HomeMy WebLinkAboutMinutes 08-07-1962REGULAR MEETING August 7,1962 A regular meeting of the City Council of the City of Cape Canaveral was held Tuesday, August 7, 1962, at 11 :45 P.M. at the Recreation Hall of the Cocoa Palms Trailer Park. City Officials Present: Mayor R. A. Jamieson; Aldermen George Rogers, Leo B. Collins, A. D. Anderson, C. F. Applegate and W. J. Eberwein; City Clerk Jean Taylor and City Attorney George Ritchie. The Minutes of the Regular Meeting of July 31, 1962 were perused by the Council and on MOTION duly made, seconded and passed unanimously were approved as presented. The Minutes of the Special Meeting of August 2, 1962 were perused by the Council and on MOTION duly mnde, seconded and passed unanimously were approved as presented. Absentee ballots were given to the Council by the City Clerk, the ballot of Mrs. Betty O.Clark had not been received by the legal time limit and remains an outstanding ballot. The report of the Election Board was received and read. The report and the tally sheets of the Election Board are attached hereto and made a part hereof. On MOTION duly made, .seconded and passed unanimously the following RESOLUTION was made: RESOLUTION NO. 12 It is hereby RESOLVED by the City Council of the City of Cape Canaveral to accept the report of the Election Committee as submitted and as the result of their tabulations, it is hereby found that the following Charter Board Members are duly elected C. P. Cook, William E. Greaney, Jr., Eugene J. Jandreau, William R. King and Richard Thurm; and the following Permanent Election Board members 2 Regular Meeting August 7, 1962 are duly elected: Norma Markham, Mary V. Shepherd, Gladys Chandler, Lloydine Collins and Anne K. Larson. In the event that any of the five members of the Election Board do not desire to hold office then the next highest candidates are hareby declared alternates which will be fully entitled to the privileges and duties as members of the Election Board, if requested to accept, and they shall be requested in the following order: Dorothy Harris, Betty.O.Clark and Betty Anderson. ORDINANCE No. 3-62: Ordinance #3 -62 was returned to the Council Vetoed by Mayor R. A. Jamieson. The reasons for his veto were contained in a letter which is attached hereto and made a part hereof. On MOTION of C, F. Applegate, seconded by W. J. Eberwein and passed by 2/3 vote of the Council, the Mayor's veto was overridden. Alderman Leo B. Collins voted against overridding the Mayor's veto. CIGARETTE TAX MONIES: A letter was read from the State Beverage Department stating that the City should expect their first monies from the Cigarette tax by October 10, . 1962. BILLS: The following list of bills was presented to the Council for approval of payment: Rent $75.00 Water Bill $3.25 Brevard County Ed Sprow (thermofax) 20.00 Recreation Bd. 439.43 Morton's Mimeo Service 4.20 Cocoa Tribune 32.20 Al's Signs 54.50 Frank Hoog 5.96 Brevard Printing 27.80 P&R Office Sup. 21.55 Jean Taylor (stamps) 1.94 George Ritchie 345.00 (late in arriving) On MOTION duly, made, seconded and passed unanimously all due bills were approved for payment with the exception of the $439.43 due to Brevard County Recreation Board and $345.00 due to Attorney George Ritchie. 3 REGULAR MEETING August 7, 1962 CORRESPONDENCE: A letter was read from the Joint Impact Committee giving information on securing municipal improvement loans in impact affected areas. A letter was read from Smith and Gillespie Engineers requesting a conference with the City Officials. An appointment was set up with them for Wednesday, August 15, 1962 at 7:30 P.M. Jamieson, Mayor SUBJECT: Ordinance 3 -62 On 19 June 1962 in a letter addressed to you and which was read publicly concerning the same ordi- nance, I wrote, "Because of..the importance and the nec- essity of this ordinance,I respectfully request the council give additional consideration not only to the occupational license tax ordinances of the surround- ing citites of Brevard County, but also to the opin- ions of the citizens of our community." Again on 5 July 1962 in another letter addressed to you and read Publicly, I wrote, "I request that the council recon- sider the occupational license ordinance and, after careful study of like ordinances in the surrounding area, write an ordinance covering. this need that will prove to be equitable and fair to the existing as well as prospective people residing or doing business with- in our corporate. limits." No one is more aware than I of our urgent need for monies for our town which could be derived from this ordinance. In spite of this need, I cannot in good conscience, and as an elected official repre- senting the people of this town, approve this ordinance in its present status. Firstly, I sincerely feel that too little time has been devoted to its drafting. This becomes apparent by examining like ordinances adopted by our neighboring towns. Secondly, the inequities which existed in the first ordinance which I vetoed are still present. It Is intolerable, in my opinion, to give one group of our citi- zens tax benefits not enjoyed by the remainder of our citi- zens. I specifically refer to some crafts and professions being charged a less amount because they are residents of our town. If some are to be given benefits because they are residents, then all trades, crafts, professions, etc. should be given like benefits. This inequity could easily be remedied by the insertion of a paragraph giving a flat percentage reduced fees to residents. Thirdly, a review of the minutes of the regular council meeting held 31 July 1962 and of the special coun- cil meeting held 2 August 1962 reveals that changes were made to Ordinance 3- 62.after the first reading and that the addition of another section was made to the ordinance at the special meeting. The ordinance as it is now written has not been read the required number of times. In view of the above, I.have no recourse but to veto this ordinance as presented. Signed: R.A.
