THE CITY COUNCIL OF THE CITY OF CAPE CANAVERAL, FLORIDA,
HELD A WORKSHOP, MEETING ON OCTOBER 27, 19B3 , 1983
AT CITY HALL, 105 POLK AVENUE, CAPE CANAVERAL, FLORIDA.
THE MEETING WAS CALLED TO ORDER AT 7:30 P.M. BY
MAYOR WAYNE RUTHERFORD.
COUNCIL MEMBERS PRESENT WERE: MRS. J. CALVERT, MRS. L. HARRIS,
MR. L. NICHOLAS AND MAYOR RUTHERFORD. MR. WINCHESTER ARRIVED AFTER
ALL THE ITEMS ON THE AGENDA HAD BEEN DISCUSSED.

THE MAYOR EXPLAINED THAT THIS ITEM. WAS RECOMMENDED BY THE
PLANNING AND ZONING BOARD.. ATTORNEY SCOTT FURTHER EXPLAINED THAT
THE ORDINANCE CLEARS THE LANGUAGE BY ALLOWING TOWNHOUSES IN C-1 BY
SPECIAL EXCEPTION AND ALSO SPELLS OUT THAT VACATED LAND CANNOT BE
USED IN DENSITY CALCULATIONS.

TO PLANNING AND ZONING BOARD
MAYOR RUTHERFORD EXPLAINED THAT THE PLANNING AND ZONING BOARD
WISHES TO INTERVIEW ANOTHER PROSPECTIVE BOARD MEMBER BEFORE MAKING
A RECOMMENDATION TO COUNCIL. 'DO NOT AGENDA THIS .ITEM.'
ITEM 2. RESOLUTION NO. 83-81 DESIGNATING OFFICIAL DEPOSITORIES
IT WAS EXPLAINED THAT. THIS RESOLUTION REAUTHORIZES OUR PRESENT
DEPOSITORIES. AGENDA FOR TUESDAY..
ITEM 3. DISCUSSION RE: MOTHER'S MARCH OF DIMES
COUNCIL HAD BEFORE THEM A MEMO FROM THE CITY MANAGER EXPLAINING
THAT IN THE PAST THE CITY HAS RECOGNIZED THE MOTHER'S MARCH OF DIMES
BY MAKING A DONATION IN AN AMOUNT EQUAL TO THE OCCUPATIONAL LICENSE FEE
DUE.
AGENDA FOR TUESDAY.
DISCUSSION
CITY MANAGER F. NUTT RECAPPED THE WRITTEN CITY MANAGER'S REPORT
THAT COUNCIL HAD BEFORE THEM. THIS REPORT IS ATTACHED TO THESE MINUTES
AND MADE A PART HEREOF.
MR. NUTT MENTIONED TO COUNCIL THAT PERHAPS THEY WOULD LIKE TO
CONSIDER DESIGNATING VETERAN'S DAY.A CITY HOLIDAY, EVEN THOUGH IT IS
NOT DONE IN THE PERSONNEL POLICY.
MR. NUTT REPORTED TO COUNCIL THAT AT THIS TIME MITCH OWENS OF
HOUGH AND COMPANY HAS NOTHING POSITIVE ON THE BOND ISSUE.
CITY ATTORNEY SCOTT REPORTED TO COUNCIL THAT HE HAS RESEARCHED
THE ORANGE COUNTY RESOLUTION AND IT IS TIED TO THE ALCOHOLIC
BEVERAGE LICENSES.
DISCUSSION WAS HELD ON THE REDUCED BUDGET OF THE LIBRARY.
MR. NICHOLAS RAISED THE QUESTION IF THE ITEMS THAT DR. PINDZIAK
COMPLAINED ABOUT IN HIS LETTER HAD BEEN TAKEN CARE OF. MR. NUTT
REPORTED THAT THE MAJORITY OF THE ITEMS HAVE BEEN ADDRESSED.

MR. NICHOLAS ALSO MENTIONED THAT IF THE CITY HAD PURCHASED
THE FLAGS THAT THE BEAUTIFICATION BOARD HAD BUDGETED FOR, THE VFW
WOULD PERHAPS TAKE IT ON AS A PROJECT TO PUT THEM UP AND TAKE
THEM DOWN.
MR. NICHOLAS ALSO QUESTIONED WHEN HARBOR HEIGHTS RESURFACING
WOULD BEGIN..
CHARLEY McCONNELL, VICE-CHAIRMAN OF THE PLANNING AND ZONING
BOARD, SAID THAT THE BOARD WOULD LIKE TO SEE THE MAP SHOWING DENSITY
CALCULATIONS IN THE BUILDING DEPARTMENT KEPT UP. MR. NUTT ASSURED
MR. McCONNELL THAT HE HAD ALREADY SPOKEN TO ACTING BUILDING OFFICIAL
KELLER ABOUT THIS.
ATTORNEY STEVE JACOVITZ, REPRESENTING AN OWNER OF ONE OF THE
BOTTLE CLUBS, ASKED COUNCIL IF DISCUSSION COULD BE REOPENED ON
ORDINANCE NO. 22-83 BECAUSE HE HAD MISSED THE ITEM WHEN IT WAS
DISCUSSED EARLIER. HE SPOKE IN OPPOSITION TO THE ORDINANCE BECAUSE
HE FELT IT WAS A DISCRIMINATION ISSUE BY CLOSING DOWN THE BOTTLE
CLUBS ALREADY IN BUSINESS.
THE MEETING WAS ADJOURNED AT 8:20 P.M.

RE: City Manager's Report'
1. The City Maintenance Department began beach cleanup on
Monday of the dead fish resulting from the Red Tide. On
Tuesday, five trustees from Brevard Correctional
Institution joined the City crew to continuethe fish
cleanup activity and to expand the operation to include
litter pickup. The trustees will be utilized for the
remainder of the week to assist the beach cleanup program.
The Sheriff's Department has .been very cooperative in help-
ing arrange
elp-
ingarrange for the use of the trustees and in transporting
them to and .from DCI.
2. This year's Dune Crossover Project is beginning to take shape.
We have met with the Department of Natural Resources and are
in the process of updating our grant application. We will
shortly begin to survey the existing crossovers to determine
which need to be extended and to what degree. Also dune
vegetation and restoration locations will be identified.
After this in work is completed the engineering

phase will begin so that plans and specifications pplying
developed.. This work. must be completed prior to applying
in
for the necessary Department of Natural Resources permits.
Funds must be expended or under contract for expenditure
with DNR prior to April 1,'1985.
3. Imet with Lary Fleckinger of Western Waste Industries
to relate the discussion Council has had with regard to
Larry
dumpsters. Western Waste will cooperate with the City
in relocating dumpsters from the City rights of way and in
identifying undersized dumpsters.

We are researching the ownership of dumpsters on the list
supplied by the Beautification Board. Letters will be sent
when this is completed.
I also expressed the City's concern that the orange color
for the dumpsters was notappropriate for Cape Canaveral.
He said he would meet with .Western Waste officials this
week to explain the City's position and attempt to con-
vince them thatthe dumpsters should not be repainted
orange.
q. The City's new Chevette was delivered October 21. We
will be conducting an -analysis of our vehicles, including
condition and utilization. It is anticipated that a
comprehensivevehicle, policy will be developed that will
assist us in future budget planning.
5. We have been receiving applications this week for a number
of positions currently vacant. 'Interviews will be
scheduled and appointments will follow shortly thereafter.
