Per section 110-33(a)(2) of the City Code, an aggrieved party actually has “ten calendar days” from the date of the final BOA decision to file an appeal to the city council. Therefore, the deadline for Cumberland Farms to appeal the BOA decision to the City Council was yesterday. However, since yesterday was a Sunday, the applicant should have until the end of today to file an appeal. Have you heard anything from the applicant related to an appeal?
