HomeMy WebLinkAboutMinutes 06-02-1962OFFL RECS 505, PAGE 470 TRANSCRIPT OF THE PROCEEDING OF THE MEETING TO INCORPORATE THE TOWN OF CAPE CANAVERAL, SAID TOWN BEING LOCATED IN BREVARD COUNTY, FLORIDA, AND HELD AT THE PORT WAREHOUSE, PORT. CANAVERAL, BREVARD COUNTY, FLORIDA, AT 3:00 P.M., 2 JUNE 1962. REGISTRATION: All electors attending the meeting were required to sign affidavits before a Notary Public that they were qualified to vote; whereupon they received a ballot. Affidavits have been filed with the duly elected Clerk at 214 East Jefferson Avenue in Cape Canaveral, Florida. A list of qualified voters, being all the male and female inhabitants who were freeholders and registered voters, was obtained from the County Superintendent of Registration and said list was used to aid in determining the number of resident freeholders and registered voters. NOTICE TO ASSEMBLE AND ORGANIZE: The meeting was called to order by R. A. Jamieson, Chairman of the Committee for Incorporation. An invocation was given by Mr. Harry Coulter. QUALIFIED ELECTORS: The number of qualified electors who were freeholders and registered voters residing within the area described in the notice to assemble and organize a municipal government for the area described in said notice, as attached hereto, made a part hereof and marked Attachment "1" was two hundred sixty one (261) . The number actually present who signed affidavits that they were resident freeholders and registered voters was two hundred thirteen (213). Attached hereto, made a part hereof and marked Attachment "2", is a certification of the committee accepting affidavits and distributing ballots for the vote on the Town limits, Town name and Town seal. ELECTION BOARD: An Election Board consisting of eleven (11) members was appointed by R. A. Jamieson, Chairman. Said Board consisted of the following: Alice B. Scabarozi, Conrad Beaulieu, Norma Markham, Roy W. Staton, Ellen Tucker, 2 OFFLS RECS 505 PAGE 471 Leo B. Collins, Margaret Littler, Rose Marie Lenie, Ann Nagy, Kenneth McCabe and Shirley Lackner. TERRITORIAL LIMITS OF THE CORPORATION: The territorial limits of the municipality, described by metes and bounds an mentioned in Attachment "1", were read by the Chairman, R. A. Jamieson and are as follows: 'The tract of land situated in Sections 14, 15 22, 23, 26 and 27 of Township 24 South, Range 37 East and being all of that land lying south of the South limits of the Cape Canaveral Missile Test Annex (AFMTC) and North of a line described as follows: Beginning at the intersection of the South Line of Lot 21 in Banana River Estates, as recorded in Plat Book 10, page 1 of the Public Records of Brevard County and the East Shore Line of Banana River; thence along the South Line of Lot 21 in an easterly direction to the westerly R/W line of Palm Avenue (SR No. 401); thence continue along the easterly extension of last described line to the East R/W line of Palm Avenue (SR No. 401) ; thence northerly along the East R/W line of said Palm Avenue ' (SR No. 401) approximately 2440 feet to a point in the middle of Block 73, in Avon-By-the-Sea subdivision which is the point separating Lot 1 and Lot 9 in said block 73; thence easterly along the rear line of the lots in Blocks 73, 74, 75, 76, being the blocks bounded on the North by Johnson Avenue and on the South by Grant Avenue to the intersection of this line with the shores of the Atlantic Ocean; excepting the lands owned by the Canaveral Port. Authority and /or any additional Government owned lands as of January 12, 1962, and including all littoral and riparian rights pertaining thereto.' The territorial limits as read by Chairman,. R. A. Jamieson were submitted to the qualified electors for their approval and a vote was taken. The ballots were picked up and the Election Board tabulated the results thereof. 3 OFFLS RECS 505 PAGE 472 The results were as follows: 205 for the proposed limits as just read and 6 against the proposed limits as just read. An affidavit as to the count by the Election Board is attached hereto, made a part hereof and marked ' Attachment No. 3'. It was then announced that the Territorial Limits of the proposed Corporation were as described in the attached legal notice 'Attachment No. 1' and as just read. CORPORATE SEAL: A copy of a Corporate Seal was submitted to the qualified electors for their approval and upon which a vote was taken. The ballots were collected and tabulated by the Election Board. The results were as follows: 205 for the displayed seal and 5 against the displayed seal. An affidavit as to the count by the Election Board in attached hereto, made a part hereof and marked 'Attachment No. 4.' It was then announced that the Corporate Seal would be as displayed hereon. STYLE OR NAME OF CORPORATION. The name of 'CAPE CANAVERAL' was submitted to the qualified electors and a vote was taken. The ballots were collected and tabulated by the Election Board. The results were as follows: 205 for the name 'CAPE CANAVERAL and seven (7) against the name "CAPE CANAVERAL". An affidavit aso to the count of by the Election Board is attached hereto, made a part hereof and marked "Attachment No. 3. NUMBER OF ALDERMEN: By a standing vote the Chairman requested suggestions from the qualified electors as to the number of Aldermen there should be: such number being any number from five (5) through nine (9) Aldermen. By an overwhelming majority it was decided that the number of Aldermen should be five (5) . ELECTION OF MAYOR: The Chairman opened up the floor to the qualified electors for 4 OFFLS RECS 505 PAGE 473 the nomination of people to the office of Mayor. Whereupon it was moved and seconded that the following names be submitted for the office of Mayor of Cape Canaveral: Jack Hurck, R. A. Jamieson, B. B. Purcell and Leo B. Collins (who declined the nomination). Whereupon by ballot that was collected by the Election Board the results were tabulated as follows: Jack Hurck, twenty (20); R. A. Jamieson, ninety seven (97) and H. B. Purcell, forty six (46). An affidavit as to the count by the Election Board in attached hereto, made a part hereof and marked " Attachment No. 5." ELECTION OF ALDERMEN: The Chairman opened up the floor to the qualified electors for the nomination of people to the offices of Aldermen. Whereupon it was moved and seconded that the following names be submitted for the office of Alderman: C. F. Applegate, Leo B. Collins, George G. Rogers, B. B.Purcell, Jack Hurck, Don Clayton, A. D. Anderson, William J. Eberwein. Whereupon by ballot that was collected by the Election Board the results were tabulated as follows: C. F. Applegate, one hundred thirteen (113) ; Leo B. Collins, seventy two (72) ; George G. Rogers, seventy six (76); B. B. Purcell, sixty (60); Jack Hurck, fifty nine (59) ; Don Clayton, sixty five (65); A. D. Anderson, ninety four (94); William J. Eberwein, ninety six (96). An affidavit as to the count by the Election Board is attached hereto, made a part hereof and marked "Attainment No. 5". It was then anoounced that the five Aldermen were: C. F. Applegate, William J. Eberwein, A. D. Anderson, George G. Rogers and Leo B. Collins. TOWN CLERK: The Chairman opened up the floor to the qualified electors for the nomination of people to the office of Town Clerk. Whereupon the only name submitted for the office of Town Clerk was Jean Taylor. A MOTION was made and duly seconded that the nominations for the office of Town Clerk be closed. The Motion passed unanimously. MARSHAL: The Chairman opened up the floor to the qualified electors for the nomination of people to the office of Marshal. Whereupon it was moved and seconded that the following names be submitted for the office of Marshal of the Town of Cape Canaveral: Fred C. DeFuniak, G. J. Salvaggio and Roy W. Staton. 4 5 OFFL' RECS 505 PAGE 474 Whereupon by ballot that was collected by the Election Board the results were tabulated as follows: Fred 0. DeFuniak, forty one (41); G.J. Salvaggio, thirty five (35); and Roy W. Staton, fifty four (54) . An affidavit as to the count by the Election Board is attached hereto, made a part hereof and marked "Attachment No. 5". It was then announced that the Marshal of the Town of Cape Canaveral was Roy W. Staton and the Town Clerk was Jean K. Taylor. COMMENTS BY CHAIRMAN: The Chairman publicly thanked the Notaries Public and the members of the Brevard County Sheriff's Department for their presence at the meeting. Mayor R. A. Jamieson announced that the first meeting of the Council of the Town of Cape Canaveral would be held Tuesday, June 5, 1962, at 7:30 P.M., at the Cooca Palms Trailor Park recreation hall. We, the undersigned committee, appointed to accept notarized affidavits of the freeholders and registered voters within the area seeking incorporation, hereby certify that a total number of two hundred thirteen (213) affidavits were filed and that at the commencement of the meeting two hundred twelve (212) freeholders and registered voters had signed affidavits. We also certify that we distributed a printed ballot for the territorial limits, the seal and the name of the Town to each person so presenting us with a notarized affidavit.
