HomeMy WebLinkAboutMinutes 03-29-1984 WorkshopCITY COUNCIL WORKSHOP MEETING MARCH 29, 1984 THE CITY COUNCIL OF THE CITY OF CAPE CANAVERAL, FLORIDA, HELD A WORKSHOP MEETING ON MARCH 29, 1984 AT CITY HALL, 105 POLK AVENUE, CAPE CANAVERAL, FLORIDA. THE MEETING WAS CALLED TO ORDER AT 7:30 P.M. BY MAYOR RUTHERFORD. COUNCIL MEMBERS PRESENT WERE: MAYOR RUTHERFORD, MAYOR PRO TEM J. CALVERT, COUNCIL MEMBERS J. FISCHETTI AND L. NICHOLAS. COUNCIL MEMBERS ABSENT WERE: J. WINCHESTER ALSO PRESENT WERE: CITY MANAGER, F. NUTT, AND CITY ATTORNEY J. SCOTT. .MR. BOB MURKSHE ADDRESSED THE COUNCIL REGARDING BEACH EROSION,. STATING. THAT SAND HAD BEEN PUMPED ON TO THE BEACHES IN 1975 FROM THE TRIDENT BASIN. IN 1985, IT IS EXPECTED THAT THIS WILL HAVE ToBEDONE AGAIN. THE .CITY WILL HAVE TO CONTACT THE CORPS OF ENGINEERS AND. HAVE THEM COME OUT AND LOOK OVER THE BEACH. THIS WOULD REQUIRE FUNDING AND APPROVAL. JOAN CALVERT TOLD THE COUNCIL THAT SHE WOULD LIKE THE CITY TO BEGIN TAKING ACTION NOW ON THIS MATTER. COUNCIL WISHES TO AGENDA TO MAKE B. MURKSHE OFFICIAL REPRESENTATIVE TO THE GOVERNMENT ON BEACH EROSION. SUGGESTED BY J.FISCHETTI. ITEM 1. SCOTT EXPLAINED IT IS A MISDEMEANOR WHICH IS A.$500.00 FINE AND SIXTY DAYS IN JAIL. NEW BUSINESS ITEM 1. ORDINANCE N2.2 SUBDIVISION OF LAND AMENDING CODE CHAPTER 0 PERMISSION TO ADVERTISE DISCUSSION BY COUNCIL ON CHANGE IN PROCEDURES IN SUBDIVISION OF LAND. PLANNING AND ZONING BOARD HAS REVIEWED THIS ORDINANCE. TUESDAY AGENDA. PERMISSION TO ADVERTISE. ITEM 2. ORDINANCE NO. 8-84 AMENDING ZONING ORDINANCE PERMISSION TO ADVERTISE COUNCIL HAD BEFORE THEM A MEMO FROM THE CITY MANAGER OUTLINING THE CHANGES TO THE ZONING ORDINANCE, WHICH WERE RECOMMENDED BY THE PLANNING AND ZONING BOARD (WHICH IS ATTACHED HERETO). ITEM 1 WAS REFERRED BACK TO THE PLANNING AND ZONING BOARD. COUNCIL SUGGESTED THAT THE OTHER CHANGES BE BROKEN DOWN IN FOUR SECTIONS AND VOTED ON SEPARATELY. THERE WAS THEN A DISCUSSION BY COUNCIL AND CITIZENS ON THE DEFINITIONS OF WALLS AND FENCES. AGENDA. PERMISSION TO ADVERTISE FOR APRIL 3. ITEM 3. DISCUSSION AE: REGULATIONS FOR CITY PARKS (CODE CHAPTER 0 F. NUTT .DISCUSSED THE LITTLE LEAGUE BALLPARK ISSUE AND EXPLAINED THAT CITIZENS HAD COMPLAINED ABOUT LIGHTS AND NOISE ON LITTLE LEAGUE NIGHTS. (SEE ATTACHED MEMO). Chapter 606 of the City Code provides that City Parks close no later than 10:30 P.M. In checking with other jurisdictions, we found that most have established 11-00 P.M. as a closing time, but through administration policy, call for nothing to begin after 9:30 to 10:30 P.M. I met with Mr. Ted Smith of the Cape Canaveral Little League who provided a copy of the Little League's rules which call for the field to be cleared by 9:30 P.M.. Mr. Smith assured me that the Little League will abide by these rules. BOX 226 TELEPHONE 205 2WIN March 29, 1984 M E M O R A N D U M TO: Mayer and City Council FROM: City Manager RE: PLANNING AND ZONING BOARD RECOMMENDATIONS The Planning and Zoning Board has recently recommended changes to the Zoning Ordinance for City Council action. The changes can be incorporated into one ordinance for ease of advertising and discussion. Proposed changes are: 1. SECTION 637.51 AT END OF PARAGRAPH "H"... EXCEPT FOR RETAIL SALES FOR OFF -PREMISE CONSUMPTION OF BEER AND WINE." (FROM 2-22 PfiZ MEETING) 2. SECTION 645.05 PARAGRAPH (4): "IN THOSE SITE PLANS WHICH REQUIRE A SUBDIVISION OF LAND, NO SITE PLAN SHALL BE APPROVED UNTIL THE PLANNING AND ZONING BOARD HAS GIVEN APPROVAL TO THE PRELIMINARY PLAT'. (FROM 3-14-84 PSZ BOARD MEETING) 3. DEFINITIONS: a. Right -of -Way - Land reserved, used or to be used for a street, alley, walkway, drainage facility or other public. purpose. b. Easement - A right-of-way granted for limited use of pryproperty for a public or quasi -public purpose. c. Dedication - The deliberate appropriation of land by Its -owner any general and public uses, reserving to himself no other rights than such as are compatible with the full exercise and enjoyment of the public uses to which the property has been devoted. • With regard to walls, the following has been proposed: 1. All newly constructed walls are to be finished on both sides within seven days. 2. Any and all words or symbols to be covered within seven days by the wall's owner. 3. No wall shall be built along unimproved property .boundaries unless the owner has obtained building permit for the principal structure. 4. That portion of'a wall in excess of 4 feet in height, between two or more parcels of land, shall be 50% open to light and air. This would apply to areas zoned residential.
