CITY COUNCIL
WORKSHOP MEETING
May 28, 1992
A Workshop Meeting of the Cape Canaveral City Council was held on
May 28,. 1992, at the City Hall Annex, 111 Polk Avenue, Cape
Canaveral, Florida. The meeting was called to order at 7 : 37 P.M.
by Mayor Pro Tem Porter.

1 . Mrs. Harris, ,i Columbia Drive, re : 'additional information _on
Passive Park Request' lfor vacant lot , at210 ' Columbia;,Drive.
Mrs. Harris .presented additional information regarding the need for
a children 's park .on Columbia Drive and reviewed the reasons for
her request. Discussion followed. Council concurred to ask, the
City Manager to contact the property owner regarding a purchase
price and to refer the ' matter to the Beautification Board,
Recreation Board, and Public Works Department for additional input.
BUSINESS:
Mayor Pro Tem Porter advised that he wished to consider Item No. 7
at this time and Council concurred.
7. Report on damage to City Hall Annex with ;recommendations.
Mr. Joseph Abbott, Public Works Director, reported on the damage to
the stucco on the City Hall Annex building. He explained the
estimates he h;ad received and the work involved in repairing the
damaged, wails. Estimated cost of repairs would be $1 , 250. Council
concurred to proceed with the repairs.

alternate member.
_. Mr. Kancilia, City Attorney, interviewed the applicants for the
Code Enforcement Board _position: Tom Beasley and Carol Warner.
2. Discussion Re: Appointment of Beautification Board Members.
Mr. Kancilia, City Attorney, interviewed the following applicant
for a Beautification Board position: Curtis L. Middleton, Jr.
10. Discussion Re : Audit Letter - Dobson, Bjerning & Duffy, CPA
1988 and ,Leiter of Response January 25, 1988.
Mayor Pro Tem Porter stated that there was a question regarding
compliance with an item included in the 1988 audit report
concerning the Building Department ' s calculations of building
permit fees, impact fees, etc. Mr. Randals failed to understand
the reason for reviewing the 1987 audit now. Mr. Jim Morgan,
Building Official, explained how the building permit and impact
• fees were calculated and' the worksheet for calculating the fees on
the_ reverse side of each building permit application. Mr. Boucher

stated that Mr. Spenik had doubts about the way the fees were being
calculated. Discussion followed. It was the consensus of the City
Council not to place the item on the regular agenda.
3. Discussion Re : ,Future wastewater service to Port Canaveral -
Michael Burton Associates.
Mr. Kancilia advised that Mr. Burton had issued a draft report as
to how the City should handle its continuing relationship with the
Port. He stated that the final report and recommendations would be
presented to the City Council on Tuesday.
4. Discussion Re : Western Waste problem areas and green waste
program.
Mr. Randals stated that problem areas and the green waste program
should be discussed at a workshop when all five ( 5) members were
present. Mayor Pro Tem Porter stated that Western Waste had
presented three ( 3) options to the City, but the City could offer
its own options. He felt that the City may want to contact the
homeowners groups for their input. Discussion followed. Council
felt that Western Waste should provide additional justification for
the proposed service rates. It was the consensus of the City
Council to place this item on the next Council workshop.
5. Discussion Re: Brevard Metropolitan Planning Organization -
strategies for attaining MPO seat.
There was discussion among Council regarding the strategies to be
used to pursue a seat for the City of Cape Canaveral on the MPO.
Mr. Randals stated that a map of the County with target red
thumbtacks showing where the current seats are would be helpful
during Council 's presentation to the MPO on June 10th. There was
also discussion regarding sharing a seat with the Port, or
alternating the seat between West Melbourne and Cape Canaveral .
Mayor Pro Tem Porter stated that Council may want to allow him and
Mayor Salamone the flexibility to negotiate an alternative method
for attaining an MPO seat and Council concurred.
6. Resolution No. 92-24, regarding proposed flood insurance
legislation currently before the U.S. Congress.
Agenda this item for Tuesday.
8 . Discussion Re : Canaveral Port Authority Comments and
Recommendations concerning the Brevard County, Florida,
Shore Protection Study - Reconnaissance Report, dated March 1992.
Mr. Randals stated that there were some errors in the report
regarding the evaluation of sand loss on the beaches. He stated
that Army Corp of Engineers disregarded recreational benefits as a
value and as a result it was not feasible to do any type of sand
transfer. Mayor Pro Tem Porter stated that he would call the
Engineers and the City should write a letter opposing the new
benefit/cost ratio citing specific reasons. Mr. Boucher suggested
attaching the Olsen report to the letter. Mayor Pro Tem Porter
suggested using the study that best supports the City 's position.
Mr. Kancilia advised that the City Manager 's office could prepare
the data' and the Mayor sign the letter.
9. Discussion Re : Request from Brevard County Association of
Chiefs of Police for donations in the form of monies, door prizes,
etc. for Florida State Police Chief 's Conference in June 1992.
Council agreed to donate a City mug and t-shirt to the Brevard
County Association of Chiefs of Police.

' Mayor Pro Tem Porter recommended that Item Nos. 11-14 be placed on
another workshop when the Mayor was present. Council concurred.
DISCUSSION,•
1 . Mr. Don Arabian commented on the beach erosion.
2. Mr. Kancilia stated that the City had received an adverse
decision on the Nationwide Mutual Fire Insurance Company vs . City
of Cape Canaveral. He advised that the City had thirty ( 30) days
to appeal the decision. Agenda this item for Tuesday.
3. Mr. Randals encouraged :attendance at the Space Coast League of
• Cities meeting on June 8, 1992.
4. Mrs. Thurm advised that the Port would be putting 100,000
cubit ft. of sand on Cape Canaveral beaches due to construction at
the Port. She also mentioned two ( 2) complaints she had received
regarding bikepaths not being swept along Atlantic Avenue and
boisterous individuals loitering and drinking on the dune ,
crossovers.
5. Mayor Pro Tem Porter stated that he would like to include a
proclamation for Navy League Day on Tuesday 's agenda. Council
concurred.
