AN ORDINANCE PROHIBITING THE REMOVAL OF
SAND, SHELL, GRAVEL AND OTHER EARTHEN
MATERIAL FROM THE OCEAN BEACH WITHIN THE
LIMITS OF THE CITY OF CAPE CANAVERAL; PRO-
VIDING PENALTY FOR THE VIOLATION THEREOF;
AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE CANAVERAL, FLORIDA,
AS FOLLOWS:
WHEREAS, the City of Cape Canaveral has full and complete juris-
diction over the ocean beach extending from the ocean bluff to the

low water mark of the spring tides within the limits of the said
City; and
WHEREAS, the removal of sand, shell, gravel and other earthen
material from the said ocean beach subjects the beach to danger from
erosion resulting from the wash of the tides and the action of wind
and endangers the bluff and the property of persons owning property
to the bluff and on the beach to ,ordinary high water mark;
NOW, THEREFORE, BE IT ORDAINED:
SECTION 1 : It shall be unlawful for any person to remove any
in excess of 1 cu ft
sand, shell, gravel and other earthen materiaj/ from the ocean beach
within the limits of the City of Cape Canaveral between the ocean
bluff and the low water mark of the spring tides.
SECTION 2: Any person violating any of the provisions hereof
shall, upon conviction, be punished by being fined in an amount not
exceeding five hundred dollars ($500.00), or by being imprisoned for
a period not to exceed sixty (60) days, or by both such fine and
imprisonment.
SECTION 3: All ordinances, or parts of ordinances, in conflict
herewith be, and the same are hereby, . repealed.
SECTION 4: The method of publication of this ordinance shall be
in conformance with applicable Florida Statutes.
SECTION 5: This ordinance shall become effective immediately
uponits adoption.
