THE MEETING WAS CALLED TO ORDER AT 7:30 P.M. BY MAYOR RUTHERFORD. OFFICIALS PRESENT WERE MAYOR W. RUTHERFORD, MAYOR PRO TEM J. WINCHESTER, COUNCIL MEMBERS J. FISCHETTI, M. MARCHETTI AND L. NICHOLAS. ALSO PRESENT WERE CITY MANAGER F. NUTT, CITY ATTORNEY J. SCOTT AND CITY CLERK J. LESSER. IT WAS DECIDED THAT THE COUNCIL MEMBERS WOULD RETAIN THEIR SAME AREAS OF INTEREST AS LAST YEAR WITH MR. 14ARCHETTI ASSUMING THE AREAS MRS. CALVERT HAD WITH THE EXCEPTION OF POLICE WHICH WOULD BE GIVEN TO MR. WINCHESTER IN EXCHANGE FOR THE PLANNING 6 ZONING BOARD. AGENDA. NEW BUSINESS ITEM 1. CITY MANAGER'S REPORT CITY MANAGER NUTT RECAPPED HIS WRITTEN REPORT WHICH IS ATTACHED HERETO AND MADE A PART HEREOF. ITEM 2, DISCUSSION RE: DUAL TAXATION LAWSUIT MR. NUTT EXPLAINED THAT MR. JOHN DeVAULT, COUNSEL ON THIS LAWSUIT, HAS SUGGESTED THAT THE BREVARD MUNICIPALITIES CONSIDER WAITING UNTIL THE PENSACOLA CASE IS REVIEWED AND A DECISION ISSUED, BEFORE A POLICY IS ADOPTED TO PROCEED OR CEASE LITIGATION. NO FORMAL ACTION IS REQUIRED BY COUNCIL AT THIS TIME. ITEM 3.. DISCUSSION RE: 4QGASOLINE TAX CITY MANAGER NUTT EXPLAINED THAT THE CITY OF TITUSVILLE RAS REQUESTED THE BREVARD LEAGUE OF' MUNICIPALITIES SUPPORT THE LOCAL CITY COUNCIL PARK9iOP MEEPING NOVEMBER 29, 1984 PAGE 1 OF 3 OPTION GASOLINE TAX. DISCUSSION FOLLOWED. THE CONSENSUS OF COUNCIL IS THAT THIS TAX WOULD NOT HAVE MUCH APPLICATION IN THE CITY. AGENDA A MOTION TO EXPRESS COUNCIL'S VIEWS TO THE BREVARD LEAGUE. ITEM 4. DISCUSSION RE: STORM DAMAGE AND EROSION MAYOR RUTHERFORD HAD JUST RETURNED FROM A MEETING OF THE BREVARD EROSION CONTROL TASK FORCE AND RECAPPED SOME OFTHE STEPS THEY ARE TAKING TO DEAL WITH THE SEVERE EROSION CAUSED BY THE STORM LAST WEEK: 1. HAVING A DNA ENGINEER LOCATED. AT COCOA BEACH CITY HALL. 2.. LOBBYING BOB SASR AREA .RE AEAGAN TODECLARE BREVARDADI 3. URGING LOCAL BANKS TO POOL RESOUCES AND OFFER LOANS AT LOW INTEREST RATES. IN OTHER ACTION, THE BREVARD COUNTY BOARD OF COUNTY COMMISSIONERS PASSED AN EMERGENCY ORDINANCE ISSUING A120 -DAY TEMPORARY MORATORIUM ON THE ISSUANCE OF BUILDING PERMITS WITHIN 25 FEET OF THE COASTAL CONSTRUCTION CONTROL LINE. DISCUSSION FOLLOWED AND COUNCIL DECIDED. TO AGENDA THE FOLLOWING ITEMS: 1. AN EMERGENCY ORDINANCE ESTABLISHING A 30 -DAY TEMPORARY MORATORIUM ON THETHE COASTALANCE OF CONSTRUCTIONING CONTROLITS ITHIN LINE. 2. A RESOLUTION SUPPORTING THE BOARD OF COUNTY COMMISSIONERS REQUEST THAT PROCLAMATION OF DISACOUNTY BSTER FORFLORIDA'SDIN EASTTGOVERNOR'S COAST. COUNCIL FURTHER DECIDED TO SEND A TELEGRAM TO. BOTH PRESIDENT REAGAN AND GOVERNOR. GRAHAM URGING THEM TO DELCARE BREVARD COUNTY A DISASTER AREA. ITEM 5. As a result of the passage of the waterfront access and acquisition referendum, the County is now looking for suitable properties. We have completed a highly successful United Way Campaign among City employees. A total of 508 of the employees made pledges totaling $1,037.00. 3. pursuant to our contract with Port Canaveral for fire- fighting protection, they are required to pay one-third of the fire department's operating budget in quarterly installments. It is our position that this is irrelevant, and the Port has breached the fire- fighting agreement. The Port contract allows only for drant the exclusion of three line items, those being by rental, hydrant installation and fireworks. However, the contract is not to be looked at as a line by line budget to the. Porto but rather as an agreement to provide services for a previously agreed upon dollar amount which was pegged to the operating budget. Bob Matte has included a cover letter and comments. Subsequent. to Mr. Matte's letter, Mr. DeVault and Mr. Tsamoutales discussed the case, and are now of the opinion that the Brevard municipalities might consider waiting until the Pensacola case is re- viewed and a decision issued,before a policy is adopted to proceed or cease litigation. t4 7YO-- Fre er cc C. BO% 220 TELEPHONE 205 793-1100 November 29, 1984 M E M O R A N D U M TO: MAYOR AND CITY COUNCIL FROM- CITY MANAGER RE: STORM DAMAGE AND EROSION The City was fortunate that we did not receive the severity of damage from this past weekend's storm that the rest of the County endured. No City structures were damaged, but the beach suffered a large erosion of sand. Loss of forty to fifty feet of beachfront was not uncommon. In some areas, however, sand was deposited, resulting in an in- creased elevation of six to twelve inches. The primary dune line was breached in few locations,causing ocean water to run down some street ends and on to some private property. The area of most concern was from Madison Avenue to the North City limits. Water reached Ridgewood Avenue at Surf and Central, and approached the first floor units at Canaveral Sands Condominiums. The state and federal Emergency Management teams are currently assessing the damage to Brevard County to determine if State or Federal aid is warranted. An Erosion Advisory. COMM ttee has been formed to review the impact of the beach erosion. Immediate action from the state or federal governments is fenses, or much more needed to address the weakened beach de destruction may occur if we encounter another storm of similar magnitude this winter. This practice has been established to recognize the performance of City employees throughout the year. , The formula, utilized to award the bonuses for full time employees, has been $25.00 for the first year of service and r. Part me ployees eived $12.50 for the hfirst tyear land ai $15.00 foreachmadditionalcyear. I recommend that this policy be continued this year.
