ORDINANCE NO. 6 -69 -
AN ORDINANCE AMENDING ORDINANCE NO. 81 -611 AS
AMENDED, BY AMENDING SUB - SECTION 1, Q OF SECTION
10 OF ARTICLE VI TO PROVIDE DISTA14CE AND OTHER
REQUIREMENTS FOR GASOLINE, FILLING, OIL OR SERVICE
STATIONS, PROVIDING AN EFFECTIVE DATE.
WHEREAS, .the Council of the City of Cape Canaveral, Florida,
desires to amend the City Zoning Ordinance regarding requirements
for gasoline, filling, oil, or service stations,
NOW, THEREFORE, be it ordained by the City Council of the City
of Cape Canaveral, Brevard County, Florida, as follows:
SECTION 1: Sub - section 1, Q of Section 6 Article V of Ordi-
nance 81 -64 as amended in its entirety to read as follows:
"R 1. Service stations which arc 2,000 feet apart
by shortest driving route, subject to provision
of Article VI, Section 10, or Ordinance 81 -64
as amended."
SECTION 2: Section 10 of Article VI of Ordinance 81 -64 as
amended, be and the same is hereby amended In its entirety to read
as follows:
"SECTION 10: Automobile, gasoline, or service station
requirements.
(a) No automobile, gasoline, filling, oil or
service station shall be permitted within
2000 feet of an existing station by shortest
driving route, measured along one side of
North Atlantic Avenue or Palm Avenue within
the City of Cape Canaveral, Florida.
(b) Minimum lot area: 15,000 square feet;
(c) Minimum lot width: 100 feet;
(d) Minim= lot depth: 100 feet;
(e) Maximum lot coverage: 25;x;
(f). Minimum floor area: 1,000 square feet;
(g) Maximum height: 25 feet;
(h) Minimum building set - backs: from any street -
40 feet; interior aide 25 feet; rear - 15 feet.
(1) Other minimum set -backs from any property line:
pump islands - 25 feet; canopy - 20 feet; signs,
portable or fixed - 15 feet; storage tanks -
15 feet.
And in addition, underground storage is required
for all recepticles for combustible materials in
excess of 55 gallons.

(j), Curb cuts: The number of curb cuts or drive-
ways shall not exceed two (2) for each street
frontage. Such curb cuts shall be a maximum
of thirty (30) feet wide and shall be located
no closer to any intersection than twenty -five
(25) feet and not closer to any rear or side
lot line than fifteen (15) feet.
Curb cuts and driveways shall be constructed
according to City specifications.
(k) No service station shall be erected or located
within one hundred fifty (150) feet of the prop-
. erty line of any church, hospital, school or
park.
(1) A visual screen meeting the specifications set
by the Planning and Zoning Board shall be pro -
vlded along any property line abutting a resi-
dential district.
(in) The following services and no others may be
carried on at automobile, gasoline, oil, filling,
or service stational to -wit:
1. Sale and dispensing at retail of gasoline,
oil, grease, batteries, tires and automo-
bile accessories;
2. Sale and servicing of spark plural batter-
. ies, and distributors and distributor parts;
3. Replacement of mufflers and tall pipes,
water hose, fan belts, brake fluid, light
bulbs, fuses, floor meta, seat covers, wind -
shield wipers and wiper blades, grease re-
talners, wheel bearings, mirrors, and the
like;
A. Radiator cleaning and flushing;
5. Washing and polishing, and sale of auto-
motive washing and polishing materials;
6. Greasing and lubrication;
7. Providing and repairing, fuel pumps, oil
pumps and lines;
8. Minor servicing and .repair of carburetors;
9. Emergency wiring repairs;
10. Adjusting and repairing brakes;
11. Minor motor adjustments not involving re-
moval of the head or crankcase or racing
the motor;
12. Sales of cold drinks, package foods, to-
bacco, and similar convenience goods for
service station customers, as accessory
and incidental to principal operation;
13• Provision of road maps and other informa-
tion material to customers, provision of
rentroom facilities;
14. Tire servicing and repair, but not recapp-
ing or regrooving;

(n) It is specifically set forth herein that uses
permissible at a service station do nctinclude
major mechanical and body work, straightening
of body parts, painting, welding, storage of
automobiles not in operating condition, or other
work involving noise, glare, fumes, smoke, or
other characteristics to an extent greater than
normally found in service stations. A service
station is not a major repair garage or a body
shop.
(o) service stations shall not be used as commercial
storage facilities for vehicles.
(p) Service bays shall not front on ,North Atlantic
Avenue or Palm Avenue.
(q) Removal of automobile engines is prohibited.
(r) Storage of trailers, campers and rental vehicles
on the premises is prohibited."
SECTION 3: All Ordinances and parts of Ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 4: This Ordinance shall take effect immediately upon its
adoption.
ADOPTED by the City Council of Cape Canaveral, Florida, this
