HomeMy WebLinkAboutMinutes 02-14-1991 Workshop 0 0 CITY COUNCIL WORKSHOP MEETING FEBRUARY 14, 1991 A Workshop Meeting of the Cape Canaveral City Council was held on February 14, 1991 , at the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. The meeting was called to order at 7: 30 P.M. by Mayor Joy Salamone . Members Present Joy Salamone Mayor John Porter Mayor Pro Tem Andy Kedzierski Council Member Ann Thurm Council Member Rocky Randels Council Member Others Present Ed Spenik City Manager Jim Theriac City Attorney Jan Leeser City Clerk At this time City Attorney Theriac introduced two new members of his firm, Mr . Jim Woodman and Mr. David Presnick. 1 . Interview of Prospective Board Members City Attorney Theriac interviewed prospective Board Members Rita and Fred DiStasio. Mr. DiStasio noted that he would like to serve on the Planning & Zoning Board and Mrs. DiStasio had submitted her application for the Beautification Board . Agenda these appointments for Tuesday. DISCUSSION Since there were several members of the audience who wished to speak on a complaint form that had been submitted by residents of Harbor Heights, Mayor Salamone requested the Discussion Period be held at this time. Mayor Salamone noted that the complaint form was signed by over 50 residents of Harbor Heights who requested some relief from the no parking at the east end of the development by the Beach. Several of these residents addressed Council and requested that additional parking be provided . Several other residents of Harbor Heights spoke in favor of leaving the no parking as it is currently posted. Discussion followed . Mr. Spenik was directed to research the matter and report back to the Council at the next Workshop Meeting. At this time Mayor Salamone called for a five-minute recess. 2. Ordinance No. 1-91 Establishing and Imposing Ad Valorem Tax for Fire/Rescue Services (Second Reading and Public Hearing on 2-19) 3. Ordinance No. 2-91 Establishing and Imposing Ad Valorem Tax for Police Protection (Second. Reading and Public Hearing on 2-19) 4. Ordinance No. 3-91 Amending Chapter 626, Life Safety Code, by adopting 1985 NAPA #101 Code (Second Reading and Public Hearing on 2-19) City Council Workshop Meeting February 14, 1991 Page 1 of 4 • O O 5. Ordinance No. 4-91 Amending Chapter 701 , Animals Controlled, regarding Appeal Process (Second Reading and Public Hearing on 2-19). Since all of the above items were advertised for Second Reading and Public Hearing on Tuesday, Mayor Salamone requested that they be placed on the agenda. 6 . Discussion Re : Award ' of Bid . No. 90-13 Construction of Washington Avenue Beautification Project Mr. Spenik introduced Mr. Terry Stoms, the Landscape Architect on the project. Mr. Stoms recommended that the bid not be awarded to either of the two lowest bidders because they did not submit complete bids. He recommended the bid be awarded to the third lowest bidder, Florida Native Growers , in the amount of $44, 900. Mr. Stoms also noted that sod and the site preparation for the sod were not included in the specifications and that would be an additional expense of approximately $2, 000.00 Discussion followed . Discussion Re : Landscaping Design for City Ballpark and Playground Mr. Spenik advised that Mr. -Terry Stoms had submitted a proposal to do the landscaping design for the ballpark and playground for $1, 500. 00 Mr. Stoms answered Council Member ' s questions on his proposal . Agenda this item for Tuesday. 8. Discussion Re : Authorizing Funds for Beautification Board Poster Contest Mrs . Judy Randels, Chairman of the Beautification Board, addressed Council regardingthe poster contest . . Discussion followed . . It was the consensus of Council that the prizes should be awarded to each grade level rather than each class, which would reduce the cost to the City. Mrs . Randels will work up a revised proposal for Tuesday. Agenda this item. 9. Discussion Re; Beautification Board 's Recommendations regarding Establishing Landscaping Regulations and Amending Sec. 641 . 43 of Zoning Regulations Mr. Spenik advised that the -Beautification Board was proposing new Landscape Regulations and an amendment to the ZoningCode . P 9 He recommended that these items be referred to Planning and Zoning Board for review, prior to any action by Council . Discussion followed. These items will be referred to the Planning and Zoning Board . __ 10. Discussion Re : City Manager 's Request to Change Pension Eligibility Attorney David Presnick addressed Council and explained the difference between the 9 City ' s regular Pension Plan ( 401 Plan) and the Deferred Compensation Plan ( 457 Plan) . Discussion followed . Mayor Salamone voiced the opinion that there seemed to be a miscommunication between the City Manager and the Council Members during the interview process when the pension plan was discussed . She suggested the tapes of the meeting and the advertisement for the position be reviewed. City Council Workshop Meeting February 14, 1991 Page 2 of_ 4 Mr. Porter and Mr. Kedzierski spoke in favor of granting the City Manager ' s request because of the excellent job he was doing for the -City. Discussion continued. It was pointed-out-that by honoring the City Manager ' s request, the 7% contribution would be in addition to the salary he is currently receiving. Agenda this item for Tuesday. Attorney Presnick further noted that his- cursory review of the City ' s 401 Plan indicated that some changes may be necessary. It was the consensus of Council to have -the law firm review the entire document. - 11 . Discussion Re : City Attorney 's Finding regarding Political Fund Raiser Held at Cape Canaveral Volunteer Fire Department Mr. Randels noted that it was brought to his attention that the City never responded to the Volunteer Fire Department 's concern about the fund raiser that was held at the Fire Department last August. Discussion followed . The City Manager was directed to forward a copy of the attorney' s letter on the matter to the Fire Department. - 12. Discussion Re : DOT Hearing on Widening AlA It was noted that the DOT Public Hearing was scheduled for the same night as a Council " Workshop Meeting (February 28th) . Discussion was held on rescheduling the Workshop Meeting to February 26th in order to afford the Council Members an opportunity to attend the -hearing. Mr. Theriac advised that since it was an advertised- public hearing it would not be a violation of the sunshine Law if more than one Council Member wished to attend and speak --on the issue . Mr. Porter suggested the City adopt a policy on the widening of the road to be presented at the hearing. Discussion followed . It asointed out that if the meetingwere rescheduled the P Harbor Heights residents would have to be informed since they were told earlier in the evening that the parking problem would be discussed that night. Agenda this item for Tuesday. 13. Discussion Re : Tree Planting Ceremony for Former Council Member Salvaggio It was noted that the tree planting ceremony was planned for 4 : 00 P.M. on February 15th in order that Mr. Salvaggio' s family members and friends could be in attendance. Discussion followed . No action required on this item. 14 Discussion Re : Reorganization of Public Works Department Mr. Spenik reviewed his memorandum requesting a full-time Public Works Superintendent and a Secretary II for the Public Works Department. Discussion followed . Mr. Randels requested that this item be discussed further at the next Workshop Meeting. The rest of the Council Members concurred. 15. Discussion Re: Hosting Space Coast League of Cities Meeting Mr. Spenik recommended that the April Space Coast League of Cities dinner meeting be held at Captain Ed ' s. Council concurred .
