AN ORDINANCE PROVIDING FOR THE LICENSING
OF ALL CATS AND DOGS WITHIN THE CORPORATE
LIMITS or THE CITY OP CAPE CANAVERAL;
PROHIBITING DOGS FROM RUNNING AT LARGE
WITHIN THE CORPORATE LIMITS OF THE CITY
Or CAPE CANAVERAL; AUTHORIZING THE IMPOUND-
ING AND DESTRUCTION OF CATS AND DOGS;
PROVIDING A PENALTY FOP. THE VIOLATION
HEREOF; PROVIDING THE METHOD OF PUBLICATION
HEREOF; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL or THE CITY Or CAPE
CA,IAVER.AL, FLORIDA, AS FOLLOWS:
SECTION 1. DEFINITION Or TERMS. As used in this
ordinance, unless the context otherwise indicates:
(a) "Cat and Dog" shall be intended to mean both
male and female.
(b) "OWNER" shall be intended to mean any person
or .persons, firm, association or corporation owning, keening; or
harboring a dog or cat.
(c) "At large" shall be intended to neap off the
premises of the owner', and not under the .control of the owner
or member of his immediate family either by leash, cord, chain
or otherwise. A dor accompanied by it's owner or member of the
owner's immediate family, with or without leash, is not at larEe.
SECTION 2. LICENSE: AND P.EGISTRATION REQUIRED. All
cats or dogs kent, harbored, or maintained by their owners in the
City of Cape Canaveral shall be licensed and registered if over
three (3) months of are. Cat and Dog licenses shall be issued
by the City Clerk upon payment of a license tax of $1.00 for
each male or spayed female, and $1.00 for each unspayed female.

The owner ;hall state at the time application is made for such
license and upon printed forms provided for such purpose his
name and address, and the name, breed, color and sex of each
cat and dog otmcd or kept by him. The provisions of this section
shall not be intended to apply to cats and dogs whose owners are
nonresidents temporarily within the City, nor to dogs or cats
brought into the City for the purpose of rarticinatirg in any
cat or dog show, nor to "seeing -eye" dogs properly trained to
assist blind persons when such dogs are actually being used by
blind persons for the purpose of aiding them in going from place
to place.
SECTION 3. Pll'LII'IC AT LAPEL rPOH13ITCD. It shall be
unlawful to permit any doC to run at large.
SLCTION 4.. IMPO1j:IDI?1r. It shall be the duty of every
police officer or dogcatcher to apprehend any dog, found running
at large .contrary to the provisions of Section 3 and to impound
such dog in the City nourd or other suitable nlace. The round -
master (or some other dp,;irnated official) upon recr_ivinr any dog
or cat shall make a complete registry, entering the breed, color,
and sex of such dog and whether licensed.

dog or cat. The following, charges shall be paid to the City
of Cape Canaveral:
For impoundinr any dog or cat --------- $2.00
For keeninp inv dor or cat ------------ $1.00 daily
For givinr notice --------------------- S2.00
SECTION 6. DISPOSITION OF UNCLAIMED OP. IMrECTED
DOGS OP. CATS. It shall be the duty of theDound- master to keep
all dogs or cats so impounded for a period of seven (7) days.
If at the expiration of seven (7) days from the date of notice
to the owner or the posting'of notice such dog or cat shall not
have been redeemed, it may be destroyed or given by the humane
officer to another person. Any unlicensed dog or cat required
by law to be licensed, or any dog or cat which appears to he
suffering from rabies or affected with hydrophobia, mange or
other infectious or dangerous disease shall not be released
but may be forthwith destroved.
SECTION 7. co,iriMEMENT OF CERTAIN DOCS OR CATS.
No dop or cat of fierce, dangerous or vicious propensities and
no female dog in heat, :whether licensed or not, shall be allow-
. ed to run at .large or upon the premises of one other thar. the
owner. If any such dog or cat is found running, at large in
violation of this provision it shall be taken and impounded
and shall not be released exr-ept upon approval of the Hunane
Officer, Mayor, or an Alderman after payment of the fees
; rovided in Section 5; provided however, that if any dangerous
fierce, or vicious dog or cat so found at large, cannot be
safely taken up and impounded, such dog or cat nay be slain
by any policeman.
SECTION B. MUZZLINC. '7henever it becomes necessary
to saferuard the public from the dangers of hydrophobia, the
Mayor, if he deems it necessary, shall issue a proclanetion
ordering every person owning or ?:coping a dog or cat to

confine it 'securely on his promises unless such dog or cat
'shall have .a muzzle of sufficent strength to prevent its biting
any person. Any unmuzzled dog or cat running at large during,
the time of the proclamation shall be seized and impounded,
unless noticeably infected with rabies.. All dogs or cats so
noticeably infected with rabies and displaying vicious pro -
pensities shall be killed by the Police Department without
notice to the owner. Dogs or cats impounded during the first
two days of such proclamation shall, if claimed within five
(5) days, be released to the owner, unless infected with rabies,
upon payment of the impounding, charges provided in Section 5.
If unclaimed after that period, such dog or cat may be
summarily destroyed.
SECTION 9. PADIES-- FIOTICE . If a dog or cat is
believed to have rabies or has been bitten by a doe or cat
suspected of having rabies, such dog or cat shall be confined
by it leash or chain on the owner's premises and shall be
placed under the observation of a veterinarian at the expense
of the owner for a Period of two (2) weeks. The owner -shall
notify the round- master of the fact that his dog or cat has
been exposed to rabies and at his discretion the hound - master
is empowered to have such dog or cat removed from the owner's
premises to a veterinary hospital and there placed under
observation for a period of two (2) weeks at the expense of
the owner.
It shall be unlawful for any Person knowing or
suspecting a dog or cat has rabies to allow such dog or cat
to be taken off his premises or beyond the limits of the City
without the written permission of the pound - master. Every
owner, or other person, upon ascertaining a dog or cat is
rebid shall immediately notify the pound- master or policeman who
shall either remove the dog or cat to the pound or summarily
destroy it.

If any doe or cat is believed to have rabies or
any other contaricus dinease, and has not been confined to the
nremises of the owner as above . required, such dos or cat shall
be nicked up and impounded by the humane officer until the said
dog or cat is cured . in the discretion of the humane officer.
The humane officer shall be the sole judge as to the condition
of such dog or cat.
SECTION 10... VACCINATION. It shall be unlawful for
the owner of any dog, or cat to keep or maintain such dog or cat
unless it shall have been vaccinated by a licensed veterinary
.surgeon with anit- rabies vaccine, within one (1) year preceding
the date on which such dog or cat is kept or maintained.
SECTION 11. NUISANCE. When at least three (3)
citizens of the City of Cape Canaveral, residing in different
residences, shall report to the City that a dop or cat is a
nuisance, either by continuous barking or other annoyance, the
owner of such dog or cat shall be notified by the City that
his dog or cat is a nuisance, and a hearing shall be set
before the City Judge or P!ayor of Cape Canaveral cn such
charges and if, upon such hearing, such dog or cat shall be
declared to be a nuisance the owner shall have seven (7) days
to rectify the nuisance and if such nuisance is not rectified
the owner shall be deemed Guilty of a misdeameanor and punished
as .provided in this ordinance.
SECTION 12. PENALTIES. Any owner found violating
any provision of this ordinance shall be guilty of a misdeam-
eanor and upcn conviction thereof shall be punished by a fine not
exceeding $300.00, or imprisoned not exceeding 60 days, or by
both such fine and imprisonment.
SECTION 13. 9EPEAL Or CONrUCTING OHOINANCCS, All
existing ordinances of the City of Cape Canaveral are hereby
repealed insofar as they may be inconsistent with the provisions
of this ordinance.
