AN ORDINANCE AMENDING ORDINANCE NO. 2 -83, CODE
CHAPTER 631, ZONING REGULATIONS OF THE CITY OF
CAPE CANAVERAL, FLORIDA; AMENDING SECTION 645.05,
"APPLICATION FOR BUILDING PERMIT" BY REQUIRING
ADDITIONAL REQUIREMENTS FOR SITE PLAN REVIEW;
REPEALING ALL PORTIONS OF THE CITY CODE IN CONFLICT
HEREWITH; PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the
City of Cape Canaveral, Florida, as follows:
SECTION 1. Section 645.05, "Application for Building
Permit ", Sections (A), (B) and (C) are hereby deleted in their
entirety and replaced with the following:
645.05 APPLICATION FOR BUILDING PERMIT
A. All applications for building permits for any new
structure and its accessory buildings shall be
accompanied by the following:
(1) 1, 2, or 3 residential units: 3 copies of structural
plans and 6 copies of site plan.
(2) 4 or more residential units: 6 copies of structural
plans, 6 copies of site plan, and 6 copies of land
survey, one of which is the original.
(3) Commercial structures: 6 copies of structural
plans, 6 copies of site plan, and 6 copies of land
survey, one of which is the original.
Land surveys shall be performed by a surveyor licensed in
the State of Florida and shall bear his signature and
seal. The survey shall show all property lines and the
location and dimensions of all existing or proposed
structures on the property, with the front, rear and
side setbacks clearly marked and showing the elevation
of the crown of the street nearest the principal
structure. The site plan shall be drawn at a scale of
not more than one (1) inch equal to fifty (50) feet
and shall show the following:
1. The actual dimensions and shape of the lot or
lots to be built upon, including the location
and actual boundaries of said lots, of any
abutting water courses and water bodies.
2. The exact dimensions and locations on the lot of
proposed and existing buildings.
3. The dimensions of the proposed buildings or alterations.
4. The location and layout of the proposed sewage system.
5. The required parking spaces, loading and unloading
spaces; maneuvering space and opening for ingress
and egress.
6. When applicable, grading and drainage plans showing
any and all cuts, fills and provisions for adequately
carrying off surface water on premises, plus
provisions for any surface water which would naturally
flow over or through the area.
7. The site plan and survey may be incorporated into
one document, with the necessary copies, providing
all the requirements of Paragraph A -1 through 6
are complied with.

8. Site plans, requests for special exceptions and
vacations of streets, alleys and easements shall
be submitted to the City Building Department,
not less than fourteen (14) days before the next
regular Planning and Zoning Board meeting. The
Building Department shall stamp the date and hour
of submittal upon one copy of the submitted plans
and /or documents.
9. The type of enclosure for and location of communal
type trash containers (dumpsters) shall be shown
on the site plans. Such type of enclosure shall be
subject to approval and acceptance of the Planning
and Zoning Board.
10. Such other information as lawfully may be required
by the Building Official, including existing or
proposed building or alteration; existing or
proposed uses of the building and land; the number
of families, housekeeping units or rental units
the building is designed to accommodate; conditions
existing on the lot, and such other matters as may
be necessary to determine conformance with and
provide for the enforcement of this Ordinance.
B. All plans, other than single, two- family and triplex
residences, shall be reviewed by the following depart-
ments, based on conformity with requirements:

1. City Engineer
2. Building Department
3. Planning and Zoning Board
4. Fire Marshal
5. Florida Department of Natural Resources (All
phases calling for buildings located on the
Atlantic Ocean and Banana River are to be reviewed
by this Department.)
The Building Official shall prepare a site plan check
list to be submitted to the Planning and Zoning Board
when a site plan is reviewed. The Building Official
shall transmit the applicable copies to the various
City Department Heads and the various boards involved,
for their review and comment. The review by the
Departments listed in 645.05(B) shall include, but
not be limited to, the following areas:
To insure that the size and spacing of water
mains and fire hydrants are adequate; to insure
that an orderly and safe traffic flow is permitted
within the site, and that no traffic problems are
created by the proposed ingress and egress routes;
that the plans provide adequate parking; to insure
that the plans comply with the Standard Building
Code and all other applicable codes and standards
which the City has enacted by Ordinance or
Resolution.
SECTION 2. Sections (D) through (J) of 645.05 shall remain
the same and in full force and effect.
SECTION 3. All portions of the City Code in conflict herewith
are hereby repealed.

SECTION 4. This Ordinance shall take effect immediately
upon its adoption.
