THE MEETING WAS CALLED TO ORDER AT 7:30 P.M. BY
MAYOR RUTHERFORD
COUNCIL MEMBERS PRESENT WERE: MAYOR W. RUTHERFORD, J. CALVERT,
J. FISCHETTI,. L. NICHOLAS AND J. WINCHESTER.
COUNCIL MEMBERS ABSENT WERE: NONE
ALSO PRESENT WERE: CITY MANAGER F. NUTT AND CITY ATTORNEY

ITEM 1. DISCUSSION RE: CITY FACILITIES
COUNCIL HAD BEFORE THEM A MEMORANDUM FROM CITY MANAGER F.
NUTT. HIS RECOMMENDATION WAS THAT THE LIBRARY REMAIN WHERE IT
IS FOR THE PRESENT TIME BECAUSE THE CITY HAS A NUMBER OF YEARS
LEFT ON THE PRESENT LEASE. HE ALSO EXPLAINED THAT SPACE NEEDS
OF CITY HALL CAN BE ADDRESSED FOR THE PRESENT TIME THROUGH
UTILIZATION OF PORTIONS OF THE POLICE DEPARTMENT BUILDING.
HE FURTHER RECOMMENDED THAT THE RECREATION BOARD AND CITY
STAFF BE ALLOWED TO PURSUE A STUDY FOR A NEW RECREATION BUILDING.

IT WAS POINTED OUT BY CITY MANAGER F. NUTT THAT THE RECREATION
DIRECTOR HAS REQUESTED THE LIFEGUARD STATIONS BE MORE STRATEGICALLY
-LOCATED BY PLACCIING STATIONS AT PIERCE, TYLER AND MADISON AVENUES.
HE NOTED THAT THE TOTAL COST TO THE CITY WILL BE $3,000. AGENDA.
ITEM 2. DISCUSSION ARE: REFUSE CONTRACT
MR. NUTT RECOMMENDED TO COUNCIL THAT THEY EXTEND THE CURRENT
CONTRACT WITH WESTERN WASTE INDUSTRIES FOR ONE YEAR. AGENDA.

CONCERN WAS EXPRESSED ABOUT THE WAY THE LOT WAS SPLIT WITH
ONE LOT IN FRONT AND ONE, IN BACK. IT WAS POINTED OUT THAT THIS
COULD SET A PRECEDENCE IN THE CENTRAL AVENUE AREA. MAYOR RUTHERFORD
POINTED OUT THAT ALTHOUGH IT MAY NOT BE COSMETICALLY APPEALING, PLAT
PLAN APPROVAL CANNOT BE DENIED AS LONG AS THE REGULATIONS SET FORTH
IN THE CITY CODES ARE FOLLOWED.

ITEM 5. ORDINANCE RE: NATIONAL FIRE PREVENTION CODE (PERMISSION
TO ADVERTISE - TUESDAY MARCH 6
MR. NUTT EXPLAINED THAT THE LIFE SAFETY -CODE -WAS ADOPTED IN 1978 AS
PART OF CODE CHAPTER 621, FIRE PREVENTION CODE. HOWEVER, WHEN
THIS CHAPTER WAS REVISED TO ADOPT THE STANDARD FIRE PREVENTION
CODE - 1982 EDITION, THE LIFE SAFETY CODE WAS OMITTED. IT WAS
FURTHER NOTED THAT THE FIRE DEPARTMENT HAS RECOMMENDED THAT THIS
CODE, AND ALSO THE NATIONAL FIRE PREVENTION CODE, BE ADOPTED.

ITEM 6. DISCUSSION RE: AMENDING ORDINANCE 27-83 SPECIAL
INSPECTOR - THRESHOLD BUILDINGS
CITY MANAGER NUTT EXPLAINED TO COUNCIL THAT OUR ORDINANCE ON
THRESHOLD INSPECTORS REQUIRES AN ERRORS AND OMISSIONS BOND FOR
ONE MILLION DOLLARS TO BE POSTED BY AND FOR THE SPECIAL INSPECTOR
TO THE CITY OF CAPE CANAVERAL. THE QUESTION THAT IS NOW RAISED
IS DOES THIS PROVISION MEAN ONE MILLION DOLLARS COVERAGE FOR
EACH OCCURENCE OR IN THE AGGREGATE? THE CITY ATTORNEY IS OF THE
OPINION THAT THE ONE MILLION DOLLAR LIMIT IS FOR EACH OCCURENCE.
MR. KELLER, ACTING BUILDING OFFICIAL, REQUESTED COUNCIL
CONSIDER LOWERING THIS AMOUNT TO $500,000 PER OCCURENCE -$1,000,000.
DISCUSSION FOLLOWED. IT WAS NOTED THAT THE .COST OF THE ONE MILLION
DOLLAR PER OCCURENCE REQUIREMENT IS PROHIBITIVE,,IF AVAILABLE.
MR. KELLER-POINTED OUT TO COUNCIL THAT TWO CONTRACTORS ARE PLANNING
TO PULL THEIR PERMITS NEXT WEEK AND IF THIS CLAUSE IS IN THE

ORDINANCE, THEY WILL BE UNABLE TO GET A THRESHOLD INSPECTOR AND
POSSIBLY GIVE THEM GROUNDS FOR A LAWSUIT AGAINST THE CITY. MR.
NICHOLAS QUESTIONED THE CITY ATTORNEY AS TO WHETHER OR NOT AN
EMERGENCY ORDINANCE WAS IN ORDER. MR. SCOTT SAID HE WOULD RESEARCH
THE MATTER AND GIVE THEM AN ANSWER AT TUESDAY'S MEETING. HOWEVER,
IN THE MEANTIME, HE SUGGESTED PLACING AN AMENDING ORDINANCE ON
THE AGENDA FOR PERMISSION TO ADVERTISE.
DISCUSSION
MR. FISCHETTI REPORTED THAT HE HAD A LETTER FROM ZAYRE'S
STATING THEY. DID NOT WISH TO LOCATE IN THE CITY.
MR. WINCHESTER QUESTIONED THE PROCEDURE OF MR. KELLER BEING
IN THE POSITION TO APPROVE THE LOCATION FOR HIS OWN BUSINESS. HE
ALSO QUESTIONED THE LEGALITY OF MR. KELLER BEING IN A POSITION TO
APPROVE HIS OWN EMPLOYEES AS THREHOLD INSPECTORS. THE CITY ATTORNEY
IS GOING TO RESEARCH.
MR. NICHOLAS NOTED THAT HE WOULD LIKE THE CITY MANAGER TO
RESEARCH LIBRARIAN IRENE SANDER'S RETIREMENT BENEFITS. IT WAS
BROUGHT TO HIS ATTENTION THAT THERE WAS A TRANSITIONAL PERIOD
BETWEEN THE TIME SHE WORKED FOR THE CITY AND STARTED. TO WORK.
FOR THE COUNTY THAT SHE WAS NOT COVERED UNDER THE PENSION PLAN.
CITY MANAGER F. NUTT TOLD COUNCIL THAT THE NEW BUILDING
OFFICIAL, D. SALVUCCI, IS SCHEDULED TO START WORK ON MARCH 7TH.
HE ALSO MENTIONED THAT THE COUNTY IS EVIDENTLY DOING THE TRAFFIC
STUDY THAT THE CITY REQUESTED AT NORTH ATLANTIC AVENUE AND CENTRAL
BOULEVARD AS THE COUNTER WAS IN PLACE AT THAT LOCATION.
MR. SCOTT GAVE A REPORT OF THE PENDING LITIGATION:
THE LONG POINT ROAD APPEAL WILL BE IN ORAL ARGUEMENT
IN 5 O 6 MONTHS. ALSO, THE HEARING ON THE TWO BOTTLE CLUBS WILL
BE NEXT WEEK.
THE QUESTION WAS BROUGHT UP ABOUT THE COMMUNITY STANDARDS
ACT. MR. SCOTT EXPLAINED THAT OUR NUDITY ORDINANCE IS TIED TO
THE LIQUOR LICENSE. AND HAS BEEN UPHELD IN COURT. HE FURTHER NOTED

with regard to facility needs. Copies of the responses
are attached.
After examing the matter closer, I believe the City should
approach the facility issue in phases. A new recreation
building should be constructed at the Recreation Complex
to replace the present facility. This new building should
be of adequate size to handle present and anticipated
activities with provisions for future expansion when
necessary. A building of 2,000 to 2,500 square feet
would be acceptable.
Space needs of City Hall can be addressed in the short
run through utilization of portions of the Police Building.
The Sheriff does not anticipate the need to use the entire
building for much longer as he intends to relocate a number
of the units now using the Police Building. The long range
needs of City Hall can be addressed better as we analyze the
impact of growth in the community as it occurs.

Hoard be able to develop a multi-year growth plan with
guaranteed funding to support the need for larger facilities,
we could propose a new building at that time. Also, should
the event arise that Cityfunds needed to be expended for

At this time, it would be advisable to allow the Recreation
Board, in conjunction with City staff, to undertake a study
to develop new recreation building. A preliminary building
plan and cost estimates can be developed which will lead to
a recommendation to proceed with construction. I would
propose further that the Library and City Hall facility needs
be examined after the vote on Amendment 1 has occurred.

SUBJECT: Library Facilities
In response to your memo of February 23, 1984 concerning
new library facilities, I was unable to get a quorum for
a meeting of the library board. I have contacted four mem-
bers of the board and explained what you have requested.
I gave them figures that I came up with regarding future
library facilities, which they thought were satisfactory.
Following is a comparison of the present library facilities
and future needs:
Present building 4,800 sa.ft.-would like to increase to
1O Uu - 12 000 so.ft.
Auditorium- presently 27x29 ft,which is probably adequate,
but
wou like a Conference room approximately 16x18 ft.
for smaller meetings.
Books- presently 31,744 volumes, would like to increase to
af—Zeast 60,00 volumes, with emphasis on a much stronger
reference department.
Children's section- presently 26x19 ft., should be at least

We will be discussing this further at our next library board
meeting, scheduled for March 6th.

The -District II Recreation and Parks Department. is in the
process of initiating the upcoming 1984 Lifeguard Prog-
ram. Actual weekend lifeguard coverage will begin April
14 on the Brevard County beaches,.
Attached is a proposed agreement between the City of Cape
Canaveral and the Board of County Commissioners to provide
Joint funding of the lifeguard services on the municipal
beaches of Cape Canaveral.
If you have any questions, or need additional information
concerning the agreement or services proposed, please do
not hesitate to contact me.

RE: Refuse Contract
I have had discussion with representatives of Western Waste
Industries concerning an extension of .the present Garbage
and Rubbish Collection Agreement. The agreement allows for
one-yearextensions with approval of .both parties, and
Western Waste is agreeable to an extension.
I recommend the City extend the agreement for an additional
year. This will allow time for an evaluation of services
provided by. Western. Waste as well as allow us to prepare
specifications for service changes and a long-term agreement.
If the Mayor and City Counil agree with the concept of a
one-year extension, we can have a Resolution and agreement
prepared for the March 6th Council Meeting.

RE: Fire Codes

To bring the City into line with other municipalities, the
Life Safety Code and the National Fire Prevention Code
need to be adopted. The Fire Department has recommended
that these codes be adopted. The City adopted the Life
Safety Code in 1978 as part of Code Chapter 621, "Fire
Prevention Code". However, when this Chapter was revised
to adopt the Standard Fire Prevention. Code- 1982 Edition,
the Life Safety Cade was omitted.
I request that the Mayor and City Council approve the
advertising of adoption of these codes at this time.
We will provide a formal presentation on the content and
impact of the Codes at the March 15 Workshop meeting.

RE: ORDINANCE J27-83,SPECIAL' INSPECTOR - THRESHOLD
BUILDING
When Ordinance No. 27-83 was adopted, we anticipated that
changes may be necessary as implementation began. The
Ordinance provides that an Errors and omissions Bond for
one million dollars be posted by and for the Special
Inspector to the City of Cape Canaveral. The question that
is now raised is does this provision mean one million
dollars coverage for each occurence or in the aggregate?
The City Attorney is of the opinion that the one million
dollar limit is for each occurence.
in researching this matter with other jurisidctions, we
have found that those which require bond have accepted
policies which allow for a $500,000 per occurrence,
$1,000,000 aggregate coverage, with the exception of
Titusville, which requires $5,000,000 coverage. Threshold
inspectors are having difficulty obtaining insurance policies
at a reasonable rate which comply with the City's coverage
requirements. Their concern is that the premiums for the
coverage, if obtainable, will drive the cost of construction
upward, with the cost passed on to the buyers.
The Mayor and City Council are requested to review this
provision and act accordingly.

Threshold Inspectors

Refer City Code 623 Threshold Inspectors, Sec. 623.03 (C). (attached)
The intent of this section for insurance/bond was to establish an.ladditinal liability
between the Building Official (city) and the Developer/Builder/Contractor.
The current wording of "—bond payable to the City of Cape Canaveral" is wrong and was

hastily written, thou4h with proper intent.
The wording should be "A million dollars in the aggregate, of4liability insurance
payable on behalf of the inspector should liability incur from his actions."
There are three jurisdictions which accept $500,000/1,000,000 insurance policies as
required insurance (Cocoa Beach, County, "Ielbour"POLED
The inspectors currenty available to Developers for work on buildings to soon go up
in cape Canaveral cannot obtain insurance that miplies with the wording of our present
ordinance.
It is recogmended that the inspectors available wbo have,: the 500,000/1,000,000 type
personal liability policies be alluded to perform as Special Inspectors and that the
ordinance wording be changed.
