CITY COUNCIL
WORKSHOP MEETING
June 11, 1992
A Workshop Meeting of the Cape Canaveral City Council was held on
June 11, 1992, at the City Hall Annex, 111 Polk Avenue, Cape
Canaveral, Florida. The meeting was called to order at 7 : 30 P.M.
by Mayor Salamone.

BUSINESS:
1 . Discussion Re : Contract agreement with Burton & Associates,
Financial Advisor, Sewer Plant Expansion.
Mr. Spenik briefly explained the proposed contract with Burton &
Associates. Mr. Kancilia recommended two ( 2) changes to the
agreement including making the contract terminable on thirty ( 30)
days notice and that all secretarial/administrative charges be
included in the proposed hourly rates. Agenda this item for
Tuesday.
2. Discussion Re : Western Waste, Inc. , Green waste additional
pickup/contractual services.
Mr. Spenik briefed Council on the negotiations with Western Waste
for curbside pickup, reardoor service for handicapped residents,
and the additional pickup for yard waste. He stated that the $8. 01
current rate would be stable for the next two ( 2) years and the
agreement would require a contract extension of five ( 5) years to
amortize the cost of the new equipment. Discussion followed
regarding reardoor pickup , for handicapped residents and the
underground cans at Atlantic Gardens . Western Waste suggested
using commercial containers at Atlantic Gardens and this option
would be discussed further with Council and the residents within
the subject area. Agenda this item for Tuesday.
3. Discussion Re: Port Canaveral Sewer Service Percentages.
Mr. Spenik stated that the City had run a computation which
indicated an actual port income for July 1990 to June 1991 of
11 . 34% or $121 ,342 . 12 and for April 1991 to March 1992 the income
was 11. 41% or $122, 148. 26.
4. City Attorney' s Report - referendum issue.
Mr. Kancilia advised that the City Charter did not provide⢠a
separate procedure for adopting referendum items. He stated that
Florida Statutes provided that if an item was to be placed before
the electorate, the City Council would have to adopt the measure by
ordinance and then adopt a referendum question to be put before the
voters. He stated that two ( 2) of -the five ( 5) issues presented
should go to the voters: changing the terms of office of the City
Council and revision of the City Charter. Mayor Salamone suggested
working on the other issues as ordinance items.

5. Discussion Re : . Recodification of the City 's Code of
Ordinances, Land Development Regulations, and Zoning Regulations by
Municipal Code Corporation.
Mr. Spenik briefed Council on Municipal Code Corporation 's proposal
to recodify the City 's Code of Ordinances . He stated that the
process would take approximately 12 - 18 months and $2, 500 was
currently budgeted to begin the process this year. He recommended
proceeding with recodification this year and explained his reasons
for same. He stated that the City Attorney would be heavily
involved in this process and it would cost approximately $15, 000 in
attorneys fees in addition to the Municipal Code fees . Discussion

6. Discussion Re : Request for transfer of $4 ,500 - from
contingency fund for internal audit.
Mr. Spenik explained that there may be a problem with the
calculations of permit and impact fees and he requested that the
auditors complete a review of the permit process. He stated that
the City needed a check and balance system and he substantiated his
reasons for same. Agenda this item for Tuesday.
7. Discussion Re : Compliance review conducted by the State of
Florida, Department of Community Affairs, Chapter 624, Cape
Canaveral Code of Ordinances.
Mr. Kancilia stated that Kevin Markey had recommended certain
changes to Chapter 624 of the Code of Ordinances. He stated that
Chapter 668 also needed substantive changes and he suggested that
Mr. Markey, Mr. Spenik and Mr. Morgan meet with the Department of
Community Affairs to review the changes. Mr. Spenik stated that
there would be a public hearing/workshop for municipalities with
representatives of the Federal Emergency Management Association
(FEMA) in Vierra this month. Agenda this item for Tuesday.
8. Discussion Re : Resolution No. 92-27, authorizing the City's
Purchasing Agent to become a member of the Six County Cooperative
Purchasing Association (SICOP) .
Mr. Spenik explained the benefits of the SICOP"Association. Agenda
this item for Tuesday.
9 . Monthly Activity Reports.
Mr. Joseph Abbott, Public Works Director, presented three ( 3)
different scenarios currently being reviewed by Post, Buckley for
the reuse program. The next- step would involve costing out each of
three ( 3) scenarios .
10. City Manager's Report.
Mr. Spenik had no additional items to report.
DISCUSSION:
1 . Mr. Kancilia stated that he had been contacted by an attorney
for the Forgotten Veterans group who questioned why the permit
application had been refused. He stated that the group may
possibly be approaching Council again.
2. Mr. Porter stated that Council may need to revisit the MPO
issue after the MPO's denial of a seat for Cape Canaveral. Mr.
Kedzierski and Mrs. Thurm did not feel that Council needed a voting
voice on the MPO. Mr. Porter stated that the MPO had a tremendous

impact on the City and he explained his reasons for same. He
suggested approaching the Port regarding a united effort between
the City and the Port to obtain an MPO seat. Council concurred to
ask Mr. Spenik to begin talking to the Port regarding the MPO seat.
Mr. Kedzierski stated that the two ( 2) entities affected
transportation significantly.
3. Mr. John Ossman, resident of Canaveral Sands , spoke regarding
the Port transferring sands to the Cocoa Beach beaches and not to
Cape Canaveral. Mayor Salamone stated that 100,000 cubic yards of
sand would be transferred to Cape Canaveral beaches within three
( 3) months.
4. Mr. Leo Nicholas questioned the current procedure for
processing garbage complaints and he spoke specifically regarding
the garbage not being picked up at 405 Adams Avenue and 307 Adams
Avenue.
There being no further business, the meeting adjourned at 8 :40 P.M.
