HomeMy WebLinkAboutOrdinance No. 06-1962 4 - 0'' 000' 00! 0' 0` 0000000; 000000 00000' MICROFILMED3_13:8oQ okb, Ar-7) ORDINANCE NUMBER — 6 Z AN ORDINANCE REGULATING ESTABLISHMENTS DEALING IN ALCOHOLIC BEVERAGES AS TO LOCATION AND SANITARY CONDITIONS WITHIN THE CITY LIMITS OF CAPE CANAVERAL, FLORIDA. BE= IT ORDAINED AND ENACTED by the Council of the City of Cape Canaveral of the County of Brevard, of the State of Florida. It is hereby ordained by authority of the same that : SECTION (1) DEFINITIONS For the purpose of this Ordinance the terms and their definitions shall be that as defined by Chapters 561 and 562 of the 1961 Florida Statutes . SECTION (2) MANUFACTURE, SALE, ETC. , TO BE IN ACCORDANCE WITH THIS ORDINANCE No person shall engage in the business of manufacturing, selling, distributing, bartering, changing or in anywise dealing in liquors, wines, beers or other beverages containing more than one per cent of alcohol by weight, within the City except under and in compliance with the provisions of this Ordinance . SECTION (3) LOCATION OF BUSINESS For the purpose of this Ordinance, any and all establishments dealing in .the use, consumption or sale of alcoholic beverages shall comply with the following: a. Said establishment shall be not less than 300 feet from any existing church grounds . b . Said establishment shall be not less than 300 feet from any existing school grounds . c, Said establishment shall be not less than 300 feet from any existing play grounds . d. For a manner of measurement , the prescribed amount of feet shall be measured in a straight line from the closest point of each respective properties . SECTION (5) INSPECTION OF PREMISES -BY CITY OFFICERS Every establishment provided for in this Ordinance shall agree that, as a condition to their being able to operate within the City limits of Cape Canaveral, the premises shall be subject to inspection or be searched by any police, health or sanitary . j o officer of the City at any time without a search warrant . Any licensee, agent, officer, employee or person in charge of an establishment who refuses to admit such City Officer or who hampers, hinders or interferes with any inspection or search made hereunder shall be subject to punishment as provided for in accordance with the applicable Ordinances and Florida Statutes . 0-7 SECTION . (6) MUNICIPAL LICENSE TAX a No person shall engage in the business of dealing in alcoholic beverages within the City limits of Cape Canaveral, unless they have paid a license tax of 50% of the State and County license tax as provided for in Chapter 561 of the 1961 Florida Statutes . Said license tax shall be paid to the City on or before the 15th day of September of each year. SECTION (7) PENALTY Any person violating any provision of this Ordinance shall upon conviction thereof, be punished as provided for in accordance with the applicable Ordinances and Florida Statutes . This Ordinance shall be in full force and effect from andafter its passage, approval,° recording, and publication as provided by law.
