AN ORDINANCE AMENDING C APTER 630 OF THE CODE
OF THE CITY OF CAPE CANAVERAL, FLORIDA, ZONING
REGULATIONS, BY PROVIDING A DEFINITION OF OCEAN
FRONT LOTS AND PUBLIC ACCESS EASEMENT; BY
AMENDING DINENTIONAL REQUIREMENT FOR SIDE
INTERIOR LOTS IN THE R -2 AND R -3 ZONING DISTRICTS;
BY ELIMINATING REQUIREMENTS FOR ADDITIONAL THREE
FEET SETBACK FOR SECOND STORY OF A SINGLE FAMILY
RESIDENCE; BY PROVIDING FORA SIDE SETBACK OF TEN
MET ON OCEAN FRONT LOTS CONTIGUOUS WITH THE OCEAN
IN THE R -3 ZONING DISTRICT; BY DELETING THE PHRASE
"RESIDENTIAL" FROM ALL AREA AND DIMENSION REGULATIONS
IN THE R -3 ZONING DISTRICT; BY PROVIDING MINIMUM FLOOR
AREA REQUIREMENTS FOR OFFICE BUILDINGS AND OFFICE
UNITS IN THE R -3 ZONING DISTRICT; BY REPEALING ALL PARTS
OF THE CODE IN CONFLICT THEREWITH; BY PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CAPE
CANAVERAL, FLORIDA AS FOLLOWS:
Section 1. Chapter 630 of the Code of the City of Cape Canaveral,
Florida, Zoning Regulations, is hereby amended as follows:
(1) Section 631.01 is amended by the addition of the following
definitions:
"Oceanfront Lots -a lot that is contiguous with the ocean *beach
and which is considered as fronting an a public access easement
and include those lots adjacent to a dedicated street.
Public Access F.a.ement -an easement less than twenty feet wide
dedicated and used for utilities and vehicles. Not qualified
as an alley per subdivision code."
(2) Section 631.01 is amended as follows: The definition for Lot,
Frontage is deleted in its entirety and the following new definition
substituted therefore:
"Lot, Frontage -the front of a lot shall be construed to be the
portion nearest the street."
(3) Section 631.01 is amended by the deletion of the following
two sentences from the definition of Lot, Frontage:
"Fences, walls and hedges shall not exceed four feet in height
in any yard abutting a street. The applicable front setback
requirement shall apply to both frontages regardless of which
line the land owner elects as the front lot line."

(4) Section 637.31 and Section 637.51 are amended as follows;
The side interior lot minimum setback requirements in Zoning District R -2
and R - -3 are amended as follows: The three foot requirement for each story
above the first shall not apply to single family residences.
* Section 637.31 and Section 637.51 are amended as follows:
add the word "dwellings" after the words "rruhl tiple family".
(5) Section 637.51 is amended as follows: Minimum setback
requirement for side interior lots in the R -3 Zoning District is amended
by the addition of the following language. "Single family residence side
setback for fifty foot lots contiguous with the ocean is ten feet ".
(6) Section 637.51 is amended by deleting the word "residential"
from all Area and Dimension regulations in the R -3 Zoning District.
(7) Section 637.51 is amended by adding the following minimum
floor areas for office buildings and office units:
Office Buildings 1,050 square feet
Office Units 200 square feet
Section 2. All sections of the Code in conflict herewith are
hereby repealed.
Section 3. This Ordinance shall became effective immediately upon
its adoption.
ADOPTED by the City Council of the City of Cape Canaveral,
Florida on this 7 day of February , 1978.
