CITY COUNCIL WORKSHOP MEETING
RE: ZONING AMENDMENTS
MARCH 25, 1982
THE CITY COUNCIL MET IN A WORKSHOP SESSION ON MARCH 25,
1982 IN ORDER TO REVIEW THE PLANNING AND ZONING BOARD'S
PROPOSED AMENDMENTS TO THE ZONING ORDINANCE.
THE MEETING CONVENED AT 7:OOPM. COUNCIL MEMBERS PRESENT
WERE: MAYOR J.L. MURPHY, JR., J. CALVERT, L. HARRIS, L. NICHOLAS,
W. RUTHERFORD; CITY ATTORNEY/MANAGER J. SCOTT, CITY CLERK P. BEAULIEU.
RESIDENTS FROM THE LONGPOINT ROAD AREA WERE ALSO IN ATTENDANCE.
CITY COUNCIL AND CITIZENS DISCUSSED THE PROPOSED ZONING AMEND-
MENT FROM R-3 TO R-1 WHICH HAD BEEN RECOMMENDED BY THE PLANNING
AND ZONING BOARD AND INITIATED BY THESE RESIDENTS ON LONGPOINT
ROAD. IT WAS NOTED THAT IT WOULD BE SOME TIME BEFORE THIS
AREA WOULD BE OFFICIALLY CHANGED TO R-1.
ALSO IN ATTENDANCE WERE CITIZENS FROM THE COSTA DEL SOL
AREA. IT WAS NOTED THAT THIS AREA WOULD REMAIN R-2 AS PER
MAP ON EXHIBIT AT THIS MEETING.
IT WAS DECIDED THAT DEFINITIONS WOULD BE COVERED AS
THEY CAME INTO THE REVIEWED MATERIAL. COUNCIL COMMENCED WITH
REVIEW OF THE AMENDMENTS TO THE ORDINANCE ON PAGE 13 AT
SECTION 633.01.
SECTION 635.01 CONFORMITY WITH REGULATIONS
CONCERN WAS EXPRESSED AS TO THE POSSIBILITY OF A SINGLE
FAMILY HOME IN COMMERCIAL BEING DESTROYED AND THE RESTRICTION
AS TO REBUILDING IT UNDER THE PROPOSED ZONING AMENDMENTS. A
POSSIBLE SOLUTION WHICH WAS SUGGESTED WAS TO CONSIDER GRAND-
FATHERING THESE HOMES IN OR TO COVER THIS PROBLEM UNDER SPECIAL
EXCEPTIONS.
SECTION 637.27 SPECIAL EXCEPTIONS PERMISSIBLE BY BOARD OF
ADJUSTMENT
THE QUESTION AROSE REGARDING THE FACT THAT CHILD CARE
CENTERS WERE NOT INCLUDED IN R-2 DISTRICT UNDER SPECIAL
EXCEPTIONS. COUNCIL REQUESTED THAT THE CITY ATTORNEY QUESTION
THE PLANNING AND ZONING BOARD REGARDING THEIR RATIONALE ON
THIS SUBJECT.
DISCUSSION ALSO CENTERED ON ADULT CONGREGATE LIVING
FACILITIES AND THE PROVISIONS FOR ALLOWING IT IN ZONING
DISTRICTS R-2 AS A SPECIAL EXCEPTION. THE POSSIBILITY OF
PLACING IT IN THE COMMERCIAL DISTRICT WAS DISCUSSED. CITY
ATTORNEY SCOTT INFORMED COUNCIL THAT HE HAD THE ATTORNEY
GENERAL'S LETTER REGARDING THE REQUIREMENTS AS TO WHERE THESE
FACILITIES SHOULD BE LOCATED AND WOULD PASS THE LETTER ON TO
COUNCIL.
SECTION 637.31 R-2 AREA AND DIMENSION REGULATIONS MEDIUM

DISCUSSION CENTERED ON HEIGHT LIMITATIONS. COUNCIL
REQUESTED PLANNING AND ZONING BOARD'S RATIONALE REGARDING
R-2 HEIGHT LIMITATION OF 3-STORIES, NOT TO EXCEED 25 FEET
AND R-1 HEIGHT LIMITATION OF ONLY 25 FEET WITH NO MENTION
OF STORIES.
SECTION 637.51 R-3 AREA AND DIMENSION REGULATIONS MEDIUM

COUNCIL SUGGESTED THE HEIGHT REMAIN AT 45 FEET NOT 50
FEET AND THE NUMBER OF STORIES CONFORM WITH WHAT IS DONE IN
R-1 AND R-2.
DISCUSSION FOLLOWED ON THE HEIGHT OF ONE OR TWO FAMILY
RESIDENCES IN R-3. IT WAS SUGGESTED THAT PLANNING AND ZONING
BOARD BE ASKED WHETHER OR NOT THEY HAD ADDRESSED THIS ITEM.

IF IT WAS ADDRESSED, THE COUNCIL REQUESTED THE BOARD'S
RATIONALE. IT WAS FELT THAT IN THE PRESENT PROPOSED A!-MND-
MENTS NO HEIGHT LIMITATION WAS LISTED, THEREFORE, A SINGLE
FAMILY HOME OR DUPLEX COULD BE BUILT IN THE R-3 DISTRICT
WITH A HEIGHT OF 45 FEET.
SECTION 637.83 PRINCIPAL USES AND STRUCTURES
CONDENSE TO READ AS FOLLOWS: "THE FOLLOWING USES AND
STRUCTURES ARE PERMITTED".
IT WAS DECIDED TO ADD 'M' ON PAGE 29, SHOPPING CENTERS
AND MALLS. ALSO ADD A DEFINITION FOR THESE CATEGORIES.
THE DELETED SECTION OF FORMER 'L', "BUSINESS SERVICE
ESTABLISHMENTS" WAS QUESTIONED BY COUNCIL.
SECTION 637.89 PROHIBITED USES AND STRUCTURES
ADD W. "DANCE STUDIOS".
THIS WORKSHOP COVERED THE AMENDMENTS UP TO, BUT NOT
INCLUDING PAGE 49, M-1.
MEETING ADJOURNED AT 9:2OPM.
