HomeMy WebLinkAboutOrdinance No. 18-1971MICROFILMED 3.14.80 ORDINANCE NO. 18 -71 (as amended) AN ORDINANCE AMENDING ORDINANCE 12 -71 WHICH AMENDS SECTION iV.i 'r11EREOF AS TO THE ZONING DISTRICT CLASSIFICATION CHANGING FROM M -2 AND M -3 CLASSIFICA- TION TO C -1 CLASSIFICATION A STRIP OF PROPERTY 400 FEET WIDE ALONG THE EAST SIDE OF HIGHWAY AIA FROM THE NORTII CITY LIMITS TO THE SECTION LINE; AND AMENDING SECTION VTll BY REDEFINING RESIDENTIAL PLANNED DEVELOPMENT THEREIN; AND AMENDING SECTION XVIII.1 AS TO NO'T'ICE REQUIRE ?IENTS TO PROPFRTY OWNERS WHERE A CHANGE OF ZONING CLASSIFI- CATION IS TIEING CONTEMPLATED; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL 01: THE CITY 01' CAPE CANAVERAL, FLORIDA, AS FOLLOWS: SECTION 1. That Section IV.1 of the City of Cape Canaveral Ordinance 12 -71 is hereby amended to reflect on the Official Zoning Map and Official Zoning District of the City of Cape Canaveral, a classifi- cation of C -1 for a strip of land 400 feet wide abutting the cast side of Highway AlA extending from the north City Limits south to the inter- section of Highway :11A and the Section Line between Sections 14 and 15, Township 24S, Range 37 E. The Official Zoning Nap shall be changed accordingly and said Official Zoning %fall, as amended, is hereby adopted by reference and declared to be part of this Ordinance. SECTION 2. That Section VIII is hereby amended as to the definition of residential planned unit development and shall read as follows: RPUD: Defined: For the purpose of this zoning ordinance an RPUD is defined as any residential use except mobile home developments and including the group of residential uses and town house developments for which a mini- mum of 100,000 square feet for town house developments, or a minimum of four (4) acres for all other types of development if intended to be 1 developed simultaneously. SECTION 3. That Section XVlli.l is amended by tine addition of paragraph (g) which shall read as follows: (g) When the City Council proposes a change in zoning classi- fication of a single parcel or a group of not more than five hundred (500) parcels of any property within its jurisdiction, it sliall be the duty of said Council to give notice by mail to each property owner whose zoning PAGE I OFZ MICROPILNIED 3.14.80 classification is proposed to be changed. Such notice shall be mailed to the owner's current address of record, as maintained by the assessor of taxes for the jurisdiction proposing the change and be postmarked no later than ten (10) days prior to the first scheduled hearing concerning the proposed change. The notice shall contain the legal description of the affected property, the existing zoning classification, the proposed zoning classification, and the time and place of any scheduled hearing concerning the proposed zoning change. Prior to the effective date of any zoning classification change, the City Council shall cause an affidavi to be filed with the City Clerk certifying that said Council has complied with the provisions of this section. 'file filing of said affidavit shall be prima facie proof of compliance with the requirements of this Section. A failure to give notice shall not affect the validity of zoning except as to the property of the complaining owner. SECTION 4. All ordinances in conflict herewith are hereby repealed. SECTION' 5.
