ORDINANCE NO. 8 -79
AN ORDINANCE AMENDING ZONING REGULATIONS OF THE
CODE OF THE CITY OF CAPE CANAVERAL, FLORIDA, BY
AMENDING THE DEFINITION FOR "MOBILE HOMES" AND
BY ADDING A DEFINITION FOR "MOBILE HOME PARKS"
(SECTION 631.01); BY ADDING "EXISTING MOBILE HOME.
PARKS" AS A PRINCIPAL USE IN THE R -3 ZONING DISTRICT
(SECTION 637.43); BY INCREASING THE MAXIMUM LOT
COVERAGE FOR MULTIPLE FAMILY, OFFICES, CHURCHES,
AND HOSPITALS IN THE R -3 ZONING DISTRICT (SECTION
637.51); BY REDUCING THE FRONTAGE AND DEPTH OF
MINIMUM LOT SIZE IN THE MH -1 ZONING DISTRICT
(SECTION 637.73); BY ELIMINATING CERTAIN SPECIFICATIONS
FOR OFF STREET PARKING IN THE MH -1 ZONING DISTRICT
(SECTION 637.75); BY ADDING "EXISTING MOBILE HOME
PARKS" AS A PRINCIPAL USE FOR THE C -1 ZONING DISTRICT
(SECTION 637.83); BY ADDING "SINGLE FAMILY AND
DUPLEXES" AS A SPECIAL EXCEPTION PERMITTED BY THE
BOARD OF ADJUSTMENT IN THE C -1 ZONING DISTRICT
(SECTION 637.87); BY INCREASING THE MAXIMUM LOT
COVERAGE FOR MULTIPLE FAMILY DWELLINGS IN THE C-1
ZONING DISTRICT (SECTION 637. 91); BY ADDING AREA AND
DIMENSION REGULATIONS AND MINIMUM SETBACK
REQUIREMENTS FOR SINGLE FAMILY AND TWO FAMILY
DWELLINGS IN THE C -1 ZONING DISTRICT (SECTION 637.92);.
AND BY ADDING "EXISTING MOBILE IE P R tP AS A P crnAL
"EXISTING
USE IN THE C -2 ZONING DISTRICT (SEETION638.0 3);
REPEALJNG ALL PORTIONS OF THE CODE IN CONFLICT
HEREWITH; PROVIDING AN EFFECTIVE DATE.

BE IT ORDAINED by the City Council of the City of Cape
Canaveral, Florida, as follows:
SECTION 1. Chapter 630 of the Code of the City of Cape
Canaveral, Florida, Zoning Regulations, is hereby amended as
follows:
(1) Section 631.01, Definitions: the following definition
is hereby added:
"Mobile Home Parks /Trailer Parks. A single parcel of ground
on which there are sites to be leased or rented to tenants
for the purpose of parking mobile homes or recreational
vehicles."
Delete the definition for "Dwelling, Mobile Home" and sub-
stitute therefor the following:
"(Dwelling) Mobile Home. A detached residential dwelling
unit over 8 feet in width, which bears a seal from the
Department of Housing and Urban Development of the United
States Government, designed for travel over highways /streets
or for house accommodations (or both), manufactured on an
integral chassis (or undercarriage) and arriving at the
site where it is to be occupied except for minor and
incidental and packing and assembly operations, locations
on jacks or other temporary or permanent foundations,
connections to utilities and the like."
The following definition is hereby added:
"Recreational Vehicle. Units designed as temporary living
quarters for recreational, camping, or travel use, which
either have their own motive power or are mounted on or
drawn by another vehicle. Includes travel trailer, camping
trailer, truck camper, motor home and wheel recreational
trailer."
(2) Section 637.43 of the R -3 Zoning District, Section
637.83 of the C -1 Zoning District, and Section 638.03 of the
C -2 Zoning District, are amended by the addition of the following
principal use:
"Mobile Home Parks in existence on October 28, 1975 provided
the number of spaces shall not exceed those licensed or
previously platted to said mobile home parks on that date,
and provided further that said mobile home parks 'shall not
exceed the limits of property also on that date under unity
of title ".
(3) Section 637.73, Area and Dimension Regulations of the
MH -1 Zoning District, is amended by changing the minimum lot size
as follows:
"An area not less than 6,000 square feet and having a
frontage of not less than 85 feet and having a depth
of not less than 70 feet ".
(4) Section 637.75, Off Street Parking, is deleted in its
entirety, and the following new paragraph substituted therefor:

"637.75 Off Street Parking. Off street parking and access to a
public or private street shall be provided in accordance with
Chapter 639 of this ordinance. "
(5) Section 637.87 of the C -1 Zoning District is amended by the
addition of the following Special Exception permissible by the Board of
Adjustment:
"Single Family and Duplexes"
(6) Section 637.51 of the R -3 Zoning District, Area and Dimension
Regulations, Maximum Lot Coverage, is amended by the deletion of the
following sentence:
"Multiple family and offices, churches and hospitals, 25 %"
and the following sentence substituted therefor:
"Multiple family and offices, churches and hospitals, 35%"
(7) Section 637.91 of the C -1 Zoning District, Area and Dimension
Regulations, Maximum Lot Coverage, is amended by the deletion of the
following sentence:
"Multiple family dwellings, 25%"
and the following sentence substituted therefor:
"Multiple family dwellings, 35%"
(8) Section 637.92 of the C -1 Zoning District is amended by the
addition of the following new Section:
"637. 92 (C -1 Zoning District) Single family and two family dwellings -
Area and Dimension Regulations and Minimum Setback Requirements
shall be the same as provided in Section 638.12, C-2 Zoning
District of this Ordinance. "
SECTION 2. All sections of the City Code in conflict herewith are
hereby repealed.
SECTION 3. This ordinance shall become effective immediately upon
its adoption.
