THE MEETING WAS CALLED, TO ORDER AT 7:30 P.M. BY MAYOR WAYNE RUTHERFORD COUNCIL MEMBERS PRESENT WERE: MAYOR WAYNE RUTHERFORD, MRS. J. CALVERT, MRS. L. HARRIS, MR. L. NICHOLAS AND MR. J. WINCHESTER. COUNCIL 11EMBERS ABSENT WERE: NONE ALSO PRESENT WERE: CITY MANAGER F. NUTT AND CITY ATTORNEY J. SCOTT. UNFINISHED BUSINESS ITEM 1. ORDINANCE NO. 24-83 RE: AMENDMENTS TO ZONING ORD. RESOLUTION NO. 83-86 APPOINTMENT OF ALTERNATE MEMBERS TO PLANNING AND ZONING BOARD THIS IS THE RECOMMENDATION OF THE PLANNING AND ZONING BOARD AND WILL MOVE JOHN HARBISON FROM SECOND ALTERNATE TO FIRST, AND APPOINT GEORGE WOLEVER AS SECOND ALTERNATE. RESOLUTION NO. 83-87 APPOINTMENT OF BEAUTIFICATION BOARD MEMBER THIS APPOINTMENT IS THE RECOMMENDATION OF THE BEAUTIFICATION BOARD AND WILL APPOINT ALICIA BRITTAIN AS A REGULAR MEMBER OF THE BOARD. AGENDA FOR TUESDAY'S MEETING. DISCUSSION CITY MANAGER F. NUTT DISCUSSED THE CITY MANAGER'S REPORT WHICH IS ATTACHED TO THESE MINUTES. CITY ATTORNEY SCOTT REQUESTED TWO ITEMS BE ADDED TO THE AGENDA. THE FIRST ITEM IS SETTING A PUBLIC HEARING DATE FOR VACATING AN ALLEYWAY BETWEEN JACKSON AND HARRISON. PETITIONERS ARE JAMES AND SHARON BOGAN. THE SECOND ITEM IS PERMISSION TO ADVERTISE A ZONING AMENDMENT REGARDING ESTABLISHMENTS WHICH SELL, DISPENSE, SERVE OR STORE ALCOHOLIC BEVERAGES AND ON WHICH PREMISES ALCOHOLIC BEVERAGES ARE CONSUMED. MRS. HARRIS MENTIONED THAT THE BEACHES LOOK VERY GOOD SINCE THE MASSIVE CLEAN-UP DONE AFTER THE RED TIDE. MR. WINCHESTER QUESTIONED THE STATUS OF OUR APPEAL ON THE LONG POINT ROAD CASE. ATTORNEY SCOTT POINTED OUT THAT WRITING THE BRIEF IS THE NEXT STEP. MR. NICHOLAS MENTIONED THAT THE MEMBERS OF THE VFW POST WOULD BE HONORED TO HELP IN PUTTING THE FLAGS UP AND DOWN ON THE UTILITY POLES ON HOLIDAYS. MRS. CALVERT QUESTIONED WHEN THE STREET LIGHTS THAT THE COUNCIL HAD AUTHORIZED A FEW MONTHS AGO WOULD BE INSTALLED. MRS. MCGRAW, CHAIRMAN OF THE BEAUTIFICATION BOARD, REQUESTED A POLICY BE ESTABLISHED ON CLEARING VACATE LOTS. SHE ALSO QUESTIONED IF SOMETHING MORE COULDN'T BE DONE ABOUT THE DOGS RUNNING AT LARGE IN THE CITY. On November 2,'1983, Judge Waddell issued temporary injunction prohibiting the City from enforcing Ordinance No. 23-83. Judge Waddell telephoned the City Attorney who informed me of the Order. The Sheriff's Department was notified, but the message was misunderstood and the Bottle Clubs operating within the City were told by deputies to close at 4:00AM on November. 3, 1983. This has been corrected and the Bottle Clubs are now open until 7:OOAM. On November 4, 1983, the City. was served a formal notice of a lawsuit filed by the Beach Bottle Club asking for the Court to invalidate Ordinance No. 23-83 and to declare the Ordinance unconstitutional. The City Attorney will be advising the Mayor and city Council on this matter. The owner of Mr. Lucky's Bottle Club has also filed papers to invalidate the Ordinance. 2. I attended the Board of County Commissioners Meeting on Thursday, November 3, 1983 to express the City's concern that the Cape Canaveral Library budget was being reduced dispropor- tionately to the other library budgets. The other small libraries and the Bookmobile also had good representation. The Commissioners, after much discussion, agreed to adopt the County Library, Board's recommendation to reduce the Cape Canaveral Library's budget to $50,000. The Commissioners also stipulated that the County Library Director was to find funding to continue operation of the Bookmobile on a limited basis. Irene Sanders was to meet with the County staff on Friday to modify her budget to comply with the budget cuts and would then meet: with the local Library Board. Larry Fleckinger advised me that Western Waste Industries regional office does not object to discontinuance of the repainting of dumpsters in orange. He requested that the City designate a color for the dumpsters and the company would change the dumpsters to that color. 4. Resurfacing of the Harbor Heights Subdivision was begun this week. The asphalt contractor completed his work and we will let the pavement take hold for a while before we accept the job. We also utilized the contractor's equipment to repair other streets that needed potholes patched. 5. A vendor has been located to supply the flags and brackets for the Beautification Board's flag project. We are waiting for permission from Florida Power and Light to use the power poles on AlA. The flags will be ordered when permission is granted. 6. The City Attorney and Iattended a symposium on the Citizen's Choice Amendment (Proposition 11). I have some informativematerials which we received should you wish to review them. We are in the process of compiling data on the impact of Proposition it on .Cape Canaveral.
