ORDINANCE NO. 7 -87
AN ORDINANCE OF THE CITY OF CAPE CANAVERAL,
BREVARD COUNTY, FLORIDA, CHANGING THE
DISTRICT BOUNDARIES (REZONING) CERTAIN
PARCELS OF LAND; PROVIDING THAT SUCH CHANGES
TO THE ZONING DISTRICTS SHALL NOT BECOME
EFFECTIVE UNTIL THEY HAVE BEEN DULY ENTERED
UPON THE OFFICIAL ZONING MAP; BY AUTHORIZING
SUCH CHANGES TO BE MADE ON THE OFFICIAL
ZONING MAP AND AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE SAID CHANGES ON THE OFFICIAL
ZONING MAP; REPEALING ALL PORTIONS OF THE
CODE IN CONFLICT HEREWITH; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Florida Statutes and the Zoning Code empower the City
of Cape Canaveral to change the district boundaries; and
WHEREAS, the Planning and Zoning Board has made a recommen-
dation and held public hearings thereon, and has submitted its
final report to the City Council; and
WHEREAS, due public notice of hearings relating to the change
in zoning districts have been given;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City
of Cape Canaveral, Brevard County, Florida, as follows:
SECTION 1. Pursuant to Section 633.01, of the Zoning
Ordinance of the Code of Ordinances of the City of Cape Canaveral,
Florida, the following changes in district boundaries are hereby
made. A map depiciting the exact locations and dimensions of
subject changes is attached hereto and made a part hereof by
reference.
1. Rezone from C -1 (Coiximercial) to R -3 (Medium Density
Residential) Parcel 754 and a portion of Parcel 750,
Section 15, Township 24 South, Range 37 East (located
west of Gateway to the Stars Motel).
2. Rezone from R -3 (Medium Density Residential) to C -1
(Commercial) the State of Florida Internal Improvement
Fund Property and a portion of Parcel 2, Section 15,
Township 24 South, Range 37 East (located west of
State Road A1A in the northern section of the City).
3. Rezone from M -1 (Light Industrial) to C -1 (Commercial)
a 500 foot strip east of State Road A1A in the north-
ern part of the city, including the State of Florida
Internal Improvement Fund Property, a portion of
Parcel 2, a portion of Parcel 750 and a portion of
Parcel 756, Section 15, Township 24 South, Range 37
East.
4. Rezone from R -2 (Medium Density Residential) to M -1
(Light Industrial) Parcels 258, 259, 260 and 261,
Section 14, Township 24 South, Range 37 East (property
owned by Rinker Materials located in the northern end
of the City, near George King Boulevard).

5. Rezone from M -1 (Light Industrial) to C -1 (Commercial)
the northern 500 feet of Parcel 15, Section 14,
Township 24 South, Range 37 East (located in the
northern section of the City immediately east of
Belcher Oil Company).
SECTION 2. The changes in district boundaries provided for in
Section 1 shall not become effective until said changes have been
duly entered upon the Official Zoning Map, purusant to Section
633.01, Zoning Ordinance of the City of Cape Canaveral, Florida.
SECTION 3. The Official Zoning Map of the City of Cape
Canaveral, Florida, referred to in Section 633.01, Zoning Ordinance
of the City of Cape Cape Canaveral, Florida, shall be amended in
accordance with this Ordinance, and the Mayor and City Clerk are
hereby authorized to place their signatures on said Official Zoning
Map in accordance with Section 633.01.
SECTION 4. All portions of the Code in conflict herewith are
hereby repealed.
SECTION 5. This ordinance shall become effective immediately
upon its adoption, and the zoning classifications changes as
provided for in this Ordinance shall become effective as provided
for in Section 633.01 of the Zoning Ordinance of the Code of
Ordinances of the City of Cape Canaveral, Florida.
