ORDINANCE NO. 47 -73
AS AMENDED ON SECOND READING
AN ORDINANCE AMENDING ORDINANCE NO. 12 -71 AS
AMENDED, BY REVISING THE AREA AND DIMENSION
REGULATIONS OF THE R -3 ZONING DISTRICT; BY ES-
TABLISHING A FEE SCHEDULE FOR THE FILING OF A
PRELIMINARY RESIDENTIAL PLANNED UNIT DEVELOPMENT
PLAN; BY INCREASING THE FEE FOR THE FILING OF
THE FINAL RESIDENTIAL PLANNED UNIT DEVELOPMENT
PLAN; BY REVISING CERTAIN REQUIREMENTS FOR OFF -
STREET PARKING FOR FIVE OR MORE AUTOMOBILES; BY
REVISING THE SUPPLEMENTARY DISTRICT REGULATIONS
REGARDING ACCESSORY STRUCTURES BY PROVIDING AN
EXCEPTION FOR ONE AND TWO FAMILY RESIDENCES TO
ERECT ONE (1) SUCH STRUCTURE PER UNIT AND THE
SIZE DIMENSION THEREFOR AND DELETING THE PRO-
VISION FOR .SERVANTS' QUARTERS FOR SUCH ACCESSORY
STRUCTURES; BY REVISING THE PROCEDURE OF AMEND-
MENTS TO THIS ZONING ORDINANCE BY PROVIDING THAT
PUBLIC HEARINGS ON SAID AMENDMENTS WILL NOT BE
SCHEDULED UNTIL ZONING AND PLANNING BOARD HAS
SUBMITTED ITS RECOMMENDATIONS AND BY REVISING
THE TIME PERIOD OF THE PUBLICATION OF THE NOTICE
REQUIREMENTS OF SAID AMENDMENTS; BY REVISING
SCHEDULE OF FEES, CHARGES AND EXPENSES BY ADDITION
OF FEES FOR PRELIMINARY AND FINAL RESIDENTIAL
PLANNED UNIT DEVELOPMENT APPLICATIONS; REPEALING
ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH; PROVIDING AN EFFECTIVE DATE.
SECTION 1. Ordinance 12 -71, Zoning Regulations of the
City of Cape Canaveral, Florida, as amended, is hereby amended as
follows:
(a) Paragraph 5, Area and Dimension Regulations of the R -3
Multiple Family Dwelling District of Section VII, Schedule of
District Regulations Adopted, is amended as follows: The following
area and dimension regulations are deleted.
"Single . and two - family residential, multi- family
residential and offices,"
and the following Area and Dimension Regulations are substituted
therefor:

(b) Paragraph 4b. of Section entitled "RPUD Procedure For
Securing Approval of a Planned Unit Development" of Section VIII is
deleted in its entirety, and the following paragraph 4b. is substituted
therefor:

(c) Sub- paragraph 1(b) of Paragraph 2, entitled "Procedure"
under the Section entitled "RPUD Final Application" of Article -VIII
is deleted -in its entirety, and the following new sub- paragraph 2b. is
substituted therefor:
"b. A fee of $100 shall accompany the final application for
for the purpose of administration."
(d)
Sub - paragraph 1(c)(4) entitled "Off- street Parking and
Loading Requirements" of Section IX is deleted in its entirety and
the following paragraph 1(c)(4) substituted therefor:
"(4) Required off- street parking areas for five or more auto-
mobiles shall have individual spaces marked, and shall be so
designed, maintained and regulated that no parking or maneuver-
ing shall be on any landscaped buffer, public street, walk or
alley, and so that any automobile may be parked and unparked
without moving another, allowing however, a driveway or drive-
ways of not more than twenty -four (24) feet total . on any street
or alley for ingress or egress to said. °°off- streetarking area..

(e) Paragraph 4, "Accessory Structures" of Section XII
Supplementary District Regulations, is deleted in its entirety,
and the following new paragraph 4 substituted therefor:
"4. No accessory structure shall be erected in any required
front or side yard, and shall not cover more than 30% of
any required rear yard. No separate accessory structures
shall be erected within ten (10) feet of any building airy the
same lot nor within fifteen (15) feet of any lot line and shall
not exceed twenty -four (24) feet in height, except that one
and two - family residences may erect one (1) accessory structure
per unit, not to exceed one hundred (100) square feet with maximum
height of ten (10) feet if detached; or thirty -two (32) square
feet with maximum height of ten (10) feet if attached; in rear
yard regardless of set back. Accessory buildings shall be con-
structed simultaneously with, or following, the construction of
the main building. No-home occupation or" business may be con-
ducted in an'accessory building. No accessory building which
contains living quarters shall be built on any lot in any residen-
tial district."
(f) Paragraph 1(d) of Section XVIII, Amendments, is hereby
deleted in its entirety, and the following new sub - section 1(d) shall
be substituted therefor:
"d. No recommendation for change or amendment may be considered`
by the City Council until due public notice has been given of a
public hearing. Public notice of the hearing shall be given
only after the Zoning and Planning Board has submitted its re-
commendation for the change or amendment and said public notice
of the hearing shall be given at least ten (10) days in advance
of the hearing by the publication in a newspaper of regular and
general circulation of the City of Cape Canaveral and notice
shall be posted at City Hall."
(g) Section XIX, Schedule of Fees, Charges and Expenses is
hereby amended by the addition of the following language, immediately
following "Application for special exception of variance - $75.00."
"For RPUD fee see:
Section VIII, RPUD: Procedure for securing approval
of a Planned Unit Development
(4.b.)
and
Section VIII, RPUD: Final application (2.b.)"
SECTION 2. All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 3. This Ordinance shall become effective immediately
upon its adoption by the City of Cape Canaveral, Florida.
ADOPTED by the City Council of the City of Cape Canaveral,
Florida, this 20th day of November 1973.
