HomeMy WebLinkAboutMinutes 08-11-1988 WorkshopCAPE CANAVERAL CITY COUNCIL WORKSHOP MEETING AUGUST 11, 1988 A workshop Meeting of the Cape Canaveral City Council was held on August 11, 1988, at the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. Mayor Lee called the meeting to order at 7s30 P.M. Member. Present Patrick Lee Mayor Bob Hoog Mayor Pro Tem Jeff Kidd Council member Steve Miller Council Member Rocky Randels Council Member Other. Present Leo Nicholas City Manager Kohn Bennett Deputy City Attorney Jan Lesser City Clerk 1, Resolution No. 88-36 Re ealin Resolution No. 88-2 and Resolut on No. 88-3 re ar n S ec a Assessments -- .0. a net Property Owners on Columb a Dr ve Mr. Nicholas explained that this Resolution was necessary because Resolution No. 88-2 and Resolution No. 88-3 specified the street repair on Columbia Drive be done by Special Assessment. Discussion followed on the referendum question which established street repairs be done by special assessment. The City Attorney will look into the matter. Agenda this item for Tuesday. 2. Resolution No. 88-37 A reement with Brevard County to Con uct Mun c pa E ect on Mrs. Lesser noted that this agreement was of a continuing nature= that previously they were renewed annually. Discussion Res Amendin Che ter 672 b increasin the Amount o Ut t ee Depoe t Mr. Nicholas explained that in the last legislative session the State adopted regulations which prohibits a municipality from taking legal action against an owner to recover utility chargee from he tenants. He suggested increasing the amount of utility tdeposit to cover the City's. losses. Discussion followed. It was the consensus of Council that $65.00 deposit for Residental Units would be a fair amount since it would be equal to three months charges. Mr. Nicholas did not recommend any changes for Commerical and Industrial deposits. Mayor Lee suggested verbage to allow for a larger rate increase brought about b. Mr. Nicholas rewrite the proposed amendment. Discussion Re: Proposed Ordinance to Prohibit Fireworks Discussion was held on the proposed ordinance. Since this Ordinance was drafted by Mr. Theriac, and he was not in attendnace, it will be placed on the next workshop agenda. Discussion Re: Proposed Aesthetic Ordinance Mr. Nicholas noted that the aesthetic ordinance had been reviewed by both the Planning and Zoning and Beautification Boards. He presented the suggested changes proposed by the Beautification Board. It was noted that the ordinance would be enforced by the Code Enforcement Board. In response to a question regarding whether or not the ordinance would be defensible, Mr. Bennett explained that the proposed ordinance was the "bare bones" of what could be enforced; that it was 908 maintenance standards with the design charactertics taken out. Agenda for first reading on Tuesday. 7. Discussion Re: Establishing Referendum Question on Restr ct ng Colora of Buildings Mr. Nicholas explained that the City Attorney was under the impression that the restricting of colors had to be accomplished by a referendum question, similar to the Community Standards. However, further research has shown this is not the case. Beautification Board Member Judy Randels gave a presentation on restricting the colors of buildings. Her research showed that the City should select color chartsof approximately 200 colors and that commercial buildings would have to be within those color ranges. Discussion followed on getting the support of the commercial community prior to adoption. The Beautification Board was urged to proceed with the establishment of regulations. 8. Discussion Re: Appointing member to Beautification Board Council members reviewed the application received from Marlene Woodside. It was noted that there was a vacancy on the Board for a Regular Member. Agenda this item for Tuesday. 9. Discussion Re: Proposed PY 1988-89 Annual Budget council reviewed and agreed to the proposed changes, which were discussed at the Special Workshop Meeting. A copy of these changes is attached hereto and made a part hereof. Mr. Nicholas presented a combined Parks and Recreation Budget and asked Council if they wished to incorporate that in this year's budget. It was the consensus that the two budgets should be combined into one. The Special Workshop Meeting scheduled for August 18th was cancelled. The First Public Hearing on the Budget will be September 6th, with adoption of September 12th. 10. Discussion Re: Settin Special Meetingfor Adoption of the M ase Rate and Bu get Mr. Nicholas explained that the revised Comprehensvie Plan needed to be adopted within 60 days of receiving the comments from DCA. He noted that day was September 12th and requested that that be added to the agenda for the special Meeting. Agenda this item for Tuesday. Mr. Nicholas noted that the Beautification Board was surprised to hear Council state that it would be paid for with revenue generated by the beautification ad valorem tax. He further noted that if Ross of Brevard did come through with the $25,000 donation as they have promised, that could go to defray the cost of the beautification. Discussion continued on the proposed trip to Guidonia. Mayor Lee asked Mr. Nicholas to make the reservations. There being no further business, the meeting was adjourned at 9:00 P.M. CITY COLTrII.
