Activities and Projects Status Report
For Period Ending Friday, November 06, 2009
Activities
Barry attended the Florida Redevelopment Association Annual Conference
on October 28 and 29 in Orlando. The two most important takeaways were
(1) do CRA and Brownfield designations simultaneously as they require
the same public notice and public hearings and (2) anticipate Hometown
Democracy referendum passing next November and therefore have all comp
plan amendments, i.e. mixed use land use designations completed prior to
November.
Status of Land Use Applications and Site Plans
Young Subdivision - The Young’s want to split one residential lot into
two. They are waiting until the new plat ordinance is adopted and then
use the expedited lot split process.
Cape Caribe - The applicant's response to our review comments and
revised site plans were received in our office on Sept. 24 and were
distributed to staff for review on Sept. 28. Staff comments have been
received. Tree mitigation and stormwater are issues that have not been
addressed to the satisfaction of staff. Therefore staff is not planning
to take the site plan to P&Z until the Council has had an opportunity to
address the Development Agreement. Staff is currently preparing a draft
Development Agreement to present to the Council.
Mutter Annexation - Jack Mutter has requested that the City annex his
condo project at 315 Grant Ave. (corner of Ridgewood and Grant). A few
questions have been identified regarding annexation of a nonconforming
property (density, parking, etc.). Staff will confer with the City
Attorney and DCA and then meet again with the applicant.
Status of Construction Projects
Coastal Fuels – Continuing to monitor maintenance projects.
Tank #10 status:
* The floor of the tank has been repaired,
* New heating coils have been installed,
* They are in the process of installing the door sheet. Should
be completed and X-rayed by Tuesday (Nov-10th)
* Hydro-testing will be performed in the 3rd week of November

Tank #11 status:
* Cleaning contractor will start cleaning the sister tank to
tank-10 which is tank-11 on Monday (Nov-9th). That should take approx.
one month.

Tank #15 status:
* Will begin repairs on the floor, the floating lid and exterior
steps,
* When that is complete they will blast and coat the inside and
then blast and coat the outside. The old coating was tested for lead
and was found to be well under the maximum allowable.

Monroe Carwash – Construction is underway. The owner of the property
changed contractors and the permit was re-issued accordingly. Minor
plan revisions were submitted this week.
Saurenmann Addition – Construction permit has been issued. Recall that
this is the result of a negotiated settlement agreement involving the
League of Cities insurance department. The engineering and permit fees
were paid in accordance with the terms of the agreement. All that
remains is for Saurenmann to correct construction deficiencies detailed
at plan review. The permit is valid for 6 months.
Status of Special Projects
Visioning - The final Visioning Workshop was held Thursday October 22,
2009. The Regional Planning Council will prepare a final report within
three weeks that will include findings and recommendations.
Platting Ordinance - Revisions are being finalized and our intent is to
have the second reading of the ordinance on December 1, 2009.
Tree Protection Ordinance Revisions – The City Attorney’s office has
prepared a draft revision. Todd and Bennett reviewed it and comments
were sent back the City Attorney’s office. The final draft is ready and
will be on the November 18, 2009 P&Z Agenda.
Underground Utilities Ordinance - Revisions to this section of the code
will go to the P&Z Board for recommendation on November 18, 2009.
New Sign Code – We are now up to five inquiries specifically about
electronic sign regulations. No permit applications yet, though.
International Property Maintenance Code – Todd is reviewing the new
2009 International Property Maintenance Code. He will ask City Council
to consider adopting it in its entirety. It would replace the current
version adopted by our ordinance (1998 version).
Council Meeting Room A/V – A design contract was awarded to IM
Solutions of Melbourne. IM Solutions recently designed and installed
A/V systems for new City Council chambers for the City of Melbourne and
the City of Cocoa. They also designed and installed the system utilized
in the Port Commission Room. They understand that time is of the
essence and will work hard to produce the design ASAP.
6395 N. Atlantic Ave (old Azteca II Restaurant), and
290 Cape Shores Circle – These two buildings were posted unsafe and
“taped-off” with Caution tape. The postings were executed in accordance
with Standard Unsafe Building Abatement Code. This posting requires
the property owner to either obtain a permit to repair, or obtain a
permit to demolish. Whichever option is chosen, the permit must be
obtained and the work commenced within 60 days. Failure to meet this
requirement allows the City, at its own expense, to repair or demolish
the structure and file a lien on the property for all expenses incurred.
Another residential building located west of 290 Cape Shores Circle on
adjacent property was also posted unsafe.
