HomeMy WebLinkAboutMinutes 02-27-1992 Workshop Q CITY COUNCIL WORKSHOP MEETING FEBRUARY 27,, 1992 A Workshop Meeting of the Cape Canaveral City Council was held on February 27, 1992, at the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. The meeting was called to order at 7: 30 P.M. by Mayor Joy Salamone. Personal Appearance by Frank Piccione, Re: Solid Waste Ordinance Mr. Piccione was not in attendance. Mayor Salamone outlined the problem caused by pickers going through the dumpsters and littering. Mr. Spenik advised that Mr. Piccione was one of five pickers that go through the dumpsters and that it was impossible to determine whether the pickers had gathered their cans from the dumpsters or recycling containers. Kim Westcott, Western Waste Industries, explained that aluminum cans was the only item being recycled that produced signi- ficant revenue and that there had been a marked improvement in the quantity of aluminum cans over the past few weeks. Discussion followed. It was the consensus of opinion that no exceptions should be made and the ordinance should be enforced. 2 . Ms. Clarice Costello - Residents of Columbia Drive Ms. Costello was not in attendance. Mayor Salamone noted that 24 residents of Columbia Drive had submitted a petition requesting that the City investigate the possibility of making a passive park on the vacant lot on Columbia Drive. Dis- cussion followed. Mayor Salamone requested the City Manager to advise the residents that the City will look into the matter and, if feasible, their request will be referred to the Beautification Board. 3 . Presentation Scheduling on Final Draft of Briley, Wild and Associates, Regarding Wastewater Treatment Plant Expansion Modification and Reclaim Water Reuse System, March 2 , 1992 , at 7 : 00 P.M. , City Hall Annex Mr. Spenik was requested to confirm the attendance of the participants, Dyer, Riddle, Mills & Precourt, Inc. , and Briley, Wild and Associates, Inc. 4 . Cape Sierra: Ken Detwiler, General .Manager, and Anthony Stile, Area Site Representative, For Permit For Bungee Jumping Mr. Gordon Liametz, Marketing Director, addressed Council on behalf of their request to obtain a permit to allow Bungee City Council Workshop Meeting February 27, 1992 Page 1 of 4 Pages Q O Jumping on Cape Sierra's property. A video on Bungee Jumping was shown. Mr. Zito explained the safeguards which were mandated and monitored by State inspections. Each site location must be inspected. Discussion followed on insurance requirements, fees, hours of operation, rescue and first aid, lighting and possible liability of the City. The question of height restrictions in a C-1 Zone was discussed. It was the consensus of the Board that the request would require a variance of the height restriction. It was suggested that Mr. Stile contact the Building Official to ascertain whether a special meeting of the Planning and Zoning Board and the Zoning Board of Adjustment could be scheduled to review this request. 5. St. Johns Water Management District - Wetlands and Abandoned Artisan Wells by Gene Caputo Mr. Caputo, Ordinance Development Specialist, Palatka, outlined his background and that of Geneva Acor, Inter- governmental Coordinator, Melbourne. He explained the wide variety of resources which were available to local governments and noted that he and Ms. Acor would be available to assist the City in the preparation of their wetlands ordinance. Mr. Caputo recommended that Council determine where they want and SJWMD would be available to workshop the ideas to get a better understanding of areas which need to be addressed for the City of Cape Canaveral. Mayor Salamone requested that this item be placed on the next workshop agenda. 6. Monthly Activity Reports There were no questions on the reports. 7. Citizen Volunteers 1. Litter Pickup Mayor Salamone recapped the letter she had received from Craig & Carol Smith regarding litter along North Atlantic Avenue and their suggestions for volunteers to help. Mayor Salamone expressed the City's appreciation for their willingness to help and recommended that the Beautification Board consider coordinating this effort. 2 . Scrub Blue Jays Mayor Salamone noted that Evelin Reid had written a letter recommending that a citizens group be established to observe and record endangered species of various types. It was noted that this would be helpful to the Building Department in identifying areas where Scrub Jays may be nesting. Mayor Salamone concurred and recommended that the City look into the possibility of forming a group of volunteers. 8. City Manager's Report Mr. Spenik stated that Briley, Wild and Associated had determined that an expansion of the Washington Avenue pump station was not needed. Mr. Quinn has been advised that the City will not need any property. He added that the City is researching state of the art recording devices and will investigate the pro's and con's of rehabilitations versus future construction at the same location. Mr. Spenik reported that Rockwell International had signed the necessary documents with D.O.T. for deliterring 2 . 1 miles of AlA (Grant Avenue to Dave Nesbit Drive) . Mayor Salamone requested that a Certificate of Appreciation be given to Rockwell International for their efforts. City Council Workshop Meeting February 27, 1992 Page 2 of 4 Pages O Mr. Spenik stated that the City had received an application from City Gas Company to install a gas line to Coastal Fuels. The City has ten days to respond on the Administrative Hearing for the use of diesel fuel by Coastal Fuels. The change to natural gas line would alleviate the need of an Administrative Hearing. Discussion followed. Mr. Spenik estimated that the application from City Gas Company would be approved either Friday or Monday. Mr. Spenik stated that the RFP had been advertized in the newspaper and that three proposals had been received. Two firms had good backgrounds and one had not passed the Florida Bar. He recommended that the City move rapidly since Council could not hold a meeting without an attorney present. He requested permission to hire an attorney on an hourly basis until negotiations for an attorney can be finalized. It was the consensus of the Council that an attorney should be hired on an hourly basis. Mayor Salamone requested that a Special Workshop Meeting scheduled for Monday, March 2, 1992, 5: 30 P.M. for the purpose of inter- viewing and ranking the two firms which met the requirements and a letter be written to the applicant who did not. Mayor Salamone inquired if it would be a problem of backing up the Special Workshop to start at 7: 30 rather than 7: 00. Mr. Spenik agreed to call them and tell them. Mr. Spenik reminded Council of the Volunteer Appreciation Dinner to be held at Cape Sierra, Saturday, March 7, 1992, 5: 00 p.m. Mr. Spenik reported that he had taken a different approach on the petition the City had received for a traffic light. This happens to coincide with traffic counts that were taken as a part of the concurrency management. Information has been obtained on the type of impact we would have on that corridor of Central Boulevard and AlA within the next five years. He noted that DOT had scheduled the resurfacing of AlA this spring and that they would not allow a street cut for five years. Since the City's efforts through the Brevard County M.P.O. were not successful, Mr. Spenik recommended that the City work through our consultant, Terry Corkery. Mr. Corkery will approach the request the same as a shopping center, if the request for the light is not successful, there should be a possibility of getting a caution light at that location. Mr. Spenik noted that, due to concern over Hepatitis B, a representative from Cape Canaveral Hospital explained hepatitis and what we have to worry about. He added that the City had not provided shots before but that it was a health precaution for everyone that was in and around the plant due to the fact there were no covers over the aerator and clarifiers at the Wastewater Treatment Plant. He had made arrangements with Cape Canaveral Hospital to provide Hepatitis Vaccinations (a series of three shots) to at risk employees. The shots will be given at the Port Clinic at a cost of approximately $200 per employee. Mr. Spenik stated that the City had received a letter from the Department of Community Affairs advising that the City was in for Tree City, 1991, again. Mr. Spenik reminded the Council of the Space Coast League on March 9th at Indian Harbor Beach. Mr. Randels noted that it will be Cape Canaveral's turn next month. Discussion followed on the location a suitable location. Mayor Salamone expressed an opinion that if a location cannot be found in the City or at the Port, the League of Cities should be requested to take Cape Canaveral out of the loop. City Council Workshop Meeting February 27, 1992 Page 3 of 4 Pages 0 Discussion: Mr. Randels said that the League of Cities was polling each City to determine if there was any support to go forward with "A Friend of The Court" with this Snyder vs. Brevard County. Agreements have been entered with Melbourne Beach, Indialantic, and Satellite Beach. Brevard County has requested each individual city to file an agreement. He explained that the agreement requires that the applicant has to be advised why the property can not be rezoned and forbids any council person from meeting with any applicant outside the meeting or any interested citizen. Mr. Randels also noted that there had been some discussion on the opening prayer at the league meetings. It has been recommended that, as a consideration of those of different faiths, the prayer be general. Mr. Randels inquired about the discussion regarding the development of an amendment between the Port Authority and the Air Force Station to build a wastewater treatment plant. Mr. Spenik explained that he had met with the staff at the Port and the project did not seem feasible at this time. Mr. Kedzierski noted that he understood that the Port was seriously considering going out on their own but were still negotiating with the Air Force. Mr. Randels inquired if Council would be getting some explanation of the City Clerk's resignation. Mr. Spenik stated that it revolved around the incident that occurred on February 11th, which also involved the City Attorney, and a memorandum had been sent out Mayor Salamone reported on information received from Mr. McLouth regarding their efforts in trying to get some sand on the beach. The Deputy Clerk was requested to provide a copy to the Council members. Mr. Spenik reported that everything was going according to Nancy Hanson's plan for the Patriot's Day Activities. Items to be placed on the March 3rd Council Meeting are (1) Coastal Fuels Administrative Hearing and (2) Negotiations for City Attorney.
