OCTOBER 16, 1962
A Regular Meeting of the City Council of the City of Cape Canaveral
was held at 7:30 P.M., October 16, 1962, at the Recreation Hall of the Cocoa Palms
Trailer Park.
City Officials Present were: Acting Mayor, George 0. Rogers, Leo B. Collins,
C. F. Applegate, A. D. Anderson, William Eberwein, City Clerk Shirley Jenkins and
City Attorney George Ritchie. Absent: Mayor R. A. Jamieson.
The meeting was called to order by the president Pro Tem.
The minutes of the Regular Meeting of October 9, 1962, were read and on
MOTION duly made, seconded and passed unanimously as read.
1. The Utility Tax No.__ was given its final reading, after a general
discussion was held with the council, a MOTION was duly made, seconded that a
vote be taken for its passage. The MOTION failed to carry. The vote was 1 for
and 2 against passage.
2. The next item of business was the 2nd and final reading of the
Aminal Ordinance No.____ . After a general discussion was held a MOTION was
duly made and seconded that it be unlawful to let any dog run at large. MOTION
carried. The vote was 2 for and 1 against. On MOTION duly made, seconded and
passed unanimously that a person shall have seven (7) days to rectify the nuisance
and if such nuisance is not rectified the owner shall be deemed guilty of a
misdeameanor and punished as provided in this ordinance. , On a MOTION duly made,
seconded and passed unaninously the Aminal Ordinance No.___ was accepted. The
Aminal Ordinance No.___ was signed by the president Pro tem, the Acting Mayor
and attested by the City Clerk.
3. A general discussion was held vith the council on the City's Recreation
Park, it was agreed by the Council that Mr. Applegate, Mr. Anderson and the City
Attorney talk to Mr. Carney, the County Attorney and report at the next Regular
Meeting. Mr. Anderson reported that he had talk with Mr. Kelly Brinson of the

Port Authority and that Mr. Brinson was in favor of a recreation park for the
City and would like those who are interested to attend their next meeting,
at 1:45 P.M., November 21, 1962, at the Port Authority Office for a discussion.
4. The Traffic Ordinance No.____ and the Public Nuisance Ordinance
No._____ was tabled for the next regular meeting.
5. The Master Plan of the City was tabled for the next regular meeting.
Mr. Rogers reported that 2 proposals were in and that 2 were not in.
6. The Zoning Ordinance No.____ was given its 1st reading in its
entirety. The Ordinance is entitled; "AN ORDINANCE OF THE CITY OF CAPE CANAVERAL
FLORIDA AND KNOWN AS THE ZONING ORDINANCE REGULATING THE NUMBER OF STORIES AND
SIZE OF BUILDINGS AND OTHER STRUCTURES. THE PERCENTAGE OF LOT THAT MAY BE
OCCUPIED, THE SIZE OF YARDS, COURTS AND OTHER OPEN SPACES, THE DENSITY OF
POPULATION AND THE USE OF BUILDINGS, STRUCTURES, LAND AND WATER AREAS FOR TRADE
INDUSTRY, RESIDENCE OR OTHER PURPOSES; FOR SUCH PURPOSES CREATING DISTRICTS
AND ESTABLISHING THE BOUNDARIES THEREOF; DEFINING CERTAIN TERMS USED HEREIN;
PROVIDING FOR THE METHOD OF ADMINISTRATION AND AMENDMENT; ESTABLISHING A
BOARD OF AJUSTMENT AND DEFINING THE POWERS AND DUTIES THEREOF; PROVIDING
PENALTIES FOR VIOLATION; REPEALING CONFLICTING ORDINANCES, AND FOR OTHER PURPOSES."
The following changes were agreed on by the City Council:
ARTICLE II - SECTION 1.
DWELLING TWO FAMILY - the word "exclusively" was added after occupied and
before by.
GRADE FINISHED - The word laws was changed to "lawns".
MOTEL - the word appelations was changed to "applications".
OCEAN BLUFF LINE - full moon high tide was deleted and in its place was
inserted "high water mark of the mean Spring Tide of
the Atlantic Ocean ".
ARTICLE IV - SECTION 2.
Paragraph (e) was changed to Paragraph (2).

ARTICLE XVII - SECTION 25
Paragraph 3, was deleted.
7. The Sub - Division Ordinance No.____ was given its 1st reading in its
entirety. The Ordinance is entitled: " AN ORDINANCE REGULATING THE SUBDIVISION
OF LAND; REQUIRING AND REGULATING THE PREPARATION AND PRESENTATION OF PRELIMINARY
AND FINAL PLATS; ESTABLISHING MINIMUM SUBDIVISION STANDARDS; PROVIDING MINIMUM
IMPROVEMENTS TO BE MADE OR GUARANTEED TO BE MADE BY THE SUBDIVIDER AND PRE -
SCRIBING PENALTIES FOR VIOLATION THEREOF."
8. The Acting Mayor requested a Special Meeting for the purpose of
giving the Zoning Ordinance and Sub - Division Ordinance their 2nd and Final Reading,
to be held at 7:30 P.M., at the Recreation Hall of the Cocoa Palms Trailer Park.
A MOTION was duly made, seconded, that a Special Meeting be held at 7:30 P.M.,
October 17, 1962. MOTION carried. The vote was 2 for and 1 against.
On a M0TION duly made, seconded, and passed unanimously meeting was
adjorned at 12:30 A.M.
