HomeMy WebLinkAboutMinutes 03-29-1990 Workshop 0 CITY COUNCIL WORKSHOP MEETING MARCH 29, 1990 A Workshop Meeting of the Cape Canaveral City Council was held on March 29, 1990 at the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. The meeting was called to order at 7: 42 P.M. by Mayor Joy Salamone. Discussion with Cablevision Re: FCC Regulations requiring Minimum Levels of Signal Leakage Mr. Bill Suggs of Cablevision introduced Mr . Doug Kettles, Construction Manager, who addressed Council on this issue. He explained that Cablevision was working with the owners and resi- dents to bring them into compliance with the FCC regulations. He distributed copies of a letter that was mailed to some of their customers. Mr. Suggs pointed out that some of the frequencies may be blocked out until compliance with the FCC regulations is met. Discussion followed. Mayor Salamone thanked Mr. Suggs and Mr . Kettles for making their presentation. Mayor Salamone requested Item 5 be moved up on the agenda. 5. Discussion re: Stormwater Management Study Mr. Scott Spooner of the City' s Consulting Engineer ' s firm of Briley,----Wild and Associates addressed Council on this issue and suggested a stair-step approach to the issue of stormwater management with the preliminary portion of the approach being an inventory of the present system. He further noted the next step would be' minimal treatment, i .e. sand filtration and/or chlori- nation. Mr. Spooner advised that the experts in the field of stormwater management do not recommend mixing stormwater and sanitary sewer effluent. Mr. Spooner further noted it. was his opinion that NPDES would require permitting for stormwater discharge in the not too distant future. He suggested the City may want -to consider implementing the stormwater- utility tax at some point in time. Discussion followed. Mr. Arabian explained his theory of reuse of potable water and recommended the City work towards that goal. Discussion followed. It was the consensus of Council to proceed only with the prelimi- nary portion of the stormwater management study at this time (inventory of the present system) . It was suggested that the study include the availability of grant funds. This item to be placed on the agenda for the Regular Meeting. City Council Workshop Meeting March 29, 1990 Page 1 of 4 0 0 2. Ordinance No. 15-90 Amending Chapter 671 , Sewer Service, by Prohibiting Septic Tanks (Second Reading and Public Hearing on April 3) • Mrs. Thurm explained that the proposed Ordinance was amended, on First Reading to allow existing septic tanks to be used until the sewer line is placed within 150 feet of the property, but no new septic tanks would be allowed. Mr. Arabian spoke against the proposed Ordinance. Discussion followed. Agenda this item for Tuesday. 3. Ordinance No. 16-90 Amending Chapter 351 , Personnel Policy, by Requiring Annual Performance Evaluation of City Manager (Second Reading and Public Hearing on April 3) It was explained that this Ordinance would require a yearly eval- uation of the City Manager. Discussion followed. Agenda for Tuesday. Mayor Salamone suggested addressing Item 6 at this time. - 6. Discussion Re: Location of Proposed Dune Crossover east of Harbor Heights Mrs. Thurm gave a brief history of the proposed dune crossover east of Harbor Heights. She explained that the City had obtained- State grant funds for the construction of one crossover. However,- the crossover could not be constructed in the location of either path currently being used by the public because the 10 ' easement is not located there. She further noted that the City had attempted to exchange the easement with the property owner but he was not agreeable to the idea. Mrs. Thurm sug- gested that the City not proceed with the construction of the crossover at this time; if the land is developed sometime in the future, the crossover could be constructed at that time. It was pointed out that at one time the City thought they had more easements in that area but only one exists. Discussion followed: Residents of Harbor Heights addressed Council on other problems in this area. Mayor Salamone explained these items would have to be addressed during the discussion period. At this time, Mayor Salamone called a five-minute recess. The meeting was reconvened at 9: 27 P.M. - Mayor Salamone suggested the agenda be rearranged as follows: Item 7, Discussion Period, Item 8, Item 9 and Item 4, there being no objections, Item 7 was addressed at this time. 7. Discussion Re: Clarification of Aesthetic Ordinance regarding Screening of Dumpster Areas Mr. Nicholas advised that - the Code Enforcement Officer had issued citations for non-compliance with the aesthetic regula- tions regarding dumpsters not being screened on three sides. He further explained that when the cases were brought before the Code Enforcement Board they had requested clarification from Council on the intent of Section 652. 13(B) ( 2) of the Aesthetic Regulations. Mr . Nicholas noted that it was his opinion the Beautification Board and Council ' s intent when adopting the Aesthetic Regulations was to have the dumpsters screened on three sides. Mrs. Hutcherson, Code Enforcement Officer, addressed Council and explained that the Code Enforcement Board had questioned the City Council Workshop Meeting March 29, 1990 Page 2 of 4 0 0 dumpsters being screened on only three sides because this normally would leave them visible from the street. It was pointed out that in most cases this was necessary to allow servicing of the dumpsters. Discussion followed. It was the consensus of Council that the intent of the Ordinance was to screen the dumpsters on three sides; attempting to make them less visible from the street, but allowing one side to be left open forservicing by the garbage contractor. No action was required on this item. DISCUSSION Several - residents of Harbor Heights, including Mr . Robert Blevins, Mr. & Mrs. Raymond McGee and Pam Lefler addressed Council on the following issues: problem with wild cats, speeding ; and parking problem at end of Harbor Drive at the beach. Discussion followed. The following course of action was decided by the Council: Animal Control will continue to trap the animals; City Manager will explore the possibility of installing rumble strips, and no parking signs will be installed and the Sheriff directed to issue tickets. Attorney Joe Scott addressed Council regarding a possible stipu- lated settlement agreement between his parties (Mr. Jim Murphy and Mr . William Bennix) , the City, and Mr. Ernie Szapor, to allow the parcel at the entrance to Ocean Woods and Mr. Szapor ' s parcel at the entrance to Harbor Heights to be developed as residential, rather than commercial, as stipulated in the Ocean Woods Statement of Justification. Mr. Scott requested this item be placed on the Regular Council meeting agenda -for action. Discussion followed. Members of Council advised that they needed more information on the item. Mayor Salamone explained that she wasawaiting a response from Attorney Theriac regarding the density calcu- lations prior to making a decision. Since Mr. Theriac was out-of-town on vacation, Mayor Salamone requested this item be placed on the next workshop agenda. 8. Discussion Re: Request from Brevard County Sheriff for Expenditure of Contraband Forfeiture Proceeds Discussion was held on the request from the Sheriff ' s Department to expend the contraband funds for new shotguns. Agenda this item for- Tuesday. 9 . Discussion Re: City Manager ' s Annual Performance Evaluation Mr. Randels and Mr. Porter noted they had not completed their evaluations of the City Manager. Discussion followed on the amount of merit increase tb be awarded to Mr. Nicholas. Mr. Randels and Mayor Salamone suggested a 4% increase in salary. Mayor Salamone noted any increase given should be retroactive to Mr. Nicholas ' anniversary date. Agenda this item for Tuesday. 4. Discussion Re: Land Use in Respect to Concurrency Management Mr. Arabian gave a presentation of his ideas regarding the use of land in the City by lowering the density and establishing builders rights.
