CITY COUNCIL
WORKSHOP MEETING
JUNE 15, 1989
A Workshop Meeting of the Cape Canaveral City Council was held on
June 15, 1989 at the City Hall Annex, 111 Polk Avenue, Cape
Canaveral, Florida. Mayor Salamone called the meeting to order at
7:30 P.M.

1 . Discussion Re: Agreement with Dobson, Bjerning & Duffey for
Audit Services for FY 1988-89
Mr. Gene:: Bjerning was in attendance and reviewed the agreement for
audit services. Discussion followed. Agenda for Tuesday.
2. Discussion Re: Study of Drainage Canal
Mr. Nicholas advised that Briley, Wild would be in attendance on
Tuesday to make their presentation before the full Council. Agenda
this item.
3 . Discussion Re: Structures in City Rights-of-way
Discussion was held on the City' s liability of allowing mailboxes to
be constructed out of concrete blocks on the City right-of-way. It
was suggested that research be done to see what other Cities have
done in this regard regulating such construction. Agenda this item
for the next workshop meeting.
4. Discussion Re: Radio Controlled Access Gate for Public Works
Facility
Mr. Nicholas noted the City had received two quotes for the access
control gate, the lowest being from Florida Door Control of Orlando
for $2,986. 00. Discussion followed. Agenda for Tuesday.
5. Discussion Re: Purchase of Three Radar Units for Sheriff's
Department
Mr. Nicholas advised the Sheriff ' s Department had requested the pur-
chase of three new radar units for a total amount of $2,990.00.
Discussion followed. Agenda for Tuesday.
6. Discussion Re: Appointment of Member to Planning and Zoning
Board
It was pointed out the City had one current applicant, Mr. Wayne
Washburn, for the vacancy on the Planning and Zoning Board. Agenda
an interview of Mr. Washburn for the next workshop meeting.

7 . Discussion Re: Statute of Limitation
Mr. Nicholas advised that recently there had been some cases brought
before the Code Enforcement Board regarding accessory structures
in violation of the required setback requirements. He noted that
some of the buildings had been in place for over 15 years. He
further explained that he had requested a legal opinion from the
City Attorney regarding the statute of limitations on these
structures and had been advised there was no statute of limitations.
Discussion advised on what course of action the City could take to
provide relief to the alleged violators:
1 . they could apply for a variance, but they would have to prove
hardship;
2. the City could provide general amnesty for these types of
structures;
3. the Code Enforcement Board could find them in violation but do
nothing;
4. the- Code Enforcement Officer could withdraw the complaints.
Mr. Nicholas suggested an amortization schedule. Mr. Theriac
advised that would only apply to non-conforming uses, not non-
conforming structures. Discussion followed.
Mr. Theriac recommended that the Code Enforcement Officer prioritize
the violations. He noted that no mater what course of action the
City takes, it will be open for criticism.
No Council action is required on this item.
DISCUSSION
Mr. Nicholas requested the Council hear, Recreation Director, Nancy
Hanson' s, request for funds for a teen-age dance. Ms. Hanson re-
quested $200.00 to fund a dance for teens between the ages of 12 and
15. Discussion followed. Agenda this item for Tuesday.
Mr. Nicholas reported on the Brevard League of Cities Meeting .
Council directed Mr. Nicholas to telegram the governor regarding
their objection to HB169 regarding group homes.
Mr. Nicholas advised that he had received nothing in writing from
the Commission on Ethics regarding the article in the newspaper
stating he had to deposit $1 ,500. 00 in an escrow account while
awaiting his appeal.
Mr. Hoog questioned Mr . Theriac on the Attorney General ' s Opinion
regarding whether or not he could vote on the plat approval of a
project he would be doing the electrical work on. Mr. Theriac noted
the attorney general would not render an opinion on the issue. He
advised Mr. Hoog that it was his opinion it was a potential conflict
and he should abstain from voting on the plats.
Mayor Salamone reported that the first Mayor ' s Youth Award had been
given to Nichole Taylor and stated she hoped it would be an on-going
program.
There being no further business, the meeting was adjourned at 8:45
P.M.
