mural could be approved. This process involves the review and
approval of the Community Appearance Board.
The subject wall mural is located on the north and east walls of the Post fronting Long Point and
N. Atlantic Roads. It is a tribute to veterans and first responders and depicts various scenes and
imagery related to military and emergency service themes (Attachment 2).
As indicated above, a wall mural may be allowed if approved by the CAB. When evaluating a
Level 2 application, Sec. 22-42 of the City Code identifies criteria that must be considered. Note
that these criteria were established to evaluate both Level 1 and Level 2 applications; so they
may not all apply to the subject request. Criteria include:
1. The plans and specifications of the proposed project indicate that the setting,
landscaping, ground cover, proportions, materials, colors, texture, scale, unity,
balance, rhythm, contrast and simplicity are coordinated in a harmonious manner
relevant to the particular proposal, surrounding area and cultural character of the
community.
2. The plans for the proposed building or structure are in harmony with any future
development which has been formally approved by the city within the surrounding
area.
3. The plans for the proposed building or structure are not excessively similar or
dissimilar to any other building or structure which is either fully constructed,
permitted but not fully constructed, or included on the same permit application, and
facing upon the same or intersecting street within 500 feet of the proposed site, with
respect to one or more of the following features of exterior design and appearance:
a. Front or side elevations;
b. Size and arrangement of elevation facing the street, including reverse
arrangement; or
c. Other significant features of design such as, but not limited to: materials,
roof line and height or design elements.
4. The plans for the proposed building or structure are in harmony with the established
character of other buildings or structures in the surrounding area with respect to
architectural specifications and design features deemed significant based upon
commonly accepted architectural principles of the local community.

5. The proposed development of the building or structure is consistent and compatible
with the intent and purpose of this article, the Comprehensive Plan for Cape
Canaveral, and other applicable federal, state or local laws.
6. Within the C-1, C-2, and M-1 zoning districts, any exterior building or roof color used
shall be well designed and integrated with the architectural style of the building and
surrounding landscaping in order to create a subtle and harmonious effect and promote
aesthetic uniformity within the district. Bright or brilliant colors shall not be permitted
except for use as an accent color within the C-1, C-2, or M-1 zoning district.
The prohibition of a wall mural in the City Code is centered on its potential use as additional
signage — typically in a retail setting. As the subject property/structure houses a fraternal
organization, staff is supportive of the request.

Summary: This item consists of a Level 1 applic
an aerial adventure park at 260 Cape Shore Circle.
The property is zoned C-1, which allows outdoor recreation as a permitted use. The project is
proposed on a 1.41 acre parcel which has access on Al and Cape Shores Circle (Attachment
2). The subject site has an existing structure which will be converted to house the ticket counter,
restrooms, waiting lounge and merchandise area. Operating hours will be from 9 am to dusk
and will employee approximately 15 people.
The parcel does contain a number of large specimen trees which are proposed to be maintained
to add to the experience of the guests. As indicated on the site plan (Attachment 3), parking will
be located on the south and west sides of the property. All City development standards will be
implemented during the site plan review phase. The applicant has indicated that there will be
no stormwater permit required as there is no additional impervious surface resulting from the
project.
Sec. 2242 (c) of the Code establishes certain criteria that the CAB must consider when
evaluating an application. In general, the criteria are to gauge whether a project is in hannony
and consistent with the surrounding natural and built environment (Attachment 4). The parcel is
located within the N. Atlantic commercial corridor which has developed in a commercial
manner with various retail and office uses.

Subject: Level 2 review for the installation of Accent Lighting at the
located at 8501 Astronaut Boulevard (Suites 7 & 8).
Summary: This item consists of a Level 2 review for the installation of accent lighting at
Fabulous 50's Diner at 8501 Astronaut Boulevard (Attachment 1).
Due to concerns over the proliferation of LED lights in the City, Code Enforcement Staff
recently delivered a courtesy letter to approximately 12 businesses regarding window lighting
(Attached). The letter reads as follows:
The City in 2010 adapted a revised Sign Ordinance which among other things
changed the way the City regulates lighting. Specifically, the Ordinance created
a new class of lights, known as Accent Lights. By definition, Accent Lights are
"any method of external illumination that is intended to draw attention to an
integral decorative or architectural feature of the building and not connected or
giving the appearance of any connection to the overall signage of the project. "
Accent lighting is only allowed after review and approval by the City's
Community Appearance Board. A Board Application is enclosed for your
convenience along with a copy of section 94-4 of the City Code that discusses
exempt signs as well as Section 94-6 regarding prohibited signs.
Another type of lighting that the revised Sign Ordinance addresses is Window
Lighting. Window Lighting is considered "any source of illumination intended
to illuminate or draw attention to any display that is part of a window sign. "
Window lighting is prohibited by the City Code of Ordinances, except when it is
associated with a window sign as permitted in Section 94-4(6).
Section 94-1 of the City Code defines the term Accent Lighting as indicated below:
Accent lighting means any method of external illumination that is intended to
draw attention to an integral decorative or architectural feature of the building
and not connected or giving the appearance of any connection to the overall
signage of the project. Accent lighting shall be reviewed in accordance with
article III of Chapter 22 of this Code.
As indicated above, Accent Lighting may be used if approved by the CAB. When evaluating a
Level 2 application, Sec. 22-42 of the City Code identifies criteria that must be considered. Note
that these criteria were established to evaluate both Level 1 and Level 2 applications; so they

development which has been formally approved by the city within the surrounding
area.
3. The plans for the proposed building or structure are not excessively similar or
dissimilar to any other building or structure which is either fully constructed,
permitted but not fully constructed, or included on the same permit application, and
facing upon the same or intersecting street within 500 feet of the proposed site, with
respect to one or more of the following features of exterior design and appearance:
a. Front or side elevations;
b. Size and arrangement of elevation facing the street, including reverse
arrangement; or
c. Other significant features of design such as, but not limited to: materials,
roof line and height or design elements.
4. The plans for the proposed building or structure are in harmony with the established
character of other buildings or structures in the surrounding area with respect to
architectural specifications and design features deemed significant based upon
commonly accepted architectural principles of the local community.
5. The proposed development of the building or structure is consistent and compatible
with the intent and purpose of this article, the Comprehensive Plan for Cape
Canaveral, and other applicable federal, state or local laws.
6. Within the C-1, C-2, and M-1 zoning districts, any exterior building or roof color used
shall be well designed and integrated with the architectural style of the building and
surrounding landscaping in order to create a subtle and harmonious effect and promote
aesthetic uniformity within the district. Bright or brilliant Colors shall not be permitted
except for use as an accent color within the C-1, C-2, or M-1 zoning districts.
The CAB may approve an application with conditions, if appropriate. Staff is recommending
that the following conditions be placed on the approval:
1. The Accent Lighting be placed in such a manner as to minimize light pollution, glare,
and light trespass onto adjoining properties.
2. The Accent Lighting be turned off at 1:00 a.m.
3. The Accent Lighting shall not flash or change colors more than once every four seconds.
4. The Accent Lighting shall meet maximum daytime and nighttime light level standards
(ac measured in nits) as established in Sec. 94-78 (e).

Summary: This item consists of a Level 2 review for the installation of accent lighting at the
Church Street Center building located at 8177 N. Atlantic Boulevard (Attachment 1). This
parcel is located in a larger commercial corridor surrounded by vacant property and retail uses.
Due to concerns over the proliferation of LED lights in the City, Code Enforcement Staff
recently delivered a courtesy letter to approximately 12 businesses regarding window lighting
(Attached). The letter reads as follows:
The City in 2010 adopted a revised Sign Ordinance which among other things
changed the way the City regulates lighting. Specifically, the Ordinance created
a new class of lights, known as Accent Lights. By definition, Accent Lights are
"any method of external illumination that is intended to draw attention to an
integral decorative or architectural feature of the building and not connected or
giving the appearance of any connection to the overall signage of the project. "
Accent lighting is only allowed after review and approval by the City's
Community Appearance Board. A Board Application is enclosed for your
convenience along with a copy of section 94-4 of the City Code that discusses
exempt signs as well as Section 94-6 regarding prohibited signs.
Another type of lighting that the revised Sign Ordinance addresses is Window
Lighting. Window Lighting is considered "any source of illumination intended
to illuminate or draw attention to any display that is part of a window sign. "
Window lighting is prohibited by the City Code of Ordinances, except when it is
associated with a window sign as permitted in Section 94-4(6).
Section 94-1 of the City Code defines the term Accent Lighting as indicated below:
Accent lighting means any method of external illumination that is intended to
draw attention to an integral decorative or architectural feature of the building
and not connected or giving the appearance of any connection to the overall
signage of the project. Accent lighting shall be reviewed in accordance with
article III of Chapter 21 of this Code.
As indicated above, Accent Lighting may be used if approved by the CAB. When evaluating a
Level 2 application, Sec. 22-42 of the City Code identifies criteria that must be considered. Note
that these criteria were established to evaluate both Level 1 and Level 2 applications; so they
may not all apply to the subject request. Criteria include:
1. The plans and specifications of the proposed project indicate that the setting,
landscaping, ground cover, proportions, materials, colors, texture, scale, unity,
balance, rhythm, contrast and simplicity are coordinated in a harmonious manner
relevant to the particular proposal, surrounding area and cultural character of the

development which has been formally approved by the city within the surrounding
