THE MEETING WAS CALLED TO ORDER AT 7:31 P.M. BY MAYOR WAYNE RUTHERFORD. COUNCIL MEMBERS PRESENT WERE: MAYOR RUTHERFORD, MRS. J. CALVERT, MR. L. NICHOLAS AND MR. J. WINCHESTER. MR. FISCHETTI WAS ABSENT DUE TO OUT OF TOWN BUSINESS. ALSO PRESENT WERE: CITY MANAGER F. NUTT, CITY ATTORNEY J. SCOTT AND CITY CLERK P. BEAULIEU. UNIFNISHED BUSINESS ITEM 1. ORDINANCENO 25-83 AMENDING ZONING ORDINANCE NO. 2-83, AS ARE BY AMENDING SECTION 632.0 637.51 (H) 641.01 A FIRST READING AND PUDLIC HEARING DECEMBER 6) COUNCIL HAD BEFORE THEM THE TITLE OF THE PROPOSED ORDINANCE AND MINUTES FROM THE PLANNING AND ZONING BOARD OF OCTOBER 26 AND NOVEMBER 9. ATTORNEY SCOTT INFORMED COUNCIL THAT HE WOULD DRAFT UP THE ORDINANCi FOR THE TUESDAY COUNCIL MEETING. ITEM 2. RESOLUTION NO. 83-84 RE:_ COUNCIL AREAS OF INTEREST (POSTPONED NOVEMBER 15) DISCUSSION FOLLOWED AS TO THE AREAS DESIGNATED IN THE SECTIONS OF THE RESOLUTION WHICH COUNCIL HAD BEFORE THEM AT THIS WORKSHOP. SUGGESTIONS WERE MADE BY COUNCIL. IT WAS DETERMINED THAT SINCE THE CITY DID NOT HAVE A SIGN ENFORCEMENT BOARD, THE"SIGN ENFORCEMENT BOARD"SHOULD BE REMOVED FROM SECTION 1 AND SINCE THE CODE ENFORCEMENT BOARD WOULD BE ENACTED IN THE NEAR .FUTURE THE"CODE ENFORCEMENT BOARD" SHOULD BE PLACED IN SECTION 5. IT WAS DECIDED TO TAKE'CITY BEACHES, WATERWAYS, DRAINAGE, EROSION CONTRON'FROM SECTION 5 AND PLACE THEM IN SECTION 1. A SUGGESTION WAS MADE THAT FURTHER CHANGES MAY BE MADE AT THE TUESDAY COUNCIL MEETING WHEN A FULL COUNCIL WAS IN ATTENDANCE. ITEM 3. RESOLUTION NO 83-90 RE: VACATING ALLEYWAY, AVON -BY - THE -SEA BLOCK35 PETITIONER - SHARON BOGAN PUBLIC HEARING ON DECEMBER 6 COUNCIL HAD BEFORE THEM A LETTER FROM PETITIONER SOGAN REGARDING THE PENDING CLOSING SALE OF LOTS ON THIS BLOCK TO MS. HOGAN. A QUESTION AROSE REGARDING LOTS 14 AND 15 AND THEIR ACCESS. IT WAS DECIDED TO CONSIDER THIS MATTER FURTHER AT THE REGULAR COUNCIL MEETING ON TUESDAY WHEN COUNCIL WOULD HAVE ADDITIONAL INFORMATION ON THE SUBJECT. UNFINISHED BUSINESS ITEM 1. RESOLUTION NO. 83-89 RE: ACCEPTANCE OF HARBOR HEIGHTS RESURFACING PROJECT CITY MANAGER NUTT EXPLAINED TO COUNCIL THAT THIS PROJECT'S TOTAL COST WAS LESS THAN ANTICIPATED. HE REPORTED THAT THE ASSESSMENT ROLL WOULD BE ADJUSTED ACCORDINGLY. A POSSIBLE PROBLEM WITH ASMALL PORTION OF THE RESURFACING WAS BROUGHT UP BY MR. NICHOLAS. CITY MANAGER NUTT TO CHECK THIS PROBLEM OUT PRIOR TO THE TUESDAY MEETING. ITEM 2. RESOLUTION NO. 83-90 RE: APPOINTMENT OF FIRST ALTERNATE MEMBER TO BOARD OF ADJUSTMENT COUNCIL HAD BEFORE THEM A LETTER FROM JO BARR OFFERING HER SERVICES ON THE BOARD. THIS ITEM TO BE PLACED ON TUESDAY ,AGENDA.. ITEM 3. AUTHORIZATION RE: CHRISTMAS BONUSES FOR CITY EMPLOYEES COUNCIL HAD BEFORE THEM A BONUS LIST FOR CITY EMPLOYEES. TOTAL COST OF BONUSES WOULD BE $2,500. THIS ITEM TO BE PLACED ON THE TUESDAY AGENDA. ITEM 4. AUTHORIZATION RE: FIRE DEPARTMENT FOURTH QUARTER PAYROLL DISTRIBUTION FOR DECEMBER 16 IT WAS EXPLAINED THAT THE FIRE DEPARTMENT'S PAY FOR THIS FOURTH QUARTER WOULD NOT BE FORTHCOMING UNTIL THE END OF DECEMBER. IT WAS NOTED THAT COUNCIL HAD IN THE PAST APPROVED EARLY PAYMENT OF THIS FOUTH QUARTER PAYROLL DUE TO CHRISTMAS. THIS ITEM TO BE PLACED ON THE TUESDAY AGENDA. ITEM S. AUTHORIZATION RE: CANCELLATION OF DECEMBER 29 WORKSHOP AND COMBINING WORKSHOP WITH REGULAR MEETING OF JANUARY 3 'THIS ITEM TO BE PLACED ON THE TUESDAY AGENDA. ITEM 6.. DISCUSSION RE: LOT CLEARING ORDINANCE COUNCIL HAD BEFORE THEM AN ORDINANCE WHICH HAD BEEN DRAFTED UP. BY CITY MANAGER NUTT FOR THEIR REVIEW. THE CITY MANAGER ALSO REQUESTED THAT COUNCIL REVIEW THE ATTACHMENTS TO THE ORDINANCE WHICH WERE FROM OTHER CITIES. IT WAS EXPLAINED THAT THESE CASES WOULD BE A NUISANCE AS OPPOSED TO A CODE VIOLATION. DISCUSSION CENTERED ON ADMINISTRATIVE HEARING BEFORE THE CITY MANAGER WITH THE RIGHT TO APPEAL HIS DECISIONS TO THE CITY COUNCIL. A SUGGESTION WAS MADE THAT PERHAPS THE BEAUTIFICATION BOARD COULD BE MADE THE BOARD OF APPEALS. CITY ATTORNEY TO LOOK INTO THIS MATTER. THIS ORDINANCE TO BE CITY COUNCIL WORKSHOP MINUTES, 12-1-83, PAGE 2 OF 4 PLACED ON TUESDAY'S AGENDA. ITEM 7. ORDINANCE RE: SPECIAL INSPECTOR THRESHOLD BUILDINGS COUNCIL HAD BEFORE THEM A MEMO FROM MR. NUTT WHICH EXPLAINED THE NEED TO ACT ON THIS ITEM. ATTACHED TO THE MEMO WERE EXCERPTS FROM THE FLORIDA STATUTE REGARDING THIS SUBJECT. THIS ITEM TO BE PLACED ON THE TUESDAY AGENDA. MR. NUTT'S MEMO IS ATTACHED TO THESE MINUTES.ALONG WITH THE FLORIDA STATUTE EXCERPTS. DISCUSSION: CITY MANAGER NUTT NOTED THE LETTERS THAT COUNCIL RECEIVED IN THEIR MAIL REGARDING THE LIBRARY. HE INFORMED COUNCIL THAT THE LIBRARY WAS DOWN TO TWO EMPLOYEES, CLOSED ON WEEKENDS AND NIGHTS.' MR. NICHOLAS SUGGESTED THAT THE CITY CONSIDER SUBSIDIZING THE LIBRARY SALARIES IN THE AMOUNT OF $7,704. A COPY OF MR. NICHOLAS PROPOSAL IS ATTACHED TO THESE MINUTES. THE PROPOSAL WOULD INCLUDE BALANCE OF FISCAL YEAR AND NOT INCLUDE JUNE, JULY OR AUGUST. MR. NICHOLAS REQUESTED THAT THIS ITEM BE PLACED. ON THE TUESDAY AGENDA FOR COUNCIL ACTION. MR. NUTT ALSO REPORTED THAT HE HAD SPOKEN WITH THE NEW SUPERVISOR AT WESTERN WASTE AND WILL 14EET TO DISCUSS QUALITY AND QUANTITY OF SERVICE. MR. NUTT. INFORMED COUNCIL THAT HE HAD SENT OUT THE FIRST GROUP OF DU14PSTER LETTERS AND HAS RECEIVED SOME CALLS REGARDING THE SUBJECT. THE CITY MANAGER ALSO. INFORMED COUNCIL THAT HE HAD SPOKEN TO MR. CANTERBERRY AT.. FLORIDA POWER AND LIGHT REGARDING THE USE OF THE POLES FOR,THE BEAUTIFICATION BOARD'S FLAGS AND DECORATIONS. HE INFORMED COUNCIL THAT THE CITY WOULD PROBABLY BE ABLE TO USE THE POLES THAT DO NOT HAVE TRANSFORMERS ON THEM. ATTORNEY SCOTT SPOKE TO COUNCIL REGARDING A LETTER WHICH HAD BEEN RECEIVED THIS DATE FROM THE LAW OFFICES OF WOLFE, KIRSCHENBAI MOSLEY, CARUSO AND KABBOORD.REGARDING FORMER WASTEWATER TREATMENT PLANT EMPLOYE JOY MARCONI. MR.. SCOTT INFORMED COUNCIL THAT AN UNEMPLOYMENT. HEARING WAS SCHEDULED FOR DECEMBER 6 REGARDING MRS. MARCONI'S CLAIM FOR BENEFITS AND HE WOULD HAVE MORE INFOR- MATION ON ALLEGATIONS IN THE MATTER AFTER THE HEARING. CITY COUNCIL WORKSHOP MEETING 12-1-83 ..l . FLORIDA 32830 P.O. no 3D5 713-1100 TELEPHONE ]0S ]B ]•1100 CITr CF December 1, 1983 M E M O R A N D U M TO: Mayor and City Council FROM: City Manager RE: Special Inspectors for Threshold Buildings .During the pastlegislative session, the Florida Legislature adopted a bill that requires cities and counties to designate special inspectors for "threshold buildings." Criteria was established as to who qualifies as a special inspector, as well as the type of inspections required. "Threshold building" means any building or structure which: A. Has a total floor area exceeding 25,000 square feat, or B. Is greater than two (2) stories or 25 feet in height, or C. Basan assembly occupancy greater than 5,000 square feet, or D. Is of unusual design or construction as determined by the. Building official. The City should adopt the State Statute by. reference and include additional language for clarity and local enforcement. The State has provided guidelines for interpretation and implementation which should be included in the City Ordinance. The Mayor and City Council needs to authorize advertise- ment of the proposed ordinance at the December 6 City Council Meeting. l 'rader].ck C. Nutt City Manager FCN/tgr !!De 101 7. Definitions special Inspector: The Inspector shall be a person certified, licensed, or registered under the Building Officials Association of Florida; the Southern Building Code Congress International; Chapter 4711 as an engineer; Chapter 481, as an architect; or the Council of American Building Officials. All such persons must have demonstrated and proven capability to inspect structural components of thresholdaa buildings. Threshold Building: "Threshold building" means any building or structure which: (a). has a total floor area exceeding 25.,000 square feet, Sr. (b) is greater than 2 stories or 25'feet in height, or (c) has an assembly occupancy greater than 5,000 sq. feet, or (d) is of unusual design or construction as determined by the building official. Exception: Residential structures 3 stories or.less in height and any building.defined in S. 481-203(7) or S. 481.229, F.S. (agricultural buildings on farms; single family dwellings and duplexes; and buildings costing less than $25,000 except schools, . auditoriums and other public use buildings.) General Contractor: Theterm"General Contractor" is specifically defined in Section 489, F.S. and cannot be construed to include -building contractors. General Provisions 1. The building owner shall negotiate for and pay the, salary of any required special inspector(s). 2. The special inspector shall be qualified.and be, acceptable to the building official.' 3. There must be an errors and omissions bond for one million dollars posted by and for the special inspector, to the City of Cape Canaveral. Paye 2 of 2 The salary for the special inspector will be certified as ' •' "paid", by form letter to the building official. The letter to indicate name, location, permit number, hours and dates worked, and amount paid. The letter to be submitted at the end of each two-week. period. 5. The special inspector will notify the building official in order that a dual inspection can be made of all structural components prior to "cover up" or pouring of concrete, etc. 6. The project engineer will sign a suitable form which indictes he has inspected prior to the dual inspection and states. that "the plans have been complied with" for whatever stage of construction is. occurring. . 7: The building plans for threshold buildings must bear the notation "these plans comply with minimum building codes", .and in addition an owner's certificate prepared by an engineer or architect must state that "construction complies with applicable codes and the intent and design specified in permitted documents". 8. The project engineer and general contractor shall .certify that•all shoring and reshoring meets the sealed engineer design prior to pouring any concrete. . PROPOSED BUDGET CHANGE TO.
