Dear Mr. Markogiannakis
We are very pleased to welcome the Saigon Restaurant to the City of Cape Canaveral and wish
this venture tremendous success. As you may know, last year the City underwent extensive
analysis toward revising our sewer impact fee rates and assessment methodologies. During this
period, the businesses that increased the impact on our sewer system (new businesses, expanding
businesses, adding seats to restaurants, etc.) were automatically given the courtesy of additional
time to comply with the sewer impact fee collection requirement, because we anticipated new
lower fees. We were not disappointed. The new rates arc approximately 20-40% less than the
prevums rates, depending on the use. The studies were concluded, adopted by City Council and
the corresponding Ordinance and Fee Resolutions were adopted and the new fees are now in
effect.
This letter is to inform you of die fees owed.
Pursuant to the City of Cape Canaveral Code of Ordinances Section 78-128, Change of Use,
sewer impact fees are required to be paid for all structures, or use of a structure, or for any
change of use, which increases the original impact.
For this location, City records indicate that sewer impact fees for sixteen (16) seats were paid for
on January 14, 1999, permit # 99-00015. Based on a recent Staff inspection, 45 seats have been
added, bringing the total to 61 seats. In accordance with the City's Code of Ordinances, Chapter
78, Article Il, Division 3, Section 78-99; Fees, there is a balance of $9,037.12 due for the
addition of forty-five (45) seats. The calculation is as follows:
Total number of seats: 61
Total fee for 61 seats: $13,712.80 [61 x $224.80(new rate)]
Less fees previously paid: <$4,675.68> [16 x $292.23(credit at old rate)]
Difference: $9,037.12

Please consider this your Official notification that the fees must be paid to the City of Cape
Canaveral no later than March 18, 2014. City Ordinance requires that these fees be paid by a
certified check.
In the event these fees have not been paid prior to the above date, the matter will be referred to
Code Enforcement for further action as allowed by law.
