AN ORDINANCE AMENDING ORDINANCE NO. 10 -75
ZONING REGULATIONS OF THE CITY OF CAPE
CANAVERAL, FLORIDA , AMENDING SECTION 638.11
(C -2 Zoning District) BY MODIFYING AREA AND
DIMENSION REGULATIONS FOR SINGLE .FAMILY AND
TWO FAMILY DWELLING: ADDING SECTION 638.12
(C -2 Zoning District), SETTING AREA AND DIMENSION RE-
GULATIONS, AND MINIMUM SET BACK REQUIREMENTS;
AMENDING SECTION 637.31 (R -2 Zoning District) BY
ESTABLISHING MINIMUM SET BACK REQUIREMENTS
AMENDING SECTION 637.51 (R-3 Zoning District), BY
ESTABLISHING MINIMUM SET BACK REQUIREMENTS;
REPEALING ALL ORDINANCES AND PARTS THEREOF
OR PARTS OF THE CITY CODE IN CONFLICT HEREWITH;
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED by the City Council, of the City of Cape
Canaveral, Florida, as follows:
SECTION 1. The Zoning Ordinance of the City of Cape Canaveral,
Florida, being Ordinance No. 10 -75 is hereby amended as follows:
(a) Section 638.11 AREA AND DIMENSION REGULATIONS (C -2
Zoning District) is amended by adding:
Minimum Living Area per Multiple Family Dwelling 850 Sq. Ft.
(b) Section 638.12 SINGLE FAMILY AND TWO FAMILY DWELLINGS
AREA AND DIMENSION REGULATIONS
Minimum Lot Area: 10,000 Square Feet
Minimum Lot Width: 75 Feet
Minimum Lot Depth: 100 Feet
Maximum Lot Coverage: 30%
Minimum Living Area: 1, 100 Square Feet
Maximum Height: 25 Feet
MINIMUM SET BACK REQUIREMENTS
Front:
Side Interior Lot:
Side Corner Lot:
Rear:
25 Feet
8 Feet or 10% of Lot, whichever
is greater, up to 20 Feet

(c) Section 637.31 (R-2 Zoning District) MINIMUM SET BACK
REQUIREMENTS (Corner Lots) by deleting existing subparagraph (b) and
substituting the following:

(b) On all nonconforming lots of record as defined in
Chapter 643.03, on side corner lots there shall be
a minimum setback of 15 feet.
(d) Section 637.51 (R -3 Zoning District) MINIMUM SET BACK
REQUIREMENTS, for Side Interior Lots by adding the following:
One family, two family and multiple family, 8 Feet or
10% of width of lot, whichever is greater, up to 15 Feet,
plus 3 Feet for each story above the first
and for the Side Corner Lot by adding the following:
On all nonconforming lots of record as defined in Chapter
643.03, one family, two family, and multiple dwelling;
on side corner lots there shall be a minimum setback of
15 Feet.
SECTION 2. If any Section of this Ordinance is interpreted
by a Court of law to be invalid, illegal, or unconstitutional, any said
illegality and invalidity or unconsitutionality shall not extend to any other
provision or section of this Chapter.
SECTION 3. All conflicting ordinances or Charter provisions
are hereby repealed.
SECTION 4. This ordinance shall become effective immediately
upon its adoption.
ADOFTED by the City Council of the City of Cape Canaveral,
Florida this 4 day of October , 1977.
