Air Filling Station - Fluid Concepts, $9,735.00
The fire hose bid recommendation is based upon other bidders
deviating from specifications. The Air Filling station bid is
for single phase wiring. Three phase wiring would cost $310.00
less.

hose and coupling can be funded. It is recommended that the

DISCUSSION FOLLOWED. MR. NUTT NOTED THAT NO TOP COAT WAS NECESSARY
DUE TO THE THICKNESS OF THE LAYERS OF ASPHALT. HE FURTHER NOTED
THAT SOME ROUGH SPOTS ON CAROLINE STREET WILL SMOOTH OUT WITH THE
HEAT AND TRAFFIC.

COUNCIL DISCUSSED THE PROPOSED REVISION TO THE SIGN CODE.
MR. HOWARD WARREN ADDRESSED COUNCIL AND REQUESTED THEY DELETE
THE PORTABLE SIGN PORTION OF .THE ORDINANCE. CITY ATTORNEY SCOTT
EXPLAINED TO COUNCIL THAT MR. WARREN HAD A CASE PENDING BEFORE THE
CODE ENFORCEMENT BOARD REGARDING A VIOLATION TO THE SIGN CODE. MR.
SCOTT FURTHER NOTED THAT HE NEEDED A CONSENSUS OF COUNCIL REGARDING
ANY PROPOSED CHANGES TO THE PORTABLE SIGN SECTION OF THE ORDINANCE
FOR THE CODE ENFORCEMENT BOARD. DISCUSSION FOLLOWED. IT WAS THE
CONSENSUS OF COUNCIL THAT THE SIGN CODE WOULD BE DISCUSSED AT TWO
MORE WORKSHOP MEETINGS AND TWO REGULAR COUNCIL MEETINGS) THEREFORE,
THEY WOULD NOT COMMIT THEMSELVES TO AN OPINION ON THE PORTABLE SIGNS

RE: 1984-85 BUDGET
During the Budget Workshop of August 7, certain revisions to
the 1984-85 Proposed Budget were discussed. If approved by
the Mayor and City Council, the revisions would include:
1. A'cost of living increase for School Crossing Guards,
increasing the Public Safety Account by $277.00.
2. Elimination of the requested additional Deputy Sheriff
and associated costs, reducing the Public .Safety Account
by $22,551.00.
3. An increase of $500 in the Beautification Board account
for promotional activities.
4. A reallocation of $10,000 in the Sewer Fund from Note
Reduction to Machinery and Equipment.

RE: CITY MANAGER'S REPORT
1. I havemet with Harry Wild of .Briley, Wild and. Associates
to further discuss the concept of impact fees to fund
public improvements. He advised that though the acceptance
of impact fees is still in a gray area, impact fees are
beginning to be looked at more favorably by the courts
and legislators as alternative financing sources in light
of the growth now taking place in Florida. Mr. Wild has
suggested ways that the City staff may be able to prepare
analyses for substantiation of an impact fee program. He
has volunteered, at no cost, to offer guidance and direction
for us to attempt an in-house approach. I will keep the
Mayor and City Council apprised of our progress.
2. In a related matter, the developer of the Village of Seaport
has notified us that the developer will bear the financial
responsibility to install a traffic signal on North Atlantic
Avenue when determined to be warranted by ,the County Traffic
Engineer. -

RE: POLICE SERVICES AGREEMENT
The agreement with the Sheriff for Police Services for 1984-85
needs to be adopted prior to October 1. Attached is the 1983-
84 Agreement for your review. In recent discussions with the
Sheriff's Office, two areas may need to be revised.
First, to provide that the City receive experienced personnel,
the Sheriff proposes that a clause be added requiring a minimum
of one year's law enforcement experience. Second, some provision
is needed to provide that the Sheriff pay for maintenance and
operating costs for its space in the Public Safety Building.
These areas should be clarified by next Tuesday's City Council
meeting.
At the August 7 Budget. Workshop, it was discussed that the
current level of police service was desired. The proposed cost
for this service is $389,886.00.

RE: ACCEPTANCE OF THE CANAVERAL BEACH GARDENS
RESURFACING PROJECT

Seaview Materials has completed the Canaveral Beach Gardens
Resurfacing Project percontract. The City needs to formally
accept the project so that the assessments can be charged to
the property owners.
The actual cost of the project was less than the estimated
amount, which necessitated a reduction in the assessment roll
as permitted by Florida Statutes.The new assessment rate is
$4.23 per front foot. .The estimated assessment rate was $5.51.
I recommend that the Mayor and City Council accept the
Canaveral Beach Gardens Resurfacing Project and authorize the
assessment of $4.23, per front foot upon the affected property.

RE: LATE CHARGES ON UTILITY PAYMENTS
After reviewing the City's policy on penalty charges for late
payment of utility service fees, the staff recommends that
certain changes be adopted. As we currently bill for sewer
and garbage services onthe same notice, the delinquency
dates should be consistent,. but Code Section 671.11 for sewer,
and Section 673.11 for garbage,specify different times for
payment to be delinquent. Also, the charge for reconnection
for sewer service of $1.50 is too low.
We request that the Mayor and City Council grant permission
to advertise changes to Chapter 671 and 673 to institute
penalty charges for delinquent utility payments.

RE: THRESHOLD INSPECTOR.'
As previously. discussed, the Florida Legislature has amended
the Special Threshold Building Inspector statute. Part of
the changes are in effect now and the remainder are effective
October 1, 1984. In order to comply with the amended statute,
the City needs to revise Code Chapter 623.
Attached is a proposed ordinance to bring the City in to
compliance.
In order to begin the review process, I recommend that the
Mayor and City Council authorize. advertisement of an amendment
to Code Chapter 623 at this time.

The Planningand-Zoning Board has recommended the attached
revision to the City's Sign Code. As a related matter, and
as aresult of a case before the City's Code Enforcement
Hoard, Mr. Howard Warren has requested that the Mayor and
city. Council eliminate the portable sign section of the
Sign Code.
The Mayor and Council need to grant permission to advertise
the amendment at this time.

RE: BUILDING PERMIT AND DEVELOPMENT FEES
In order to update the City's Building Permit fee structure,
we are proposing that the Chapter 547 be amended. The
Southern Building Code Congress International publishes a
report entitled Building Valuation Data" which provides the
average per square foot cost for various types of construction.
This data is used by Building Officials to analyze costs of
projects, and for calculating buildingpermit fees.
The City currently has established a value lower than that
found in the Building Valuation Data document. The attached
amendment to Chapter 547 allows for adoption of the "Building
Valuation Data" schedule as the basis for determining valuation
of projects. This will bring us into conformity with other
Jurisdictions in the county.

Replace the present wording:
"Total valuation for residential permit fees shall be
based on a value of $35.00 per square foot for all
living areas and $15.00 per square foot'for garages,
basements, carports, and enclosed patios and porches.
A building permit fee for commercial structures shall
be based upon the owner's declared value, as approved
by the Building Official."
